A RESOLUTION APPROVING CONTRACT AMENDMENT NO. 2
WITH McCLELLAND CONSULTING ENGINEERS, INC. IN THE
AMOUNT OF $56,867.00 FOR THE HIGHWAY 62-FARMINGTON
WATERLINE REPLACEMENT PROJECT
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby
approves contract Amendment No. 2 with McClelland Consulting Engineers, Inc. in the
amount of $56,867.00 for the Highway 62 -Farmington Waterline Replacement Project.
A copy of the Amendment, marked Exhibit "A" is attached hereto, and made a part
hereof.
PASSED and APPROVED this 5th day of July, 2005.

AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES
FAYETTEVILLE HIGHWAY 62 WATER MAIN RELOCATION
RELOCATION OF WATFR MAINS IN FARMINGTON, ARKANSAS
CONSTRUCTION PHASE SERVICES
The Agreement for Professional Engineering Services executed on May 18, 2004
for Relocation of Water Mains in Farmington, Arkansas is hereby amended. This
Amendment entered into and executed on the date indicated beneath the signature blocks,
by and between the City of Fayetteville (hereinafter "City of Fayetteville") and
McClelland Consulting Engineers, Inc. (hereinafter "McClelland") changes the
authorized Scope of the Project, and the Fees and Payments due to the requested increase
in scope of services on the Farmington water main project.
The Agreement defines the Scope of Services for:
1. Preliminary Design Phase Services
2. Final Design Phase Services
3. Bidding Phase Services
4. Construction Phase Services
5. Post -Construction Phase Services
6. Resident Services During Construction
However, only the Preliminary Design Phase Services were authorized for
completion in the basic Agreement and were covered in Section 6, Payments to
McClelland. Amendment No. I subsequently authorized completion of Final Design and
Bidding Phase Services.
The purpose of this Amendment No. 2 is to authorize McClelland to complete
Construction, Post -Construction and Resident Phase Services as defined in the
Agreement, and to establish compensation for these services.

SECTION 2 - BASIC SERVICES OF MCCLELLAND
McClelland is hereby authorized to complete Construction Phase Services to
include:
I. Review of submittals.
2. Processing monthly pay requests.
3. Scheduling and attending progress meetings, as needed.
4. Coordination of Construction activities between the Contractor and City of
Fayetteville.
McClelland is hereby authorized to complete Post - Construction Phase Services
to include:
1. Securing and processing of final documents (Bonds, affidavits, etc.).
2. Preparation and submission of Record Drawings.
3. Coordination of post - construction/clean up activities required of the
Contractor
McClelland is hereby authorized to provide Resident Services During
Construction to include:
1. Providing a resident construction observer to be at the project during
construction activities related to the water main installation. Resident
services shall be full time during pipe laying periods and part time during
site preparation and site clean up periods.
2. The resident construction observer shall maintain daily logs of site
conditions, work completed, activities relating to property owners, and
information/directives received from the City of Fayetteville.
3. The resident construction observer shall not provide superintendance over
the Contractor's personnel or over the Contractor's work and safety
procedures.

SECTION 6 — PAYIvTENTS TO MCCLELLAND

Compensation for Construction, Post -Construction and Resident Services During
Construction shall be based upon cost reimbursement, plus profit, as established under
Subsection 6.1.1 for Preliminary Design Phase Services. This payment procedure is to be
acceptable to the Arkansas Highway and Transportation Department for reimbursement
purposes. Attachments B 1 through B 2 list estimated manhours and labor rates as
applicable for these phases of the project. These cost factors are summarized as follows:

The Total Contract Amount for Preliminary Design, Final Design, Bidding,
Construction, Post — Construction and Resident Services is one hundred forty one
thousand nine hundred sixty seven dollars ($141,967.00), which includes the previously
authorized $85,100 for design and bidding services.
All other provisions and conditions of the original Agreement remain in full force
and effect. Completion of these construction phase services shall conform to the City of
Fayetteville's schedule with the construction contractor.

Engineering Contract Amendment #2
Recommendation:
Approval of a Resolution authorizing Amendment #2 to the existing engineering
contract with McClelland Consulting Engineers, Inc. in the amount of $56,867, for
Highway 62 — Farmington — Waterline Relocations Project.
Background:
Highway 62 is scheduled for improvements and widening in Farmington from
Hwy 170 intersection and proceed along Hwy 62 west for approximately one mile
(please see attached map). Fayetteville owns the water distribution system in
Farmington and is responsible for the relocation of water mains in conflict with
the planned highway construction.
In 2004 McClelland Consulting Engineers, Inc. was selected and awarded a
contract to perform the engineering services for this project. The design was
recently completed and the project was advertised for bid on June 2, 2005.

Discussion:

The Engineering Agreement defined the Scope of Services as following Phases:
1. Preliminary Design Phase Services
2. Final Design Phase Services
3. Bidding Phase services
4. Construction Phase Services
5. Post -Construction Phase Service
The preliminary engineenng was performed under the main contract. Final
design and bidding was performed under Amendment #1. The proposed
Amendment #2 is for construction and post construction services, and includes
Resident Services during construction.
