A RESOLUTION TO WAIVE THE REQUIREMENTS FOR PUBLIC
AUCTION OR FORMAL COMPETITIVE BIDS FOR THE SALE OF
A 1997 FORD CLUB WAGON (UNIT #2002) TO THE FAYETTEVILLE
YOUTH CENTER, INC.
WHEREAS, the City owns a 1997 Ford Club Wagon (Unit #2002) with a fair
market value of less than $10,000.00; and
WHEREAS, it is in the best interest of the City of Fayetteville and its taxpayers
to sell this vehicle to the Fayetteville Youth Center, Inc. in exchange for its agreement to
provide transportation and other services to Fayetteville citizens in programs such as their
Outreach Program for at -risk youth, the Hook -a -Kid -on -Golf program, etc.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF FAYETTEVILLE, ARKANSAS -
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby
determines that an exceptional circumstance exists such that the sale of a 1997 Ford Club
Wagon (Unit #2000) with a fair market value of less than $10,000.00 by public auction or
formal competitive bids is neither feasible nor practical. The City Council thus hereby
waives the requirement of public auction or competitive bids pursuant to its powers in
§34.25 (B) of the Fayetteville Code and agrees to sell this vehicle to the Fayetteville
Youth Center, Inc for the equal value of transportation and other services to be provided
by the Fayetteville Youth Center, Inc. to Fayetteville residents.
PASSED and APPROVED this the 18th day of May, 2004.

CONTRACT OF SALE
The City of Fayetteville ("City") and the Donald W. Reynolds Boys
and Girls Club ("Youth Center") agree as follows:
The City of Fayetteville agrees to transfer complete ownership and
title of a 1997 Ford Club Wagon — 15 passenger van (Unit #2002) to the
Youth Center in exchange for educational, outreach, special event, and
transportation services to be provided to Fayetteville citizens by the Youth
Center.
The Donald W. Reynolds Boys and Girls Club agrees to provide at
least that amount of educational, outreach, special event and transportation
services to Fayetteville citizens during the upcoming 18 month period to
equal the fair market value of the 1997 Ford Van being sold to the Youth
Center by the City.
In accordance and agreement with the terms and promises above, we
sign our names below.

RECOMMENDATION
City Staff is requesting approval of a resolution to waive the requirements for public
auction or formal competitive bids and to approve the contract of sale for the 1997 Ford
Club Wagon Unit #2002 to the Fayetteville Youth Center, Inc.
BACKGROUND
The City purchased the 15 passenger Ford Club Wagon in 1997 for the Youth Center.
For seven years, the Boys and Girls Club has used the van to transport children to the
club or to recreational program sites. The City currently has an annual contract with the
Club to provide recreational services for the citizens according to Ordinance 4532.
Arkansas Code Annotated §14-58-306 allows the City to sell municipal property pursuant
to our City Ordinances. Attached is a letter from Mayor Coody certifying the fair market
value of the van.
DISCUSSION
The van is valued at $8,285. The City's Equipment Committee unanimously approved
for the van to be transferred to the Club. The City has no current use for this van. In
order for the Club to continue to provide the current level of recreational services and to
have the capability to expand programs that require transportation, this van is a necessity
to meet the needs of our youth. Attached is the Contract of Sale stating the City would
transfer the van to the Youth Center in exchange for their agreement to provide equal
value of transportation and other services to Fayetteville citizens in programs such as
their Outreach Program for at -risk youth and Hook -a -Kid on Golf. No additional vehicle
or remuneration for this service will be provided in subsequent years.
