A RESOLUTION ORDERING THE RAZING AND REMOVAL OF
THE DILAPIDATED AND UNSAFE STRUCTURES OWNED BY
JEWELL CARR LOCATED AT 408 EAST CENTER STREET IN THE
CITY OF FAYETTEVILLE, ARKANSAS.
WHEREAS, Jewell Carr is the record owner of the real property situated at 408
East Center Street, City of Fayetteville, Washington County, Arkansas, more particularly
described as follows
Parcel Number 765-12745-000; 15-16-3- County Court Plat;
and,
WHEREAS, the City Council has determined that the structures located on
said property are dilapidated, unsightly, unsafe, and detrimental to the public welfare;
and,
WHEREAS, Jewell Carr, having been properly served with a Violation Notice
via Certified Mail, and given thirty (30) days to correct said violation, has refused to
repair, or raze and remove said dilapidated, unsightly, and unsafe structures.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1. That, by the authority granted pursuant to A.C.A. §14-56-203, and in
accordance with the provisions of Ordinance No. 3948 of 1996, Jewell Carr is hereby
ordered to raze and remove forthwith, the dilapidated, unsightly, and unsafe structures
located on the aforementioned real property. The manner of removing said structures
shall be: dismantle by hand or bulldozer, and haul all debris to a landfill.
Section 2. That if, Jewell Carr does not comply with this order, the Mayor is
hereby directed to cause the dilapidated, unsightly, and unsafe structures to be razed
and removed; and a lien against the real property shall be granted and given the City,
pursuant to A.C.A. §14-54-904, for the costs associated therewith.

Subject: Raze & Removal of structures on 408 E Center St
RECOMMENDATION
Staff recommends a resolution to order the raze and removal of the structures.
BACKGROUND
Service Request #9578, Case #1937: Code Compliance received a complaint about the
unsafe buildings on the property owned by Jewell Carr c/o Sandra Ruth Taylor. The
property is located at 408 E Center. An Unsafe Buildings Notice of Violation was sent to
the owners on December 10, 2003. Sandra Taylor signed for the notice on December 26,
2003. By ordinance the owners were given until January 29, 2004 to acquire a permit
and make repairs or to demolish and remove the buildings.
DISCUSSION
This parcel contains 2 structures, both are in violation. There is not a current building
permit on either structure.
BUDGET IMPACT
Contracting the raze and removal of the property would cost approximately S12,000.00.
The cost would be billed to the property owners. If payment is not received, the city will
place a lien on the property for the amount of the raze and removal.

the City which has become dilapidated, unsafe, unsanitary; or detrimental to the public welfare.
How This Violation Can Be Voluntarily Corrected:
Please obtain a building permit and make repairs as required or demolish the building and remove
all debris from the lot.
Potential Penalties if not corrected within thirty (30) days from the service of this Notice
include: Condemnation.
Appeal: If you disagree with our conclusion that your property contains a violation of the
ordinance hsted above, you have a right to file an appeal with the City Council.

Notice that the Fayetteville City Council will conduct a public hearing to determine if the

Removed. You are free to appear at this hearing to present any evidence or statements. If you

The hearing will be part of a regular City Council meeting — probably on May 18, 2004
beginning at 6:00 p.m. at the City Administration Building, 113 W. Mountain St, Fayetteville,
AR 72701. It is possible that this hearing may be conducted at a later meeting such as June 1,
2004 or thereafter. The City Council Meetings are advertised in local newspapers and will

I was assigned to do a property assessment at 408 East Center. There were two
structures on this property. There was split level, wood frame single family dwelling
and a garage with an upstairs apartment. These two structures are in need of repair and
should assessed by the owner. The owner should consider the cost of repair verses
removal of structures.
There were several vehicles parked on the property should be removed from the
property.
There was trash and debris in the yard as well as a brush pile which should be removed
from the property.

A RESOLUTION TO APPROVE AN ORDER TO RAZE AND
REMOVE A DILAPIDATED AND UNSAFE STRUCTURE
LOCATED AT 408 E. CENTER STREET, FAYETTEVILLE
WHEREAS, by certified mail, the owner of the dilapidated and unsafe building was
notified on December 26, 2003 that because the building was dilapidated, unsafe, unsanitary
or detrimental to the public welfare, the owner must repair or demolish the building; and
WHEREAS, the owners have not obtained a building permit, nor performed
satisfactory repairs nor demolished the building; and
WHEREAS, §95.04 of the Code of Fayetteville in compliance with state law grants
the City Council the power to order the razing and removal of such building after a public
hearing upon proof that such building is dilapidated, unsafe, unsanitary, or detrimental to the
public welfare.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas, after a public
hearing on this issue, hereby finds that the building at 408 E. Center Street, Fayetteville has
been shown to be and is dilapidated, unsafe, unsanitary, or detrimental to the public welfare
to such an extent that an order for the building's razing and removal should be and hereby is
issued.
Section 2: That the City Council of the City of Fayetteville, Arkansas hereby directs
that a lien in the reasonable cost of the razing and removal of the structure be placed on this
property until such lien amount, plus any allowed interest, is paid in full.

Description of Case
11-25-03, cp, While patrolling, found bcatbn with 2 substandard structures. The main house has broken windows and the front windows on the second story of both
structures are missing.
1-09-04, Sandra Ruth Taybr, who is caring for owner Ms. Jewell Carter and claims she lives there called to get a CDBG application., Will send her CDBG application
ASAP. Will continue to monitor until CDBG applicatbn is retumed.

Note:observed trash all around the yard. the grass is overgrown w/ brush. a tree has fallen over on the fence on the west side of the yard. will generate S/R for this
violation.

impact.supervisor will re -submit to city council in 2005. new photos are in file/ will continue to monitor.

12-14-041c R/I property w/ cb , checked for anyone Irving at property. found property to be in same condition. doors on several sides of the house and garage are
open. a big hole is in the roof with several windows busted out or no windows at all. it doesn't have anyone living al the residence,but does show signs of transients or
homeless coming and going.J/D all around property and a big tree has fell over onto the fence of the property on the west side.
