HomeMy WebLinkAbout189-04 RESOLUTION• RESOLUTION NO. 189-04 A RESOLUTION TO APPROVE CONTRACT AMENDMENT NO. 4 WITH GARVER ENGINEERS, LLC FOR ADDITIONAL DESIGN, BIDDING AND CONSTRUCTION PHASE SERVICES FOR THE GREGG STREET WATERLINE RELOCATION IN THE LUMP SUM AMOUNT OF $121, 500.00 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1: That the City Council of the City of Fayetteville, Arkansas hereby approves Contract Amendment No. 4 with Garver Engineers, LLC for additional design, bidding and construction phase services for the Gregg Street Waterline Relocation in the lump sum amount of $121,500.00 and authorizes Mayor Coody to execute this contract. Mountain Fayetteville, AR 72703 • • November 19, 2004 GARVER ENGINEERS Re: Gregg Street Waterline Relocation — Contract Amendment No. 4 Garver Project No. 0296-3600 Dear Gary: In accordance with our recent discussion, please consider this 2"s revision to the proposed Amendment No. 4 to our original professional services contract for Gregg Avenue Waterline Relocation, dated September 17, 2002. This amendment will apply to the portion of Phase 2 of the project from Township to Futrall and will cover additional design services, as well as bidding and construction phase services which were not part of our original agreement for Phase 2. Based on your direction, this amendment does not include any revisions or final completion of bid documents for the portion of the project from Sycamore to Township; any redesign and final completion of this section will be negotiated in the future after this section is included on the City's CIP list. We understand we have completed our current contractual obligations for the section between Sycamore and Township. Based on your direction, we will redesign the portion of the project between Township and Futrall to accommodate the Gregg Avenue Improvements designed by AHTD, which conflict significantly with the previous waterline relocation design. This will involve major coordination with City and AHTD staff. In addition to typical construction observation and support services, we will stake the proposed AEP pole locations, the City Right -of -Way along the west side of Gregg from Township to Futrall, and the proposed waterline from Township to Futrall. Your approval of this amendment will add a lump sum fee amount of 5121,500 for Design, Bidding, and Construction Support Services as described herein for Phase 2. For informational purposes, a breakdown of the Engineer's estimated costs is included in Appendix B with approximate current hourly rates for each employee classification. RECOMMENDATION Staff recommends adoption of Contract Amendment No. 4. BACKGROUND On September 17, 2002, City Council approved a phased design contract with Garver Engineers to design the relocation and upgrade of the main waterline along Gregg Avenue between Mud Creek and Sycamore Street. Phase I is the portion of the waterline between Futrall Drive and Mud Creek, Phase II is the portion of the waterline between Futrall Drive and Sycamore Street. The relocation of this waterline is necessary due to AI-ITD widening and improvements planned for Gregg Avenue between Mud Creek and Township Street, and in order to meet future water demand the line is being upgraded to an I8 -inch waterline. All design, bidding and construction services are complete on Phase 1, between Mud Creek and Futrall Drive, and waterline construction was completed in July of 2004. DISCUSSION Garver Engineers were only authorized to perform surveying, preliminary and final engineering design for Phase 11, with bidding and construction services to be negotiated at a later date. At 90% completion of the final design for Phase 11, the project was put on hold in April of 2003 awaiting final approval of the proposed roadway cross section and preliminary roadway alignment design from AHTD for the section between Futrall Drive and Township Street. 1 • • City Council Meeting of December 7, 2004 AI-ITD has recently provided the City with their preliminary roadway design, and due to major alignment, elevation and storm sewer conflicts with the previous waterline design, significant portions of the waterline project between Futrall Drive and Township Street will need to he redesigned. This amendment only includes funds for additional engineering, kidding, construction staking and construction inspection services for the northern portion of Phase II between Futrall Drive and Township Street. Since the southern portion of Phase 11 between Township Street and Sycamore Street is currently on the CIP Unfunded List, it is recommended that additional engineering services not be authorized on this segment until funds have been budgeted fir construction. BUDGE"1' IMPACT This $121,500 expenditure will come from Project# 02129 "Gregg- Water Line Relocation," which has a remaining 2004 budget of $858,732.80. Preliminary construction cost estimates indicate that the final construction cost could be approximately $1,000,000, and depending on the final construction bid price, a budget adjustment might be required at time of construction contract award. 2 • • RESOLUTION NO.
