A RESOLUTION TO MANAGE WASTEWATER COLLECTION
AND TREATMENT ACTIVITIES UNDER SECTION 208 OF THE
CLEAN WATER ACT
DESIGNATED MANAGEMENT AGENCY RESOLUTION
WHEREAS, the Arkansas Department of Environmental Quality has been designated by
the U.S. Environmental Protection Agency (EPA) to prepare the Section 208 Statewide Water
Quality Management Plan and the planning area includes all Counties in Arkansas; and
WHEREAS, the Environmental Protection Agency regulations published pursuant to
Section 208 of the Federal Water Pollution Control Act Amendments of 1972 require an annual
plan update and the designation of a management agency with the responsibilities thereto; and
WHEREAS, the Arkansas Department of Environmental Quality is the Designated
Management Agency to accomplish the continuing planning effort and will continue to
coordinate the continuing planning effort.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAYETTF,VILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby agrees to
accept the designation as the Designated Management Agency for wastewater collection and
treatment of domestic wastewater in the Fayetteville, Washington County, Arkansas service area
and assume the duties and responsibilities of that agency as outlined in the Statewide Water
Quality Management Plan.
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby agrees to
participate in and support the continuing Statewide Water Quality Management Planning Process
as outlined in the Plan.
Section 3: That the City Council of the City of Fayetteville, Arkansas hereby agrees to
accept the duties and responsibilities thereof.
PASSED and APPROVED this 15th day of November, 2005.

Subject: Resolution Stating that the City of Fayetteville is a Designated Management Agency for
Wastewater Collection and Treatment of Domestic Wastewater
RECOMMENDATION
Fayetteville City Administration recommends the City Council adopt the resolution designating the
City of Fayetteville as a Designated Management Agency for Wastewater Collection and
Treatment of Domestic Wastewater for the sewer system owned by the City of Fayetteville.
BACKGROUND
In order to secure a Revolving Loan Fund (RLF) loan with the Arkansas Natural Resources
Commission (previously the Arkansas Soil and Water Conservation Commission), the City
Council must adopt a resolution stating that the City of Fayetteville is a Designated Management
Agency for Wastewater Collection and Treatment of Domestic Wastewater.
DISCUSSION
This resolution is required pursuant to Section 208 of the Federal Water Pollution Control Act of
1972 as amended. It requires that the Designated Management Agency be formally identified as
such and execute an annual plan update. The City's Capital Improvement Plan, wastewater system
master plan, and annual budget meet the requirements of the annual plan update.
BUDGET IMPACT
Failure to adopt this resolution will result in the City being unable to obtain RLF funding.
