DESCRIPTION OF WORK: See attached "EXHIBIT A" The Department agrees that the required adjustment is * eligible for reimbursement for thc actual cost which is estimated to be 51,754,694.00 of which 5732,155.07 to be paid by the Department and $1,022.538.93 is to be borne by Owner. Owner will not commence work until authorized by the Department, and will then endeavor to begin within 60 calendar days and complete within 240 calendar days thereafter. On completion of said work, "Owner" is responsible for thc cleanup and restoration of the work arca including the disposal of surplus materials and debris. Final billing must include all supporting detail. "Owner" shall also submit one (1) set of "as -built" drawings at this time. Payment will be 100% of lump sum bills and 90% of actual cost bills, final 10% being released on completion of Department's audit. Such audit shall be completed within 90 days of thc approval of the final bill. Wedington Drive Water & Sewer Relocations Project Highway -Utility Construction/Relocation Agreement with the AHTD RECOMMENDATION: The Staff recommends Council approval of the Highway -Utility Construction/Relocation Agreement with AHTD. (Attached) BACKGROUND Wedington Drive is scheduled for improvcmcnts and widening by Arkansas Highway & Transportation Department, from Rupple Rd. to Double Springs. In order to clear thc way for thc widening project by A.H.T.D., the existing water and sewer facilities serving this area will have to be relocated to avoid construction conflicts with the highway facilities. Also, in addition to the necessary relocation, the Staff has requested some over -sizing of the water mains, and fire protection improvements for this area Per City Council approval on January 18, 2005, McClelland Consulting Engineers, Inc. was awarded a contract in thc amount of $54,000 for performing the preliminary engineering services for this project. Per City Council approval on May 17, 2005, the City executed a Highway -Utility Agreement For Preliminary Engineering Services with the AHTD. DISCUSSION / STATUS Certain portions of the water and sewer facilities are presently located outside the highway right of way, therefore, eligible for cost reimbursement from the Highway Department. McClelland Consulting Engineers, Inc has detcrmined the percentage of the reimbursable amounts from the Highway Department (See attached report). It is mandatory that the AHTD Utility Relocation Agreement is signed by the City and transmitted to the AHTD before the bid letting date of August 101h (See attached letter from A1-11-1)). FUNDING FOR 2005: 2005 Budget $54,000 Funds used to date $54,000 Remaining Funds $ -0- Please be advised that since this project was submitted to the City of Fayetteville, after the 2005 budget process had been completed, no funds have been officially budgeted for this project. After the preliminary engineering has been completed the cost of this project will be more accurately estimated and communicated to the Council. You and/or your contractor are also required to notify the Department's Resident Engineer on the day work is completed. The telephone number and address of the Resident Engineer assigned to this highway project is included in the attached work order letter. Please give this information to your appropriate field representative! I am also including a set of the latest highway plans, and right of way maps for this job. Please review to ensure no additional adjustment is required and that the installation of your facilities will not conflict with the proposed construction. NOTICE! STORM WATER CONSTRUCTION PERMITS Please be advised that you are required to follow all laws and regulations concerning erosion control. The Arkansas Department of Environmental Quality requires a Phase 11 Storm Water Construction Permits on sites that have a "disturbed soil area" of one acre or more. For questions or permit requirements for a Storm Water Construction Permit, contact (ADEQ) at 501-682-0627 or at 501-682-0621. This permit is separate from any work order, permit or approval from the Arkansas Highway and Transportation Department. MARKING OF UTILITIES When any utility owner, or its assigned contractor and/or representative is required, or requested to locate and mark the location of its underground lines/facilities inside highway right of way on pavement, sidewalks, curbs, gutters, structures, etc., the marks shall be made with non -permanent materials (chalk, keel, non -permanent paint, etc.). Failure to comply with this requirement will result in removal of the markings by the utility owner at no expense to the Department.
