A RESOLUTION TO AUTHORIZE THE MAYOR TO EXECUTE
A LETTER OF INTENT TO COST SHARE WITH THE ARKANSAS
HIGHWAY AND TRANSPORTATION DEPARTMENT DURING
FY 2006 AND 2007
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby
authorizes the Mayor to execute a Letter of Intent to Cost Share with the Arkansas Highway
and Transportation Department during FY 2006 and 2007.

WHEREAS, IN WASHINGTON COUNTY, on Highway 265, Section 2 in
Fayetteville, widening of this highway from Highway 45 north to the Fayetteville city limits has
been identified as an existing need to increase capacity; and
WHEREAS, the City of Fayetteville has agreed to partner with the Department
for the cost of improvements to Highway 265; and
WHEREAS, the City of Fayetteville has agreed to pay for 50% of the total costs
of the project up to $7.7 million.
NOW THEREFORE, the Director is authorized to proceed with surveys, plans,
and construction of a project to widen this highway as funds become available, subject to the
receipt of funds from the City of Fayetteville

Subject: Resolution of Intent to Cost Share with the Arkansas Highway and
Transportation Department on Improvement Projects to Highways on the State System
within Fayetteville dunng FY 2006 and 2007
Recommendation:
Approve resolution indicating the City's intent to cost share with the Arkansas Highway
and Transportation Department (AHTD) for improvement projects to highways on the
State System within Fayetteville during FY 2006 and 2007
Background:
The City Administration has been contacted by the AHTD Commissioner for this Region.
He has indicated that given the tremendous demand for road improvements throughout
the State and the shortage of State Transportation Funds to meet these needs that he will
be partnering with interested communities in order to leverage State Funds with local
funding sources.
The Commissioner has indicated that he is seeking partners for the 2006 and 2007 fiscal
years for distribution of the Regional Transportation Fund allocation. The Commissioner
has indicated that he is seeking to leverage the State Funds with a 50% local match.
The Resolution of Intent to partner with the AHTD is needed by late May.
Discussion:
The City has been struggling with congestion issues for the past several years. This
congestion has been the result of the economic growth within the Northwest Arkansas
region. This continued economic growth along with the University of Arkansas growth
will continue to pressure the existing heavily traveled comdors within Fayetteville. The

City of Fayetteville recently completed a Citywide Transportation and Traffic Study.
This study showed that Fayetteville is experiencing significant traffic congestion/vehicle
delay at many of the major interchanges along I-540. The projects on this list include
both State Highway projects and local projects that will reduce the vehicle delay/traffic
congestion by:
• Creating Parallel Traffic Relief Routes - Bypassing Congested Intersections
• Expanding the Capacity at Key Intersections
• Creating a Regional Network of Key Arterials to Improve Both East/West and
North/ South Mobility
The challenge in addressing this congestion problem is twofold: first in moving our
projects up the AHTD Five Year Work Plan and then finding local resources to
participate.
It appears that the solution to the first challenge has been answered, at least in part for
project participation in FY2006 and 2007. The second challenge can be addressed with a
systematic review of our transportation funding priorities and a review of additional
funding options.
Within the 2004-2008 Five Year Capital Improvements Program transportation
projects scheduled beginning in 2005 through 2008 (excluding the Van Asche Blvd. cost -
share) total $7.7 million (this includes two State bridge cost -shares also). These projects
are almost totally on the State System. It is recommended that the project funds be the
basis of the City's Resolution of Intent. Projects scheduled for 2004 and completed in
2005 will continue to move forward. The projects listed beginning in the 2005 through
2008 will wait additional funding.
Council discussion as recently as April 6 focused on finding additional funding sources.
As the Council is.aware, the County has imposed a quarter cent sales tax for the jail
construction. This tax will lapse when the bond is retired. This tax is expected to end
between May and September 2005, when the bonds are paid. The reauthorization of this
sales tax upon its expiration would maintain and not increase the current local sales tax
rate.
This quarter cent could be reauthorized, permitting the City to participate with the State at
a greater level if state funding permits, essentially receiving $2.00 of congestion relief for
each one local tax dollar.
The quarter cent sales tax will generate approximately $3,000,000 annually. Over a two
year period in partnership with AHTD participating on a 50-50 basis, the approximately
$6,000,000 in local sales tax dollars will generate approximately $12,000,000 in road
improvements reducing travel delays and congestion in those corridors of greatest need.
