WHEREAS, RECE WED MAR 2 2 2005 AIRPORT The Airport Authority wishes to participate in the FAA's Contract Tower Cost Sharing Program (the "Program"), and The FAA has performed a benefit/cost study relating to the feasibility of placing air traffic control services at Drake Field Airport, an airport operated and Controlled by the Airport Authority, and The FAA and the Airport Authority have agreed that, as a result of the outcome of the benefit/cost study, the Airport Authority is eligible to participate in the Program, and The Airport Authority has entered into an agreement (the "Service Agreement") with Robinson Van Vuren Associates (the "Contractor"), whereby among other things, the Airport Authority agreed to pay the Contractor $2,344.59 per month for air traffic services at said airport, all as more fully described in the said agreement. NOW THEREFORE, Pursuant to the authority granted in 49 U.S.C. 106(1) and the Department of Transportation Appropriations Act for Fiscal Year 1999, and in consideration of the terms, conditions and covenants set forth herein, it is mutually agreed as follows: a) The Airport Authority shall promptly and timely satisfy its obligations under the Service Agreement, including the payments described above. The parties further agree the terms and conditions of the parties' cost sharing allocations and payments are effective 1 March 2005. b) Upon notification, by any means, that the Airport Authority is in arrears on its payments to the Contractor, the FAA will remove all air traffic control services at the subject airport. Upon such removal, the Airport Authority will not be eligible for further participation in the Program. The continued operation of air traffic control services by the Contractor at the airport, after notification of arrearage to the FAA, shall not be construed as a waiver by the FAA of any of its rights under this agreement. c) The Airport Authority shall reimburse the FAA, including interest calculated as per FAAMS Clause 3.3.1-9 (April, 1996), for all sums paid by the FAA to the Contractor for services provided by the Contractor to the Airport Authority on and after the date the Airport Authority went into arrears. 1 • • • COST SHARE AGREEMENT - Con't Page 2 d) The parties agree that if the FAA Contract Tower benefit/cost analysis demonstrates a change in the applicable benefit -to -cost ratio, the parties may renegotiate this agreement. e) Execution of this Agreement does not constitute a commitment by the FAA to provide air traffic control services, via contract or otherwise, to said airport This Agreement is subject to the laws and regulations of the United States, as are in force and effect now, or as may be in the future. BACKGROUND: Since the Airlines relocated to Northwest Arkansas Regional Airport, the activity at Fayetteville Municipal Airport has steadily increased. The initial B/C analysis was .22. It was later increased to .59. This new rate of .91 reflects the increase in activity at the airport. DISCUSSION: The FAA will review the Benefit/Cost ratio again in two years. BUDGET IMPACT: A 9% share of the tower cost for the airport will amount to approximately $26,000 annually. Congress established this program to provide an opportunity for those airports whose B/C dropped below 1.0 to continue in the FCT Program by agreeing to share the cost of providing air traffic control services. Your B/C of 0.91 means the FAA will fund 91% of the cost while the airport will be responsible for the remaining 9%. If you chose to participate, this cost sharing arrangement will be effective on March 1, 2005. Please notify us of your intentions not later than 30 days from the receipt of this letter. Airports that decline to participate in cost sharing will be subject to withdrawal of funding March 1, 2005. Thank you for your recalculation of our B/C which shows the FAA will pay 91% of the cost and Fayetteville Municipal Airport -Drake Field will be responsible for the remaining 9%. Please consider this letter as intent for Fayetteville Municipal Airport -Drake Field to continue to .operate the Tower. We understand that our cost will be approximately $26,000.00 annually with payments to begin for the month of March 2005. Please let us know if we will be invoiced or where payments are to be mailed. For regular contract tower airports with revised b/c ratios that continue to be over 1.0, the FAA contract tower program office will advise the airport sponsor of its revised b/c ratio and that the airport's contract tower will continue in the regular program for full funding. For regular contract tower airports with revised b/c ratios that are below 1.0, the FAA contract tower program office will send each of these airport sponsors a letter with the updated b/c ratio and the back-up data information used for the b/c calculation. Included in the letter will be a request for the airport sponsor, if it so desires, to provide, no later than 60 days after receipt of the letter, to the FAA contract tower program office updated and verifiable data that will be used to calculate the final b/c. The FAA will provide these airport sponsors the final b/c NLT 60 days after the deadline for the receipt of the new data. The airport sponsor's cost -share portion to operate the tower, based on the final b/c, will become effective on October 1. Cost Share Towers FAA's policy office (APO -200) will provide the FAA Contract Tower (FCT) Program Office (ATP -140) by May 1 of every other year the updated benefit/cost (b/c) ratios for all cost -share contract towers. For contract tower cost -share airports with revised b/c ratios that are over 1.0, the FCT Program Office will advise the airport sponsor of its revised b/c ratio and that, effective no later than (NLT) October 1, the airport's contract tower will be in the regular program for full funding. For contract tower cost -share airports that have revised b/c ratios that have increased but are still below 1.0, the FCT Program Office will advise the airport sponsor of its revised b/c ratio and that the revised cost -share portion for the airport will be effective NLT October 1. • For contract tower cost -share airports with revised b/c ratios that have decreased, the FAA contract tower program office will send each of these airport sponsors a letter with the updated b/c ratio and the back-up data information used for the b/c ratio calculation. Included in the letter will be a request for the airport sponsor, if it so desires, to provide, no later than 60 days after receipt of the letter, to the FCT Program Office updated and verifiable data that will be used to calculate the final b/c ratio. The FAA will provide these airport sponsors the final b/c ratio NLT 30 days after the deadline for the receipt of new data. They didn't have a good answer. Please keep in open, I'm sure we will receive an agreement soon. RECOMMENDATION: Execute by signature of the Mayor the cost sharing agreement for the Air Traffic Control Tower at the airport. The FAA requires our signature prior to their signature. Please return to the Airport for FAA execution. BACKGROUND: The cost share provisions for the operation of the Air Traffic Control Tower were approved by the City Council with Resolution 170-04 on November 1, 2004. The provisions are that the FAA will cover 91% of the costs and the City will pay 9% of the costs. The attached agreement provides a final monthly cost to be paid by the Airport for the Tower. DISCUSSION: This agreement keeps the Air Traffic Control Tower operating at the airport through a cost share program provided by the FAA The Benefit Cost Analysis performed by the FAA in 2004 resulted in the local share of 9% or $2,344 59 per month. The payments are to begin March 1, 2005 and will be in effect for two years. The FAA will update the Benefit Cost Share analysis prior to the end of this agreement and will notify the airport of any change to the cost share ratio. We would anticipate that the City's share of the cost would continue to go down as the activity at the airport increases. BUDGET IMPACT: $26,000.00 was included and approved in the 2005 airport budget for this item. Total cost for FY 2005 is $23,445.90 to be paid in monthly installments of $2,344.59. The contractor, Robinson Van Vuren Associates, bills in arrears monthly. The budget for FY2005 represents 10 months of service. A full 12 months of service will be included in the 2006 budget.
