RESOLUTION NO. 212-05
A RESOLUTION TO CONTINUE THE NEGOTIATION OF
THE OWNERSHIP AND THE OPERATION OF THE
GREENLAND AND/OR FARMINGTON SEWER
SYSTEMS.
WHEREAS, the Cities of Greenland and Farmington are interested in having the
City of Fayetteville take ownership and operate their sewer systems.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF FAYETrEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas hereby
expresses its intent to continue the negotiation of the ownership and operation of the
Greenland and Farmington Sewer Systems if proper contracts can be agreed to.
PASSED and APPROVED this 15t day of November, 2005.

A RESOLUTION SUPPORTING SEWER RATE AND IMPACT FEE
STUDIES BY THE CITY OF FAYETTEVILLE IN CONJUNCTION WITH
NEGOTIATIONS FOR THE ACQUISITION OF THE FARMINGTON
WASTEWATER COLLECTION SYSTEM
WHEREAS, the City of Farmington does not operate a
municipal sewer system or a municipal water system, and
WHEREAS, the City of Fayetteville provides water
service and wastewater collection and treatment for the
City of Farmington, and
WHEREAS, the City of Fayetteville has expressed an
interest in acquiring the Farmington sewer collection
infrastructure and entering into a long term contractual
agreement to provide water and wastewater collection and
treatment for the City of Farmington, and
WHEREAS, the City of Fayetteville has agreed to
provide sewer rate and impact fee studies in conjunction
with negotiations for the transfer and acquisition of the
Farmington sewer collection infrastructure.
BE IT THEREFORE RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FARMINGTON
Section 1: The Farmington City Council supports
negotiations for a long term contractual agreement with the
City of Fayetteville for the transfer and acquisition of
Farmington's sewer collection infrastructure and for the
City of Fayetteville to provide water service and
wastewater collection and treatment service for the City of
Farmington.

Thank you for meeting with me and several others this morning in discussing options for providing
a feasible route for sewer service to the above mentioned project.
understand that the sale of the property that is now the city's Water and Sewer Operations
Center at the Intersection of Razorback Road and Cato Springs Road will be considered at
tonight's City Council meeting.
On behalf of the current property owner south of the city property, Martin Treat, and the developer
of Fayette Estates, I request that a twenty -foot wide utility easement be granted along the eastern
property line of the city's tract. This easement is needed to provide the developer a route to place
a sewer forcemain to connect to an existing sanitary sewer along Cato Springs Road. A sketch is
attached that depicts the location.
The placement of the utility easement would not likely interfere with any potential future
development the city's property. The easement could easily be shown and defined on the
boundary survey which the city would provide to the prospective new owners.
If it is appropriate and necessary, please forward this request to the membership of City Council
for consideration at tonight's meeting. Thank you for your help and assistance.
