A RESOLUTION TO ALLOW EXTENSION OF SEWER SERVICE
OUTSIDE THE CITY'S CORPORATE LIMITS ON A 25 ACRE
PARCEL ON MALLY WAGNON ROAD LESS THAN A QUARTER
MILE FROM THE CITY LIMITS
WHEREAS, §51.113 (c) Sewer connections outside the city. states that "the city's
sewerage system shall not be extended outside the city's corporate limits except on express
approval of the City Council;" and
WHEREAS, applicant J.B. Hays and his representative, Crystal Goedereis have
requested that the City Council grant its express approval to allow extension of City Sewer mains
at thc applicant's expense to access their 25 acre parcel south of Highway 16 East on Mally
Wagnon Road less than one-quarter mile from the City's corporate limits; and
WHEREAS, applicant has agreed that as a condition of granting this extension of sewer
service, the 25 acre parcel will he developed in accordance with all city standards as if the
development was located within the city; and
WHEREAS, the applicant has agreed to immediately petition for annexation into the
City of Fayetteville as soon as is legally possible (whenever any portion of the 25 acre parcel
abuts the city's corporate limits); and
WHEREAS, the applicant agrees that all impact fees (now including water, sewer and
parks land) including future enacted impact fees if in existence when development occurs shall he
paid as if the parcel was within the city limits.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAYETTF,VILLE, ARKANSAS:
Section I: That the City Council of the City of Fayetteville, Arkansas hereby approves a
resolution to allow extension of sewer service outside the City's corporate limits on a 25 -acre
parcel owned by the applicant J.B. Ilays on Mally Wagnon Road, less than one-quarter mile from
the city limits conditional upon thc applicant or any successor in interest fully complying with
and completing all offered conditions as shown in the Whereas clauses of this Resolution..

Mally %Vagnon Road Proposed Development, Crystal Goedereis
The City has received a request to approve providing sanitary sewer service to a
development that cannot currently annex into the City, as there is a lot owned by others
that lies between the development and the existing city limits.
The development is approximately 25 acres, with a plan for approximately 100 lots,
located on the cast side of Malty Wagnon Road, 2/10th of a mile south of Highway 16, is
being submitted by Crystal Goedereis.
Given the alternatives available, I believe that allowing this development to tie to the
City's sanitary sc\Acr system is in the best interests of the City, the residents, and the
environment.
To comply with current City ordinances, this action requires City Council approval. Ms.
Goedereis requests said City Council review and approval/disapproval of the request to
connect to the sanitary sewer before spending more time and money on the dcvclopment.
Therefore, strictly from the standpoint of sanitary sewer service and not relating to any
other engineering or planning issues whatsoever, 1 make the fbllowing recommendations:
I) This development, once it meets all other planning, engineering, and other City
requirements, be allowed to tie to the sanitary sewer system as would a development
within the Fayetteville corporate City limits.
2) This development, as a whole, he required to annex into the City immediately when
such action is legally possible.
3) Planning, with staff input and coordination, identify any and all general requirements
to be placed on this development in its preliminary stages to allow the City Council to
make a well informed decision.

Enclosed please find an application for a variance to the city sewer
ordinance. We have been working on this project since January with Dave
Jurgens and even before that I had spoke with Gregg Boettcher. I do believe
that they were trying to rewrite the city ordinance but with Gregg leaving and
Dave doing both jobs and Bob Davis arriving things have been up in the air.
The last conversation that I had with Bob Davis I was instructed to proceed
with the variance which leads me to you
1 have prepared a packet including the information that was given to Dave
in January. I would appreciate it if you could please review this and place it
on the City Council agenda as soon as possible so we can move ahead with
this project. I have enclosed everything I could think of to make this item
clear. If you have any suggestions or changes please advise me so I can get
them made. I have also sent a packet to Bob Davis, Tim Conklin, the County,
and Matt Casey.

Dear Mr. Mayor & City Council,
May 25, 2005
I come before you again to ask for your help in a matter that I have been working on
for sometime. After much research we have came to the conclusion that Fayetteville has
everything she needs to continue to expand and prosperous except for affordable housing
for the working market. We see a lot of large homes being developed because there is
more money in them than smaller homes and the same is true with lots. It cost a lot Tess to
develop and sell 25 acres with 25 tots than it does 25 acres with 90 lots however, in order
to keep the workers in our job market we need to have these smaller lots and homes.
With the job market getting stronger in other areas such as Lowell, Rogers, Bentonville
and the Fort Smith area it is now becoming more important than ever to have affordable
housing in Fayetteville, in order to keep the employment pool strong and desirable. What
good is it to build a new hotel or restaurant if there is no one to work in it? We need to
have some smaller lots of 7000 square feet or less with city sewer, water, and built to city
standards, in order for the builders to be able to build 1100 to 1400 square foot homes.
These lots need to have appeal just as the big Tots in order to keep our employment pool
desirable.
It is for these reasons that we are asking for your help in a development that we are
planning on Mally Wagnon Road. The development will consist of approximately 90 lots
on 25 acres, more or less. The property is 2/10t of a mile off of Highway 16. This
particular piece of property would have already been annexed into the City of Fayetteville
as it was in the last rounds of annexations before the annexations were tabled. We realize
the City needs time to catch up to all the annexations and, that is why we felt the best
solution would be to grant a variance to the sewer ordinance allowing this development to
extend the sewer main the 2/10t of a mile, at our cost so when the city does annex the
development it will already be at city standards. The impact fees generated from this
development will be approximately $102,870.00 plus the city won't have to pay the
$65,000.00 or more it will take to extend the sewer to the development. We feel this is a
way better option than placing a S.T.E.P. system m a place that we all know is going to
part of our city at some point.
In closing, we feel this is a win/win situation for the city, the builders, the developers,
and most importantly the new home owners. The property is already in the growth area
that is slated to be annexed into the city. It is close enough to Fayetteville and already has
a Fayetteville address that it will open up some much needed moderately priced housing
for the people working and looking to work in the Fayetteville area. The city will also win
because all aspects of this development will meet city standards so when the annexations
happens the city won't have to worry about problems that are occurring now in other
situations with roads, septic systems, and a variety of other issues. Along with the
Vanance request we have elected to provide you with a Bill of Assurance that states we
will follow all city standards including park fees and tree mitigation. We would like to
personally Thank -You for all the time and effort you put into not only this project but, all
of the councils work. As always we look forward to working with the City of Fayetteville
to maintain the great city she is and always will be.

In order to attempt to obtain approval of a request for a Vanance to the City Sewer
Ordinance the owner, developer, or buyer of this property, (hereinafter "Petitioner")
J B Hays Family Development, hereby voluntarily offers this Bill o Assurance and enters
into this binding agreement and contract with the City of Fayetteville, Arkansas.
The Petitioner expressly grants to the City of Fayetteville the right to enforce any and
all of the terms of this of this Bill of assurance in the Chancery/Circuit Court of
Washington County and agrees that if Petitioner or Petitioner's heirs, assigns, or
successors, violate any term of this Bill of Assurance, substantial irreparable damage
justifying injunctive relief has been done to the citizens and the City of Fayetteville,
Arkansas. The Petitioner acknowledges that the Fayetteville City Council will reasonable
rely upon all of the terms and conditions within this Bill of Assurance in considering
whether to approve Petitioner's request for a Variance to the City Sewer Ordinance.
Petitioner hereby voluntarily offers assurances that Petitioner and Petitioner's property
shall be restricted as follows IF petitioner's Variance to the City Sewer is approved by the
City Council.
1) The use of the Petitioners property shall be limited to the use of a single family
development following the guidelines of a RSF 7 however I might add that the average
density will only be 4 per acre but we need the lots to be 7000 square feet in order to
make it look nice with Architectural appeal instead of row housing.
2) Other restrictions including number and type of structures upon the property are
limited to RSF 7 guidelines with a maximum square footage of each house shall not
exceed 1600 square feet of heated space, garages will be attached no larger than 2 cars
3) Specific activities will not be allowed upon petitioner's property including anything
not allowed in a RSF 7 development.
4) The development will be annexed as soon as it touches city property or the city
wishes and the lots will be sold that way. With time of the essence and as this is in the
county we would ask that we would only be required to go through Parks, and Tech Platt
and that the City Planners be allowed or the City Council to sign off on final Platt. It is not
our intention to avoid anything as we have already stated that we will meet or exceed all
city requirements but we do not want to be delayed as we have already been working on
this since December 2004.
5) Petitioner specifically agrees that all such restnctions and terms shall run with the
land and bind all future owners unless and until specifically released by Resolution of the
Fayetteville City Council. This Bill Of assurance shall be filed for record in the
Washington County Circuit Office after Petitioner's variance is effective and shall be noted
on any Final Plat or Large Scale Development which includes some or all of the
Petitioner's property.
In Witness Whereof and in agreement with all the terms and conditions stated
above, I, J B Hays, as the owner, developer or buyer (Petitioner) voluntarily offer all
such assurances and sign my name below.
