A RESOLUTION TO REQUEST THAT THE WASHINGTON
COUNTY JUDGE AND THE WASHINGTON COUNTY
CLERK APPLY TO THE DIRECTOR OF THE ASSESSMENT
COORDINATION DIVISION OF THE PSC FOR A SIXTY
DAY EXTENSION OF THE DATE TO LEVY MILLAGE
WHEREAS, the Countywide reappraisal may require a rollback of millage rates
this year; and
WHEREAS, the City of Fayetteville is still waiting for the final decision as to
whether and how much municipal millage for the city library and police and fire pension
boards may have to be rolled back pursuant to Amendment 59 of the Arkansas
Constitution.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF FAYETTEVILLE, ARKANSAS:
Section 1: That the City Council of the City of Fayetteville, Arkansas hereby
requests that the Washington County Judge and the Washington County Clerk apply to
the Director of the Assessment Coordination Division of the PSC for a sixty-day
extension of the date to levy millage

SUBJECT: 2004 Millage Levy — Request for Extension
Recommendation:
Staff recommends that City Council pass a resolution authorizing the Washington County Quorum
Court to file an extension of up to sixty (60) days with the State of Arkansas' Assessment
Coordination Division for the levy of millage taxes. The extension is needed due to the possible
rollback of taxes due to reappraisals.
Background:
Each year the City must approve an ordinance to renew the levy of ad valorem taxes on real and
personal property within the City. This request will provide for such levy on property assessed
during 2004.
A millage levy ordinance must be approved by City Council in order for the City to continue to
collect property taxes for the Policemen's Pension and Relief Fund and the Firemen's Pension and
Relief Fund. The millage levy for the Policemen's Pension and Relief Fund is 0.4 mils for real
property and 0.4 mils on personal property. The millage levy for the Firemen's Pension and Relief
Fund is 0.4 mils for real property and 0.4 mils on personal property.
In addition, a millage levy must be approved for the operation of the Fayetteville Public Library that
was approved by the voters on October 1, 2002. The millage levy for the Fayetteville Public Library
is 1.0 mils for real property and 1.0 mils on personal property.
The millage levy must be at Washington County, November 4 to be included in their consolidated
levy ordinance which will be approved at the November 11, Quorum Court meeting. The City levy
will be added to the levies by Washington County, the various school districts, improvement districts
and other cities within the County when the Washington County Quorum Court adopts its millage
levy for 2004.

Discussion:
Based on a July 31 assessors report it appears that Fayetteville may have an Amendment 59 Property
Tax rollback. A Property Tax millage adjustment is required by Amendment 59, when property
assessments, when comparing the most recent year (2003) with the current year (2004), produce
greater than 10% revenue increase. The July preliminary assessors report indicated a real estate
assessment increase of 14.75%. This year's assessments are awaiting final action by the County
Assessor and Board of Equalization.
City staff is requesting that an extension of up to sixty (60) days be submitted to the Washington
County Quorum Court. This is made possible through Arkansas Code 14-14-904 Section 1 (b)(1)(B)
which reads:
B) The Director of the Assessment Coordination Department may authonze
an extension of up to sixty (60) days of the date for levy of taxes upon
application by the county judge and county clerk of any county for good
cause shown resulting from reappraisal or rollback of taxes.
The extension will allow the City of Fayetteville to wait until November 2004 to levy millage rates
for 2005.
Budget Impact:
There is no budget impact of delaying the levy of millage rates by up to sixty (60) days.
Conclusion:
If approved the City would pass its' millage levy ordinance in November 2004 and would be
submitted to Washington County for final adoption.

Washington County Assessments for the Year 2004
14-14-904. Procedures generally.
(a) Time and Place of Quorum Court Assembly. The justices of the peace elected in each county
shall assemble and organize as a county quorum court body on the first Monday, excepting
holidays, after the beginning of the justices' term in office. If the first meeting is not held on the
quorum court's established regular meeting day, the quorum court may declare the first meeting to
be in lieu of the established January meeting. Thereafter, the justices shall assemble each calendar
month in their respective counties to perform the duties of a quorum court, except that more
frequent meetings may be required by ordinance. The time and place of the initial assembly of
justices shall be designated by written notice of the county judge. Thereafter, the justices shall meet
as a quorum court at a regular time and place established by ordinance.
(b)(1) Levy of Taxes and Making of Appropriations.
(A)(i) The quorum court at its regular meeting in November of each year shall levy the county
taxes, municipal taxes, and school taxes for the current year.
(ii) Before the end of each fiscal year, the quorum court shall make appropriations for the expenses
of county government for the following year.
(B) The Director of the Assessment Coordination Department may authorize an extension of up to
4--=7 sixty (60) days of the date for levy of taxes upon application by the county judge and county clerk
of any county for good cause shown resulting from reappraisal or rollback of taxes.
(2) Nothing in this subsection shall prohibit the quorum court from making appropriation
amendments at any time during the current fiscal year.
(3) If the levy of taxes is repealed by referendum, the county may adopt a new ordinance levying
taxes within thirty (30) days after the referendum vote is certified.
(4) If a county court determines that the levy of taxes by the quorum court is incorrect due to
clerical errors, scrivener's errors, or failure of a taxing entity to report the correct millage rate to the
quorum court, the county court shall issue an order directing the county clerk to correct the error in
order to correct the millage levy.
(5) If a determination is made under this subchapter or § 26-80-101 et seq. that the taxes levied by
the quorum court are out of compliance with Arkansas Constitution, Article 14, § 3, as amended by
Arkansas Constitution, Amendments 11, 40, and 74, then upon notice from the Director of the
Department of Education, the county court shall immediately issue an order directing the county
clerk to change the millage levy to bring the taxes levied into compliance with Arkansas
Constitution, Article 14, § 3, as amended by Arkansas Constitution, Amendments 11,40, and 74.
(c) Special Meetings of Quorum Court. The county judge or a majority of the elected justices may
call a special meeting of the quorum court upon at least twenty-four (24) hours' notice in such
manner as may be prescribed by local ordinance. In the absence of procedural rules, the county
judge or a majority of the elected justices may call a special meeting of the quorum court upon
written notification of all members not less than two (2) calendar days prior to the calendar day
fixed for the time of the meeting. The notice of special meeting shall specify the subjects, date,
time, and designated location of the special meeting.
(d) Presiding Officer. The county judge shall preside over the quorum court without a vote but with
the power of veto. In the absence of the county judge, a quorum of the justices by majority vote
shall elect one (1) of their number to preside but without the power to veto. The presiding officer
shall appoint all regular and special committees of a quorum court, subject to any procedural rules
that may be adopted by ordinance.
(e) Procedural Rules and Attendance at Meetings. Except as otherwise provided by law, the
quorum court of each county shall determine its rules of procedure and may compel the attendance
of absent members in such manner and under such penalties as may be prescribed by ordinance.
(0 Quorum. A majority of the whole number of justices composing a quorum court shall constitute
a quorum and is necessary to conduct any legislative affairs of the county.
(g) Legislative Affairs. All legislative affairs of a quorum court shall be conducted through the
passage of ordinances, resolutions, or motions.
(h) Majority Vote Required. All legislative actions of a quorum court, excluding the adoption of a
motion, shall require a majority vote of the whole number of justices composing a quorum court
unless otherwise provided by the Arkansas Constitution or by law. A motion shall require a
majority vote of the whole number of justices composing a quorum for passage.
(i) County Ordinance. A county ordinance is defined as an enactment of compulsory law for a
quorum court that defines and establishes the permanent or temporary organization and system of
principles of a county government for the control and conduct of county affairs.
(3) County Resolution. A county resolution is defined as the adoption of a formal statement of
policy by a quorum court, the subject matter of which would not properly constitute an ordinance. A
resolution may be used whenever the quorum court wishes merely to express an opinion as to some
matter of county affairs, and a resolution shall not serve to compel any executive action.
(k) Motion. A motion is defined as a proposal to take certain action or an expression of views held
by the quorum court body. As such, a motion is merely a parliamentary procedure that precedes the
adoption of resolutions or ordinances. Motions shall not serve to compel any executive action unless
such action is provided for by a previously adopted ordinance or state law.
(I) Ordinances. Ordinances may be amended and repealed only by ordinances.
(m) Resolutions. Resolutions may be amended and repealed only by resolutions.
(n) Initiative and Referendum. All ordinances shall be subject to initiative and referendum as
provided for through Arkansas Constitution, Amendment 7.

ACTION REQUIRED: City Council is requested to pass a resolution authorizing the Washington County Quorum Court to
file and extension of up to sixty (60) days with the State of Arkansas' Assessment Coordination Division for the levy of
millage taxes. The extension is needed due to the possible rollback of taxes due to reappraisals.
SUMMARY EXPLANATION:
Each year during October, the City must approve an ordinance to renew the levy of ad valorem taxes on real and personal
property within the City. This request will provide for such levy on property assessed during 2004. Due to a possible
rollback of taxes due to reappraisals, staff is requesting an extension of levying the millage until November 2004.
STAFF RECOMMENDATION:
To approve a resolution to file an extension for the levy of millage taxes.
