DESCRIPTION OF WORK: See attached EXHIBIT "A" The Department agrees that the required adjustment is * eligible for reimbursement for the actual cost which is estimated to be S1,451,347.00 of which 51,217,500.23 to be paid by the Department and S233,846.80 is to be borne by Owner. Owner will not commence work until authorized by the Department, and will then endeavor to begin within 90 calendar days and complete within 180 calendar days thereafter. On completion of said work, "Owner" is responsible for the cleanup and restoration of the work arca including the disposal of surplus materials and debris. Final billing must include all supporting detail. "Owner" shall also submit one (1) set of "as -built" drawings at this time. Payment will be 100% of lump sunt bills and 90% of actual cost bills, final 10% being released on completion of Department's audit. Such audit shall be completed within 90 days of the approval of the final bill. Expenses incurred under an actual cost agreement may be billed to the Department monthly in increments of 55,000.00 or more. Said records to be retained and available for inspection for a period of three (3) years from date of final payment "Owner" shall be responsible for any and all hazards to persons, property, and traffic. Restore the fimction of the facilities by installing approximately 3,592 fed of water main (varying in sizes 6" — 12") complete with all necessary valves, meters, fare hydrants, services and appurtenances. (Attached) BACKGROUND Razorback Road is scheduled for improvements and widening by Arkansas Highway & Transportation Department, from 6th Street to 15th Street. In order to clear the way for the widening project by A.H.T.D., portions of the existing water and sewer facilities serving this arca will have to be relocated to avoid construction conflicts with the highway facilities. Per City Council approval on January 18, 2005, McClelland Consulting Engineers, Inc. was awarded a contract in the amount of 522,800 for performing the preliminary engineering services for this project. Per City Council approval on May 17, 2005, the City executed a Highway -Utility Agreement For Preliminary Engineering Services with the AHTD. • • DISCUSSION / STATUS Certain portions of the water and sewer facilities are presently located outside the highway right of way, therefore, eligible for cost reimbursement from the Highway Department. McClelland Consulting Engineers, Inc. has determined the percentage of the reimbursable amounts from the Highway Department (See attached report). It is mandatory that the AHTD Utility Relocation Agreement is signed by the City and transmitted to the AHTD before the bid letting date of August 10"i (Sec attached letter from AHTD). FUNDING FOR 2005: 2005 Budget $22,800 Funds used to date $22,800 Remaining Funds $ -0- Please be advised that since this project was submitted to the City of Fayetteville, after the 2005 budget process had been completed, no funds have been officially budgeted for this project. After the preliminary engineering has been completed the cost of this project will be more accurately estimated and communicated to the Council.
