BE 1T RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS• Section 1: That the City Council of the City of Fayetteville, Arkansas hereby accepts the Parks and Recreation Advisory Board's recommendation to accept approximately 1.34 acres of land and approximately $14,060.00 in lieu of the required Park Land Dedication for the Fairlane Apartments. RECOMMENDATION Fayetteville Parks and Recreation Advisory Board (PRAB) and Parks and Recreation Staff recommend accepting money and land as the Park Land Dedication requirement for Fairlane Apartments. BACKGROUND The proposed development of Fairlane Apartments is located south of l-tuntsville Rd. (Hwy 16) cast of Curtis Ave. and west of Happy Hollow Rd. The owner is Chris Adams with Adams Land and Cattle, LLC. and the engineering firm is Crafton, Tull & Associates, Inc. The development contains 114 multi -family units on 6.22 acres. The requirement for park land is 2.052 acres or money in lieu is $44,802. There are currently no existing parks within the % mile service arca The Park Land Dedication Ordinance states if a major development is over 40 acres or 100 units, the requirement is land. i..11owever, if the Parks and Recreation .Advisory Board determines that a neighborhood park is not feasible or advisable, it may recommend to the City Council that a cash contribution pursuant to our ordinance be accepted in lieu of land dedication. The City Council will either accept the recommendation for a cash contribution or return the subdivision plat to the Parks Board with instructions or further study.. (Unified Development Ordinance No. 166.03K) Parks and Recreation Staff met with the owners to evaluate the site and reach an agreement on the location and size of the proposed park land. The development was presented to the Parks and Recreation Advisory Board on May 2, 2005. • • DISCUSSION The Parks and Recreation Staff and PRAB recommend a combination of money and land for the Park Land Dedication requirement. Approximately 1.34 acres of land for a future neighborhood park will be dedicated. The remaining money -in -lieu contribution of $14,060 will be used for park improvements in the southwest park district. This decision is based upon the potential acquisition of additional park land to the cast of the proposed development. If you have any questions, please call me at 444-3472. As you are aware we walked the site with Fayetteville Parks staff and were advised that a neighborhood park was needed in the area. We agreed to go back and look at our design and determined the feasibility of providing a park area at the southeast comer of the project. We think the project would work on 112 units and dedicating a park area containing approximately 1.2 acres. Therefore we are requesting to dedicate the land shown and pay additional fee for the remaining that is required by ordinance. The exact area and fee would be finalized after we had gone through the planning process. We would like to present this at the May 2nd parks board meeting. Park Land Dedication: Alison Jumper, Park Planner Development Name: Adams Apartments Engineer: Crafton, Tull & Associates, Inc. Owner: Chris Adams Location: South of Huntsville Rd. between Huntsville Rd. and Fairlane St., west of Happy Hollow. Park District: SE Units 124 Multi Family Total Acres: 5.96 acres Land Dedication Requirement: 2.108 acres Money in Lieu Requirement: $48,732 Existing Parks: No parks exist within a half mile radius service area Developer's Request: 1.2 Acre Park and $20,997.50 in fees Staff Recommendation: Developer's Comments: 1.4 Acre Park (Include area labeled detention as park land, with detention off of park property) and $16,372.50 in fees ** This recommendation would require a waiver of the Park Land Ordinance to the City Council due to the project including over 100 units. Justification: Currently there are no neighborhood parks within a 1/2 mile radius of the proposed development. With 124 units, this major development creates a strong need for a neighborhood park. In addition, there are many residents in this area which could be served by this park. Staff is in the process of contacting adjacent property owners with undeveloped land to the east and north of the proposed park land to inquire about the possibility of acquiring a portion of their land for future park expansion There is $6,800.0 in Park Land Dedication Fund in the SE Park District to potentially purchase some of the surrounding acres. Hatfield said the developer is looking at alternative ways to direct detention off park property There is an opportunity to obtain more land adjacent to the park acreage. Staff is visiting with adjacent property owners. • • Hill stated that there are a lot of neighbors currently in this area that can give input and feedback immediately. Langsner said that the people who currently own homes will have a larger stake in the development of the park. Hill suggested not waiting until project is finished to start the process of acquiring surrounding land and that the process should be started soon. PRAB Motion: Marley moved to accept Staff recommendation to accept 1.4 acres and $16,372.50 in fees. Langsner seconded the motion.
