A RESOLUTION ACCEPTING THE PARKS AND RECREATION
ADVISORY BOARD'S RECOMMENDATION TO ACCEPT
$61,605.00 CASH IN LIEU OF THE REQUIRED PARK LAND
DEDICATION FOR CLIFFSIDE PLANNED ZONING DISTRICT
(PZD) DEVELOPMENT.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas
hereby accepts the Parks and Recreation Advisory Board's recommendation to
accept $61,605.00 cash in lieu of the required Park Land Dedication for Cliffside
Planned Zoning District (PZD) Development.
PASSED and APPROVED this 4th day of January 2005.

Subject: Cliffside PZD Development.
RECOMMENDATION
Fayetteville Parks and Recreation Advisory Board (PRAB) and Parks and Recreation
Staff recommend money in lieu of land as the Park Land Dedication requirement for
Cliffside PZD Development.
BACKGROUND
The Cliffside development is located north of Hwy 16 and east of Happy Hollow Road.
The owner is SCB Investments and the engineering firm is Project Design Consultants,
Inc The development contains 111 units on 26.11 acres. The requirement for park land is
2.66 acres and money in lieu is $61,605. Mount Sequoyah woods and Happy Hollow
Elementary School park are located within a half mile radius of this development.
The Park Land Dedication Ordinance states if a major development is over 40 acres or
100 units, the requirement is land.
"...However, if the Parks and Recreation Advisory Board determines that a neighborhood park is not feasible
or advisable, it may recommend to the City Council that a cash contribution pursuant to our ordinance be
accepted in lieu of land dedication. The City Council will either accept the recommendation for a cash
contribution or return the subdivision plat to the Parks Board with instructions or further study. " (Unified
Development Ordinance No. 166.03K)
The development was presented to the Parks and Recreation Advisory Board on July 12,
2004.

DISCUSSION
The Parks and Recreation Staff and PRAB recommend money in lieu of land in the
amount of $61,605 for the Park Land Dedication requirement. This decision is based
upon the recreational needs of this area being met by Mount Sequoyah woods and Happy
Hollow Elementary School park.
This PZD was approved at the December 7, 2004 City Council meeting without a waiver
request for parkland dedication. The waiver request was inadvertently left out. If you

Meeting Minutes
July 12, 2004
Opening:
The regular meeting of the Parks and Recreation Advisory Board was called to order at 5:36
p.m. on July 12, 2004 in Room 326 of the City Administration Building located at 113 West
Mountain Street, Fayetteville, Arkansas by Chairman Colwell.
Present:
Parks and Recreation Advisory Board members Colwell, Eads, Hill, Marley, and Mauritson;
City staff Coles, Dollar, Wright, Malloy, Weber, Hatfield, Edmonston; and Audience.

Mauritson asked is the corridor part of the project.
Amy Scott replied the corridor will be part of the project because it is required by
Planning Division.
MOTION:
Hill moved to accept Money in Lieu of a land dedication to satisfy the Park
Land Dedication Ordinance for the proposed development.
Mauritson seconded the motion.
Upon roll call, the motion was approved 7-0-0 with Colwell, Bailey, Eads,
Hill, Shoulders, Marley, and Mauritson voting `yes' with Pawlik Holmes
absent for the vote.
