A RESOLUTION AUTHORIZING PAYMENT NOT TO EXCEED
$30,000.00 TO WASHINGTON COUNTY AS THE CITY OF
FAYETTEVILLE'S SHARE OF THE COST OF ESTABLISHING AN
EMERGENCY OPERATIONS CENTER IN WASHINGTON
COUNTY; AND APPROVING A BUDGET ADJUSTMENT.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas
hereby authorizes payment not to exceed $30,000.00 to Washington County as
the City of Fayetteville's share of the cost of establishing an Emergency
Operations Center in Washington County.
Section 2. That the City Council of the City of Fayetteville, Arkansas
hereby approves a Budget Adjustment in the amount of $30,000.00.

SUBJECT: County -wide Emergency Operations Center
Recommendation
Staff requests City Council approve a cost -share with Washington County and approve a budget
adjustment for Fayetteville to participate with Washington County and Springdale in establishing a
county -wide emergency operations center.
Discussion
Both Fayetteville and Washington County have dealt with emergencies over the past two years that
have highlighted the need for more emergency preparedness. The 2004 flood and the region's
response to the 2005 hurricane events demonstrated the need to Netter prepare for natural disasters.
Budget Impact
Funding for this request is from General Fund reserves.

You may recall that at last month's Intergovernmental Council meeting, we discussed an
Emergency Operations Center in Washington County. Recent events with the hurricanes in the
gulf and the concerns with an outbreak of Avian Flu have made all of us more aware of the need
for a secure place for all city and county officials to gather in time of emergency.
We are now going forward with remodeling and equipping the Center. The Center will be
located in the former Juvenile Detention Center on Mill Street in Fayetteville. The layout and
security features of the building makes it better suited for an EOC than the location also being
considered in the Sheriff's Department annex on Clydesdale Drive. The remodeling costs will
be somewhat less at this location, providing more funds for hardware, software, and other
equipment needed for the operation of the Center.
This Center may be used for emergency operations in time of disaster, but can also be used as a
training center for emergency management training sessions. The Center will be open to both
Springdale and Fayetteville officials to use in time of emergency in their respective cities.
Washington County has committed $60,000 to this effort. We are asking the Cities of
Fayetteville and Springdale for a $30,000 commitment from each city to help fund this project.
Thank you for your consideration and cooperation in making this much-needed project a reality.
This is another example of the major cities working with the County to help make it a better
place to live for all of our citizens.

THIS AGREEMENT, is made pursuant to A.C.A. § 14-14-910, by and between the County
of Washington, Arkansas, (hereinafter referred to as the "County"), and the City of Fayetteville,
Arkansas, (hereinafter referred to as the "City").
WITNESSETH:
WHEREAS, the County as a part of its emergency operations plan pursuant to A.C.A.§12-
75-101 et. seq., and plans to build an emergency operations center which will be a self contained
centralized building from which emergency management can be performed; and,
WHEREAS, with the disasters of Hurricanes Katrina and Rita, the need for such has been
underscored and the County plans to begin the construction of said center immediately; and,
WHEREAS, officials of the City of Fayetteville will be able to utilize said center in the
event of a County -wide or City-wide emergency or disaster and other non-emereencv events that
may require additional resources or space.
NOW THEREFORE, IT IS AGREED:
ARTICLE 1. It is the intent of the parties to create a long standing and permanent
relationship with regard to the matters discussed herein The City and the County shall coordinate
their efforts to provide emergency services in the event of a disaster. Additionally, it is the intention
of the parties that the center may be utilized for non -emergency events that may require additional
resources or space.
ARTICLE 2. Either party may by majority vote of its respective goveming body elect to
terminate this agreement upon six (6) months written notice of such. This agreement may be
modified at any time upon majority vote of the governing bodies of both the parties.
ARTICLE 3. The parties shall keep a list of all property purchased in furthermore of this
agreement, appropriately marked for identification. In the event of termination of this agreement,
each party shall retain it's respective property or be entitled to receive the fair market value thereof.
One-time expenditures for remodeling or construction shall not be reimbursable.
ARTICLE 4. A Board is hereby established to administer this agreement and coordinate
the efforts necessary for the carrying out of this agreement. The Board shall consist of the County
Judge, the Mayor and one citizen at large to be agreed upon by the Judge and Mayor. It is agreed and
understood that Washington County is entering into a similar agreement with the City of Springdale
and that the Board created in that agreement shall constitute a joint Board with the Board created
herein.

is a member of separate Risk Management Program.

On February 9, the Washington County Quorum Court adopted Ordinance No. 2006-09
adopting an interlocal agreement between Washington County and the City of Fayetteville
regarding utilization of the Washington County Emergency Operations Center. A copy of
this ordinance is enclosed as well as two copies of the agreement which have both been
signed by County Judge Jerry Hunton.
Once the City Council approves the interlocal agreement, please sign both agreements
and return one copy to me. I have enclosed a self-addressed envelope for your use. The
other copy is for your records. I will also need a copy of the Council's ordinance approving
the agreement.

BE IT ORDAINED BY THE QUORUM COURT
OF THE COUNTY OF WASHINGTON,
STATE OF ARKANSAS, AN ORDINANCE
TO BE ENTITLED:
AN ORDINANCE ADOPTING AN INTERLOCAL
AGREEMENT BETWEEN WASHINGTON COUNTY,
ARKANSAS, AND THE CITY OF FAYETTEVILLE,
ARKANSAS, REGARDING UTILIZATION OF THE
WASHINGTON COUNTY EMERGENCY OPERATIONS
CENTER; AND DECLARING AN EMERGENCY.
WHEREAS, Washington County, as a part of its emergency

granted the authority to enter into such Agreement pursuant to Ark. Code Ann. §14-14-
910.
NOW, THEREFORE, BE IT ORDAINED BY THE QUORUM
COURT OF THE COUNTY OF WASHINGTON, STATE OF ARKANSAS:
ARTICLE 1. That said Interlocal Agreement, which is attached as
Exhibit "A" hereto and incorporated by reference as if set out fully word for word, is
hereby adopted.

upon passage.
