A RESOLUTION AUTHORIZING THE USE OF UP' TO 5100,000.00 FROM
THF. REPLACEMENT & DISASTER RECOVERY FUND FOR USE IN
COLLECTING AND DISTRIBUTING AID TO HURRICANE KATRINA
SURVIVORS; AND THE USF. OF 1851 EAST HUNTSVILLE ROAD
(MEXICAN ORIGINAL) AS A DISASTER RELIEF COLLECTION AND
DISTRIBUTION CENTER; APPROVING A BUDGET ADJUSTMENT IN
THE AMOUNT OF 5100,000.00 RECOGNIZING GRANT REVENUE FROM
TI -IE FEDERAL EMERGENCY MANAGEMENT AGENCY (FEMA); AND
DECLARING AN EMERGENCY.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1. That, pursuant to Section 2 of Ordinance No. 4435, the City Council of the
City of Fayetteville, Arkansas hereby determines that a disaster or emergency requiring the
use of funds from the Replacement & Disaster Recovery Fund has occurred, and authorizes
the use of up to $100,000.00 from the Replacement & Disaster Recovery Fund for use in
collecting and distributing aid to Hurricane Katrina survivors.
Section 2. That the City Council of the City of Fayetteville, Arkansas hereby
authorizes the use of 1851 East Huntsville Road (Mexican Original) as a Disaster Relief
Collection And Distribution Center.
Section 3. That the City Council of the City of Fayetteville, Arkansas hereby
approves a budget adjustment in the amount of 5100,000.00 recognizing grant revenue from
the Federal Emergency Management Agency (FEMA).
Section 4. Emergency Clause. That the City Council of the City of Fayetteville,
Arkansas, hereby finds the immediate provision of disaster relief services to be necessary to
preserve the health and safety of Hurricane Katrina survivors in the City of Fayetteville, and
because of such, an emergency is hereby declared to exist and this Resolution shall be in full
force and effect from the date of its passage and approval.

SUBJECT: Replacement and Disaster Recovery Funds - Hurricane Katrina
Recommendations
Staff recommends approval of the use of S 100,000 of funds from the Replacement and Disaster
Recovery Fund to finance the City's Hurricane Katrina relief effort.
Background
In November 2002 the Fayetteville City Council passed Ordinance 4435 establishing a Replacement
and Disaster Recovery Fund. The ordinance designated $3,000,000 of funds to be reserved for a
disaster or emergency. These funds cannot be spent without a specific resolution of the City Council
that declares a disaster or emergency and authorizes the use of these funds. The remaining balance in
the fund is to be used to purchase replacement public safety vehicles.
The devastation left from Hurricane Katrina has affected hundreds of thousands of people living in
the Louisiana and Mississippi gulf coast area. The disaster has touched many of the surrounding
states and everyone is being asked to help as much as possible. It is staff's understanding that
Arkansas has been designated within the disaster area and therefore is eligible to receive
reimbursement from FEMA. The City of Fayetteville has offered the use of the Tyson Mexican
Original building to be used as a collection and distribution point for donations of supplies for the
hurricane evacuees. Funds are needed to pay for labor to clean the building, staff to maintain the
facility, to purchase necessary equipment to make the building functional, and any associated utility
costs.
In addition to these expenses there have been several public safety employees called by FEMA to
help in the disaster area. Staff would like City Council's approval to continue to pay these employees
their current salaries. The City will seek reimbursement for all of these costs from FEMA.

Budget Considerations
At the beginning of September the Replacement and Disaster Recovery Fund had a reserved fund
balance of $3,000,000 and an unreserved fund balance of S1,172,487. The investments in the fund
eamed $206,220 in 2004 and $ 106,159 thru August 2005. The City also anticipates that FEMA will
reimburse the City for some of the costs associated with the relief effort.

ORDINANCE NO. 4435
AN ORDINANCE REPEALING ORDINANCE NO. 1085
AND ESTABLISHING A REPLACEMENT AND DISASTER
RECOVERY FUND
WHEREAS, Ordinance No. 1085 was passed on June 20, 1955, and
established the Vehicle and Maintenance Equipment Replacement Fund and
required $1,400.00 to be deposited monthly into this fund; and
WHEREAS, the Vehicle and Maintenance Equipment Replacement Fund
currently has a designated fund balance of about $4,181,665.00; and
WHEREAS, $3,000,000.00 of this fund should be reserved in an account
entitled "Disaster Recovery Account" so that the City will have substantial available
resources if a disaster befalls our city; and
WHEREAS, this $3,000,000.00 and the remaining $1,181,665.00 balance
should be transferred to a new fund designated as the Replacement and Disaster
Recovery Fund.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas
hereby repeals Ordinance No. 1085 and establishes a new fund "Replacement and
Disaster Recovery Fund" into which all moneys from the "Vehicle and Maintenance
Replacement Fund" shall be transferred.
Section 2. That the City Council of the City of Fayetteville, Arkansas
hereby designated $3,000,000.00 of the Replacement and Disaster Recovery Fund to
be reserved and not dispersed until and unless the City Council determines by
Resolution that a disaster or emergency requiring use of those funds has occurred.
As soon as feasible after any such disbursement of funds from the Replacement and
Disaster Recovery Fund, these funds should be restored to bring the Replacement
and Disaster Recovery Fund up to the Three Million Dollar ($3,000,000.00) fund
balance.

Section 3 That the City Council of the City of Fayetteville, Arkansas
hereby adopts the policy attached as Exhibit "A" for the use and disposition of
funds within the Replacement and Disaster Recovery Fund in excess of the Three
Million Dollars ($3,000,000.00) reserved disaster or emergency amount.
Section 4. That the City Council of the City of Fayetteville, Arkansas
hereby states that the policy (attached as Exhibit "A") describes procedures for the
purchase, replacement, insurance costs, license fee, repairs and maintenance of items
that cost $10,000.00 or less currently on the motor pool schedule.
