BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the City Council of the City of Fayetteville, Arkansas hereby designates 12.91 acres of municipal property located on Highway 45 East for recreation purposes, reserving up to 2 acres for a future fire station. Section 2. That the City Council of the City of Fayetteville, Arkansas hereby designates 2.46 acres located at 1121 South Duncan Avenue for recreation purposes. Section 3. That the City Council of the City of Fayetteville, Arkansas hereby transfers Lots 5 & 6 on South Gregg Avenue from the Street Fund to the General Fund and designates them for recreation purposes. I further request City Council reserve up -to 2 acres of the Highway 45 East property as a future fire station site. City Council has to right to designate the purpose of any City -owned property subject -to any restrictions that may have been attached to the land either by deed or by source of funds. Background/Discussion Highway 45 East On April 15, 2003 City Council approved a land swap between General Fund and Water & Sewer Fund that included approximately 12.91 acres on Highway 45 East. The property on Highway 45 East was transferred from Water & Sewer Fund to General Fund so the City would have more options for the public use of the property. Resolution 56-03 approved the property transfer from Water & Sewer Fund to General Fund. This request would designate 12.91 acres for recreation purposes and recognize a possible future may use of up -to 2 acres for a future fire station. 1121 South Duncan City Council approved the purchase of 2 46 acres located at 1121 South Duncan subject to the Town Branch Neighborhood Association raising matching funds. Town Branch Neighborhood Association was successful in raising commitments for the matching funds prior to the option to purchase lapsed. The closing is scheduled once the City receives the balance of committed money and will be an asset of General Fund. This property is proposed to be designated for recreation purposes. Lots 5 and 6 South Gregg Avenue The City granted neighbors permission to use two City -owned lots for a community garden. The property is an asset of Street Fund. City Council has two options — 1) transfer the property from Street Fund to General Fund and then designate it for recreational purposes and 2) leave the property within Street Fund and document the record that, at some future date, the land could be used for Street Fund purposes. Staff recommends transferring the property from Street Fund to General fund • • to remove any future confusion concerning the intent of city Council and designating the property for recreational purposes. If this option is accepted, then an appraisal will be needed to establish the fair -market value for the transfer. Budget Impact Except for the cost associated with the transfer of Lots 5 and 6 Gregg Avenue from Street Fund to General Fund the budget impact is minimal. • • RESOLUTION NO. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the City Council of the City of Fayetteville, Arkansas, hereby approves the exchange of certain real property between the Water & Sewer Fund and the General Fund Section 2. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the City Council of the City of Fayetteville, Arkansas, hereby supports the efforts of the neighboring property owners to purchase 2.46 acres located at 1121 South Duncan Avenue from James Mathias for a City Park or Green Space by contributing the remaining balance from the Tree and Trails Fund as recommended by the Tree and Trails Task Force, provided that in the event the neighboring property owners are unable to raise the remainder of the purchase price by May 1, 2005, the remaining balance shall be allocated toward the purchase of Scull Creek Trail Corridor rights -of way. Section 2. That the City Council of the City of Fayetteville, Arkansas, hereby expresses its gratitude to the members of the Tree and Trails Task Force for their dedicated service to the community, and finding that the Task Force has completed its duties under the Settlement Agreement in Serafini et al. v. City of Fayetteville, hereby officially discharges the Tree and Trails Task Force. Section 3. That the City Council of the City of Fayetteville, Arkansas hereby accepts the Final Report and Recommendations of the Tree and Trails Task Force, a copy of which, marked Exhibit "A" is attached hereto and made a part hereof.
