A RESOLUTION TO APPROVE A YEAR LONG AGREEMENT WITH
SEVEN HILLS HOMELESS BOARD AND THE YVONNE
RICHARDSON CENTER BOARD TO ALLOW USE OF THE
RICHARDSON CENTER BY SEVEN HILLS AS AN EMERGENCY
SHELTER DURING COLD WEATHER
WHEREAS, the City of Fayetteville, the Yvonne Richardson Center Board and
the Seven Hills Homeless Board desire to expand the availability of emergency overflow
homeless shelter during cold winter weather by allowing the use of the Richardson
Center during the nighttime hours (9:00 P.M. to 7:00 A.M.).
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby
approves the agreement attached as Exhibit A and authorizes Mayor Coody to sign this
Memorandum of Understanding.

MEMORANDUM OF UNDERSTAND BETWEEN THE SE. HILLS HOMELESS
CENTER AND THE RICHARDSON CENTER
Purposes of Agreement:
The Seven Hills Homeless Center operates a Day Center and Transitional Housing program for
homeless persons on a year round basis. However, when during the winter months (October -
March) the Center's daily hours are expanded and an Emergency Cold Weather Shelter is opened
on evenings in which the temperature drops below forty degrees. The Seven Hills Homeless
Center collaborates with the Salvation Army Shelter in Fayetteville to provide emergency shelter
on cold weather nights so that we are able to provide a safe refuge to those who otherwise would
be exposed to the elements. This collaboration has been successful for the past four years but as
Fayetteville and Northwest Arkansas continue to grow so to does our homeless population. This
reality calls for expanded preparedness in the event that the need for Emergency Cold Weather
Shelter becomes greater than the combined capacity of the Seven Hills Homeless Center and the
Salvation Army. Therefore, the Seven Hills Center Board has recommended that a partnership be
established with another facility so that in the event it is needed an over -flow cold weather
shelter for the homeless could be made available. The purpose of this agreement is solely
intended to establish a contingency option for use in extreme weather situations in which the
available shelter in Fayetteville is not sufficient to provide safe refuge for Fayetteville's homeless
citizens. This agreement in no way transfers program responsibility to the partnering facility.
This agreement is entered into between Seven Hills Homeless Center's Cold Weather Shelter
program (hereafter, the Sponsor) and the Yvonne Richardson Center_(hereafter. the Overflow
Shelter Site) for the 2005-2006 program year. The following is understood and agreed to by the
parties:
1) Duration.
This Understanding shall become effective on December 7, 2005 and shall terminate one
year from the effective date. unless terminated sooner.
2) Sponsor Responsibilities. The Sponsor will:
a. Conduct intake and assessment of cold weather shelter residents at Seven Hills
Homeless Center.
b. Make determination of shelter capacity and inform overflow shelter site
contact if additional cold weather shelter will be needed for the remainder of
the night.
c. Insure that a sponsor's representative is on site at the Richardson Center at all
times that the Richardson Center is used as a cold weather shelter.
Provide all supplies (blankets, cots, pillows, sheets, etc.) needed to provide a
cold weather shelter at the Richardson Center.
Coordinate security, as needed, with the Fayetteville Police Department to
insure the safety of shelter residents and of the overflow shelter site.
f. Screen shelter residents for potential intoxication and administer breathalyzer
or urine analysis when such a test is deemed necessary.
Transport shelter residents to the overflow shelter site after 9 pm and from the
overflow shelter site to Seven Hills Day center at 7am.
Insure that the overflow shelter site is cleaned and orderly before vacating the
property.
Maintain regular communication with overflow shelter site Director in order
to convey any pertinent information necessary for the efficient operation of
this project.
Assume all legal liability for the operation of this program.
3) Overflow Shelter Site Obligation. The site's responsible parties will:
Provide a name and contact information for Seven Hills staff in case of a need
for overflow shelter. if multiple contacts are responsible on different days the
overflow shelter site will provide a schedule detailing which contact should be
called, by day of the week.
Insure the provision of a key to the facility for use on occasions in which the
need for an overflow shelter is deemed necessary.
m. Maintain regular communication with Seven Hills Program Director in order
to convey any pertinent information necessary for the efficient operation of
this project.
4) Notices.
All notices and communication required to be given to the Sponsor by the overflow
shelter site, except as otherwise specifically provided, shall be directed to:

5) Amendments.
This Memorandum of Agreement may be amended at any time by an agreement in
writing executed by authorized representatives of the Sponsor and the overflow shelter
site.
6) Termination.
The Sponsor or overflow shelter site may terminate this Agreement at any time by giving
thirty (30) days notice in writing.
7) Authorization.
The Sponsor and the overflow shelter site hereby acknowledge by their signatures that they have
read, understand and agree to all terms and conditions of this agreement.
This agreement will remain in effect until the end of the program year, which is December 7,

Recommendation:
The Council authorizes the mayor to sign the Seven Hills l-lomeless Center's Cold
Weather Shelter Program Memorandum of Agreement.
Background:
Seven Hills operates an emergency cold weather shelter on evenings in which the
temperature drops below forty degrees. Because of the growing homeless population a
partnership has become necessary to establish another facility for use during "overflow"
situations. The Yvonne Richardson Center has been identified as a possible facility for
this shelter.
The purpose of this agreement is solely intended to establish a contingency option
for use in extreme weather situations in which the available shelter in Fayetteville is not
sufficient to provide safe refuge for Fayetteville's homeless citizens.
Discussion:
A copy of this memorandum of agreement is attached and has been signed by a
representative of Seven Hills and the Yvonne Richardson Center Board.
