HomeMy WebLinkAbout214-05 RESOLUTIONRESOLUTION NO. 214-05 A RESOLUTION TO WAIVE DEVELOPMENT PERMIT FEES PURSUANT TO §159.01 (A) (1), UNIFIED DEVELOPMENT CODE FOR ALL STRUCTURES TO BE CONSTRUCTED BY THE BOTANICAL GARDEN SOCIETY OF THE OZARKS AT LAKE FAYETTEVILLE PARK. WHEREAS, the Botanical Garden Society of the Ozarks' development of botanical gardens at Lake Fayetteville Park will provide expanded cultural and recreational opportunities to the citizens of Fayetteville; and, WHEREAS, it serves the public interest and is beneficial to the City as a whole that the Botanical Garden Society of the Ozarks develop botanical gardens at Lake Fayetteville Park. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the City Council of the City of Fayetteville, Arkansas hereby finds that waiving the development permit fees set forth under §159.01, Unified Development Code for all structures to be constructed by the Botanical Garden Society of the Ozarks at Lake Fayetteville Park serves the public interest and is beneficial to the City as a whole. Section 2. That the City Council of the City of Fayetteville, Arkansas hereby waives the development permit fees set forth under §159.01, Unified Development Code for all structures to be constructed by the Botanical Garden Society of the Ozarks at Lake Fayetteville Park. Fees shall be imposed, as set forth below, to cover the cost of public notices and such other expenses as may be incurred in connection with processing of applications, plan reviews, amendments, permits, variances and other matters pertaining to the UDC. (1) An alderman may present a resolution to the City Council to waive, or reduce development permit fees otherwise required by this chapter, elsewhere within the Unified Development Code. If the reduction, or waiver would serve the public interest, alleviate an unfair burden upon an applicant, or be beneficial to the city as a whole, the Cihy Council may grant such reduction, or waiver of permit fee.
