IN AN AMOUNT NOT TO EXCEED 5145,793.00 FOR FINAL DESIGN, BIDDING, CONSTRUCTION ADMINISTRATION, AND RESIDENT SERVICES DURING CONSTRUCTION FOR WATER AND SEWER RELOCATION FOR HIGHWAY IMPROVEMENTS TO WEDINGTON DRIVE. BE IT RESOLVED BY THE CITY COUNCIL OF THE CI'T'Y OF FAYETTEVILLE, ARKANSAS: Section 1. That the City Council of the City of Fayetteville, Arkansas hereby approves Amendment #1 to the contract with McClelland Consulting Engineers, Inc. in an amount not to exceed 5145,793.00 for final design, bidding, construction administration, and resident services during construction for water and sewer relocation for highway improvements to Wedington Drive. A copy of Amendment #1, marked Exhibit "A" is attached hereto, and made a part hereof. PASSED and APPROVED this 6`h day of September, 2005. ATTEST: By ��•c Ott's.P z. • ;FAYETT EVILLE• gs.9RKANSPc' •:41 S 1St A DRA SMITH, Ct APPROVED: By AN COODY, Mayor • • AMENDMENT NO. 1 TO AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES FAYETTEVILLE HIGHWAY 16 WATER AND SEWER MAIN RELOCATION RELOCATION OF WATER AND SEWER MAINS ALONG WEDINGTON DRIVE FINAL DESIGN, BIDDING, AND CONSTRUCTION PHASE SERVICES The Agreement for Professional Engineering Services executed on January 18, 2005 for Relocation of Water and Sewer Mains along Wedington Drive in Fayetteville, Arkansas is hereby amended. This Amendment entered into and executed on the date indicated beneath the signature blocks, by and between the City of Fayetteville (hereinafter "City of Fayetteville") and McClelland Consulting Engineers, Inc. (hereinafter "McClelland") changes the authorized Scope of the Project, and the Fees and Payments, due to the requested increase in scope of services on the Wedington Drive water and sewer main project. The Agreement lists the Scope of Services for: 1. Preliminary Design Phase Services 2. Final Design Phase Services 3. Bidding Phase Services 4. Construction Phase Services 5. Post -Construction Phase Services 6. Resident Services During Construction However, only the Preliminary Design Phase Services were authorized for completion in the basic Agreement and were covered in Section 6, Payments to McClelland. The purpose of this Amendment No. 1 is to authorize McClelland to complete Final Design, Bidding, Construction, Post -Construction and Resident Services During Construction as defined in the Agreement and hereinafter, and to establish compensation for these services. FY042165 Amendment No. 1 1 SECTION 2 — BASIC SERVICES OF MCCLELLAND McClelland is hereby authorized to complete Final Design Phase Services as defined under Section 2.3 of the Agreement, to include preparation of property mapping and detailed easement documents as defined under Subsection 2.3.6. McClelland is hereby authorized to complete Bidding Phase Services as defined under Section 2.4 of the Agreement. McClelland is hereby authorized to complete Construction Phase Services to include: 1. Review of submittals. 2. Processing monthly pay requests. 3. Scheduling and attending progress meetings, as needed. 4. Coordination of Construction activities between the Contractor and City of Fayetteville. McClelland is hereby authorized to complete Post — Construction Phase Services to include: 1. Securing and processing of final documents (Bonds, affidavits, etc.). 2. Preparation and submission of Record Drawings. 3. Coordination of post —construction/clean up activities required of the Contractor. McClelland is hereby authorized to provide Resident Services During Construction to include: 1. Providing a resident construction observer to be at the project during construction activities related to the water and sewer main installation. Resident services shall be full time during pipe laying periods and part time during site preparation and site clean up periods. 2. The resident construction observer shall maintain daily logs of site conditions, work completed, activities relating to property owners, and information/directives received from the City of Fayetteville. FY042165 Amendment No. 1 2 • • 3. The resident construction observer shall not provide superintendence over the Contractor's personnel or over the Contractor's work and safety procedures. SECTION 6 — PAYMENTS TO MCCLELLAND Compensation for Final Design, Bidding, Construction, Post -Construction and Resident Services During Construction shall be based upon cost reimbursement, plus profit, as established under Subsection 6.1.1 for Preliminary Design Phase Services. This payment procedure is to be acceptable to the Arkansas Highway and Transportation Department for reimbursement purposes. Attachments B 1 through B 4 list estimated manhours and labor rates as applicable for these phases of the project. Thesc cost factors are summarized as follows: Final Design and Easement Preparation: $53,068 Bidding Phase: $ 3,167 Construction and Post — Construction Services: $15,284 Resident Services During Construction: $74,274 Total $145,793 It is estimated that $14,000 of the $54,000 previously authorized for the Preliminary Design Phase Services can be transferred to Final Design and Bidding Phase Services, so that an Agreement Amendment Total Contract Amount for Preliminary Design, Final Design, Bidding, Construction, Post — Construction and Resident Services is one hundred eighty five thousand seven hundred ninety three dollars ($185,793). Consequently, this Amendment No. 1 authorizes an additional one hundred thirty one thousand seven hundred ninety three dollars ($131,793) to the originally approved fifty four thousand dollars ($54,000). This Contract Amount ($185,793) shall not be exceeded without specific written authorization from the City of Fayetteville. All other provisions and conditions of the original Agreement remain in full force and effect. Final Dcsign and Bidding Services shall be completed to conform to the requirements of the Arkansas Highway and Transportation Department's project FY042165 Amendment No. 1 3 • • schedule. Subsequent phases shall conform to the City of Fayetteville's schedule with the construction contractor. BACKGROUND The Arkansas State Highway Department (AHTD) has a current construction project (Job 040423) for the widening of Hwy 16 (Wedington Drive) from Rupple Rd. to Double Springs. In order to clear the way for the widening project by A.H.T.D., the existing water and sewer facilities serving this arca will have to be relocated to avoid construction conflicts with the highway facilities. Also, in addition to the necessary relocations, staff has requested some over -sizing of the water mains, and fire protection improvements for this arca Per City Council approval on January 18, 2005, McClelland Consulting Engineers, Inc. was awarded a contract in the amount of 554,000 for performing the preliminary engineering services for this project. Afrolii?iVrt • • DISCUSSION Bids were opened on August 10`h and Gilbert Central is the apparent low bidder. AHTD typically issues a Notice To Proceed to the contractor 30 days after the bid opening. It is imperative that McClelland Consulting Engineers, Inc. be authorized to complete the design work immediately and then oversee this project throughout the construction phase. BUDGET IMPACT This project is currently funded as the City Council passed Resolution No. 158-05 at its August 2"`i meeting which approved a budget amendment in the amount of $1,754,694.
