Drug -Free Workplace (Gruttecs Other Than Individuals) • As required by the Drug -Free Workplace Act of 1988, and implemented at 28 CFR Part 83, for grantees, as defined at 28 CFR Parr 83, Sections 83 and 83510 - A. These partnerships will provide the 4th JDDTF with intelligence on methamphetamine related activity and assistance when needed. This officer will be responsible for maintaining records and tracking trends concerning the methamphetamine lab crisis in our area, as well as actively work cases involving clandestine labs. The officer will also investigate and track the importation and exportation of various forms of methamphetamine. This officer will coordinate education seminars with community groups and organizations, utility companies, social workers, and retail outlets on the hazards of methamphetamine Labs and identification of precursor chemicals. Specialized training and equipment will be provided to the Washington / Madison County Drug Treatment Court, the Fayetteville Police Department and the 4th Judicial District Drug Task Force. The 4`s JDDTF will receive Drug Enforcement Administration approved training in dismantling clandestine methamphetamine labs, methamphetamine lab investigation, On- Site Safety certification, and basic narcotics investigation. The 4a' JDDTF will attend the fall 2004 National Methamphetamine Conference. The Washington/Madison County Drug Treatment Court employees will attend a national Drug Treatment Court conference and seminar. Equipment items that will be purchased with this grant are a sound system for the Washington / Madison Drug Treatment Court. The 4thJDDTF will purchase audio and video surveillance equipment, GPS tracking equipment, enclosed trailer with a generator and floodlights, and personal safety equipment for officers at methamphetamine labs sites. A ten to twelve member committee will be selected from the following areas within the 4th Judicial District: drug treatment, public health, faith -based organizations, law enforcement, community groups and organizations, public school system and the University of Arkansas. This committee will be charged with studying the methamphetamine problem in our area and developing strategies to implement an anti - methamphetamine campaign. The grant will provide funding for printing and supplies to be used by this committee. The task force will also set up a hotline and a web site that will be used in conjunction with the anti -methamphetamine campaign. • • Methamphetamine Project Summary The current methamphetamine problems that face the 4th Judicial District in Arkansas are the increase of small to medium size clandestine methamphetamine labs and the influx of methamphetamine from other states. This grant will address both of these problems by: establishing partnerships with other law enforcement agencies and community groups; assisting in drug prevention and treatment; providing trautiug and equipment to law enforcement officers and members of the Washington/Madison County Drug Treatment Court, and establishing education programs for community groups, utility providers, social workers, and retail outlets on the hazards of methamplietanune labs and precursor chemical identification. The grant will help create a committee to study the methamphetamine problem in the 4th Judicial District and develop and implement an anti- methamplictaininc campaign. • Partnerships will be created with the Washington/Madison County Drug Treatment Court and law enforcement agencies within the 41h Judicial District. The grant will provide funds to the drug court for equipment, training, and upgrading of the court's database. The Washington/Madison County Drug Treatment Court was selected for the partnership because it provides drug education and prevention by appearances in schools, drug treatment for selected offenders, and statistical information for law enforcement. The drug court is funded through a grant and it docs not currently have the budget to pay for these items. The 4th Judicial District Drug Task Force (4'h JDDTF) supports the efforts of the drug court as an alternative solution for the methamphetamine problem. Partnerships will also be created for the law enforcement agencies within the Fourth Judicial District that will include: Fayetteville Police Department, Springdale Police Department, Washington County Sheriffs Office, Prairie Grove Police Department, Lincoln Police Department, Farmington Police Department, West Fork Police Department, Greenland Police Department, Elkins Police Department,131m Springs Police Department, Johnson Police Department and the Madison County Sheriffs Oflice. The enclosed trailer is needed because many of our methamphetamine labs arc seized in rural areas and electricity and water are not always readily available An enclosed trailer could • • carry all the safety equipment and evidence packaging items that are necessary when dismantling a methamphetamine lab. The 4' JDDTF will also buy equipment that will be used to enforce laws regarding the transportation and distribution of methamphetamine. Audio and video recording devices are needed and necessary to capture the illegal activity for presentation in a courtroom. A GPS tracking device will be purchased and used to identify drug sources and / or tracking drug suppliers. This grant will assist the 4th JDDTF in adopting Community Oriented Policing Strategies through the partnership with the Fayetteville Police Department. The task force will expand its current methamphetamine education program and document all speaking engagements. There is a need to educate community groups and organizations, utility companies, apartment and hotel managers, social workers, and retail outlets on the identification of precursor chemicals and the hazards of methamphetamine for public safety and health reasons. A committee of ten to twelve members will be developed to study the methamphetamine problem and develop strategies for an anti - methamphetamine campaign. The committee members will be selected from the following areas within the 4'h Judicial District: drug treatment, public health, faith -based organizations, law enforcement, community groups and organizations, the local media, and the University of Arkansas. The funding for the anti -methamphetamine campaign will be provided by this grant and the officers at the task force will be available to respond to the needs of the committee. The 4'h JDDTF will set up a hotline and a website to be used in conjunction with the anti -methamphetamine campaign. This hotline and website will be monitored by the officer provided for in this grant. The 4th JDDTF, the selected partners, and the committee referred to in this grant will also initiate some of the civil remedies that are needed to clean up the hazardous residue after the chemical contractor has taken the methamphetamine lab from the lab site. In Washington and Madison Counties no one is currently responsible for the cleanup of these harmful chemicals which at certain levels are considered as a health hazard. Since methamphetamine labs are found in apartments, hotels, and other rental property, these chemical residues could have an effect on a large number of people. The task force will explore ways that will make it possible to make the owner of the property or the person who assembled the methamphetamine lab to pay for the clean up of any harmful chemicals. The task force will try to influence community leaders to make city and / or county ordinances to assist this goal through codes compliances and nuisance abatement. The 4'h JDDTF could not possibly meet all the needs that have been outlined without the assistance provided for in the COPS Methamphetamine Training Initiative. The current task force budget does not allow for the purchase of any additional equipment, the addition of another officer, or a funded committee to develop an anti - methamphetamine campaign. The 4th JDDTF has taken advantage of the free Drug Enforcement Administration and Arkansas State sponsored methamphetamine lab training, but it usually takes a year to receive the training. Through this grant, the task force will be able to get three officers in clandestine methamphetamine training and two officers in On -Site Safety. By adding another officer to the 4'h JDDTF, the task force will have more time to educate the public on the hazards of methamphetamine Tabs in the community and to enforce methamphetamine related laws. The equipment that will be bought through this grant could not be purchased with the 4th JDDTF's current budget. The enclosed trailer, generator, and floodlights will provide safety for officers as they • • investigate and dismantle methamphetamine labs. The surveillance equipment will assist in identifying and arresting individuals who transport and sell methamphetamine. The generator and lights will increase the safety of officers at the lab sites. We have estimated the equipment will cost $800.00. B. One global positioning tracking devise The global positioning tracking device will be used to track and identify the methamphetamine distributors in our area. The use of global positioning technology will increase the chance of successfully following methamphetamine distributors without being detected. International Narcotic Interdiction Association This conference and seminar will provide two officers at the 4th JDDTF with training in methamphetamine interdictions techniques, the profiling of methamphetamine labs, search and seizure issues, asset forfeiture, and narcotic officer survival. This training will enhance the officers' knowledge and skills in dealing with methamphetamine related crimes. We have estimated the training will cost $3,868.00. E. Reid Interview and Interrogation Training Three officers at the 4th JDDTF will receive training on interview and interrogation techniques. These skills are essential to methamphetamine related investigations by obtaining and documenting evidence and assisting in successful prosecutions. We have estimated that training three officers will cost $1,200.00. Contracts Consultants A. Contract fee for an upgrade in the Washington / Madison County Court Drug Treatment Court computer system The Washington / Madison County Drug Treatment Court needs to update / upgrade their computer system. Currently, court personnel cannot retrieve all the information in the computer system. The court's computer system is important to the overall goal of this grant because it can supply the 4°JJDTF on information that would assist in methamphetamine related investigations. Hotline OR! # AR072 100 • Legal Name: City of aA etteville, Arkansas The 4`" JDDTF requests the purchase of a hotline to work in conjunction with a website and an anti-methamphetamine campaign. The hotline will be located at the 4`s JDDTF office and will be monitored by 4th JDDTF officers. We have estimated the hotline will cost $ 600.00. B. Web page The web page will be designed by a committee that will be created with this grant. The web page will provide facts about methamphetamine and hazards of methamphetamine labs. The web page will work in conjunction with an overall anti-methamphetamine campaign. An individual contractor will create and maintain this web site for a period of one year. We have estimated the contract for the web page will cost $5,000.00. C. Crime Prevention Practitioner This is a nationally recognized course that certifies officers as crime prevention practitioners. This certification would allow officers to perform security surveys for commercial and residential locations. This would benefit the 4th JDDTF in the efforts to combat methamphetamine by educating merchants on how to protect against the theft of the chemical precursors to methamphetamine labs. This certification would also allow officers to educate citizens on the problems of methamphetamine and how it relates to burglary, theft, forgery and a host of other crimes. We have estimated the training will cost $4,700.00 F. Basic Narcotic Training The 4th JDDTF will host this training for narcotic officers in the northwest Arkansas area. The topics will include: undercover operations, informants, surveillance, case management, drug interdiction and red flags. Sworn officer, Officer Overtime and Clerical Support Overtime The City of Fayetteville will hire an officer at the beginning salary and provide all necessary and normal basic training and uniforms. One trained and certified officer will be transferred to the 4'' Judicial District Drug Task Force (4s' DTF). This officer will receive training through the Drug Enforcement Agency to become Methamphetamine Lab certified and a Site Safety Officer. Approximately 50% of the officer time will be dedicated to actively investigating cases involving methamphetamine. The sergeant with the 4s' DTF will also be able to assign current officers within the task force to assist with these investigations and approve overtime when necessary. This officer will have the support of the Fayetteville Community Oriented Policing division, the Control Group of the 4th DTF and Washington Madison County Drug Court while setting up the Anti-Methamphetamine Initiative Committee. This officer will also be charged with assisting the Anti-Methamphetamine Initiative Committee by attending meetings; keeping records and ensuring all budgeted items are purchased as requested. FY2004 COPS Methamphr�ine Training Initiative Vftq U.S. OEDiRTMaNT Or JUSTICE 11 CERTIFICATION OF CLEANUP OF CLANDESTINE DRUG LABORATORIES This section explains the requirements for cleanup of a clandestine drug laboratory discovered while implementing a Methamphetamine grant and ways to mitigate the possible adverse health, safety, and environmental impacts of cleanup activities. First, it requires you to certify what cleanup strategy you plan on utilizing. Specifically, it requests certification regarding (1) the type of training local law enforcement personnel receive; (2) whether DEA contractors, DEA equivalent contractors or other qualified contractors and/or local personnel will perform the cleanup and disposal of hazardous chemical waste; and (3) whether vehicles and/or storage units funded under the grant program will be used to transport and/or store hazardous chemical waste. The acceptable cleanup strategies are discussed in more detail in the Environmental Assessment, which you reviewed on the COPS website (www.cops.usdoj.gov), and are agreeing to abide by through the submission of these application materials. Second, it requires you to certify that to avoid or mitigate the possible adverse impacts of cleanup activities you will (1) include protective measures or components as a part of your cleanup activities; (2) provide for their adequate funding to include funding, as necessary, beyond that provided by the grant award; and (3) implement these protective measures throughout the life of the grant award. My own State ofArkansas has the highest number of meth lab seizures per capita in the nation. Arkansas has become a crossroads for meth production and trafficking, making meth one of the top law -enforcement problems in the state." I agree with with Representatives Boozman's description of the meth problem. Our Fourth Judicial District Drug Task Force (4th DTF) seized 27 Meth labs during the fiscal year of 2000 and at the current rate 95 will be seized in the fiscal year 2004. This is a 351% increase in just four years with no sign of a slowdown. Methamphetamine is perhaps the most addictive illicit drug and affects generations of families including pre- teens to adults. One effort to prevent drug abuse through education and rehabilitate drug offenders is provided by the Washington County Drug Court presided over by Judge Mary Ann Gunn. Judge Gunn holds court in area schools upon request and allow students to witness first hand the consequences of illegal drug use. Judge Gunn will request through this grant funds for training and equipment. Current status The City of Fayetteville, as the lead agency for the 41h DTF, received a COPS (Community Oriented Policing) grant package on Wednesday, July 7, 2004 notifying us that we were selected to receive up to $164,900.00 through the COPS Methamphetamine Training Initiative. This is a 1 -year non-renewable grant and does not require matching funds but has some non -allowable expenses to efficiently implement the program. The 0 completed application must be in Washington D.C. on July 30, 2004; therefore we are requesting permission to complete the application. The grant is broken into four basic areas: • 30% of award for Training/Technical Assistance • 20% of award for Education/Awaremness/Community Outreach • 15% of award for Officer Overtime • 30% to 35% of award for Equipment/ Supplies and Evaluation After meeting with Police Department and Task Force staff and contacting Circuit Judge Mary Ann Gunn, the following is being considered for funding: Provide employees participating in the training program to become Site Safety and Clandestine Lab Certified. This training is important to ensure the safety of officers on scene as well as the public living or working nearby. 2. Provide funding for overtime for officers investigating all cases involving illegal narcotics. 3. Provide for the addition of one additional officer to be assigned to the 4`h DTF. This officer will maintain research trends concerning the Methamphetamine Lab crisis in our area and actively investigate drug cases. The grant -funded cost of the officer is $31,130.00 with $20,061 additional non -allowed operational expenses and cost above grant funding level. 4. Provide for the addition of a second officer to the Community Oriented Policing (COP) division to create partnerships between neighborhood associations, businesses, civic and faith based organizations and the Drug Court to define and initiate anti-methamphetamine strategies. The grant - funded cost of the officer is $31,130.00 with $20,061 additional non -allowed operational expenses and cost above grant funding level. The budget within this grant for equipment is $49,470.00. The equipment being considered for funding through this grant will include audio recording devices and accessories, enclosed trailer with generator and lights to store and transport equipment utilized to secure clandestine lab sites while waiting for disposal crew, GPS tracking devices and tracking equipment utilizing night vision technology and a portable sound system. RECCOMENDATION The Police Department recommends the City Council authorize Mayor Coody to sign the application for the COPS Methamphetamine Training Initiative and accept the Assurances, Certifications and Disclosure of Lobbying Activities. This is a 12 -month non -reoccurring grant and does not require the retention of personnel authorized by this process. Positions will be reduced through attrition if at the end of the grant the Department is unable to secure a funding source to maintain the positions.
