RESOLUTION Na 86-03
A RESOLUTION REDUCING THE RIGHT-OF-WAY
DEDICATION FROM SOUTH SCHOOL AVENUE
CENTERLINE TO ACCOMMODATE THE EXISTING
STRUCTURE LOCATED AT 729 SOUTH SCHOOL
AVENUE
WHEREAS, the City of Fayetteville and the Arkansas Highway and
Transportation Department have completed the expansion of South School
Avenue to five lanes in this location; and
WHEREAS, the additional right-of-way for this portion of South School
Avenue is not now needed for road expansion.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas
hereby approves the lesser dedication of right-of-way necessary to accommodate
the existing structure located at 729 South School Avenue.
PASSED and APPROVED this 3rd day of June, 2003.

ADM 03-08.00: Administrative Item (Scott Miller, pp 562) was submitted by Scott Miller on
behalf of Gene Barbee for property located at 729 S. School Avenue. The property is zoned C-2,
Thoroughfare Commercial. and contains approximately 0.45 acres. The request is for a lesser
dedication of right of way in that location where the existing structure encroaches upon that right of
way.
BACKGROUND
A 55' right of way from center line for S. School Avenue is required for the principal arterial
pursuant to the Master Street Ilan. The applicant proposes to dedicate the required right of way
except where the existing structure encroaches upon that area. LSP 03-37.00 was approved by the
Planning Commission subject to a lesser dedication of right of way approval by the City Council.
CURRENT STATUS
On May 12, 2003, the Planning Commission voted 9-0-0 to approve LSP03-37.00 subject to a lesser
dedication of right of way being approved by the City Council.
RECOMMENDATION
Staff recommends approval of this lesser dedication of right of way.

Right-of-way being dedicated: A 55' right of way from center line for S. School Avenue is
required for the principal arterial. The applicant proposes to dedicate the required right of way
except where the existing structure encroaches upon that area
Street Improvements Proposed: None
Recommendation: Approval subject to the following conditions:
I. Planning Commission determination of the request for lesser dedication of right-of-way.
The applicant is requesting not to dedicate the full 55 feet from centerline required
pursuant to the Master Street Ilan because an existing building encroaches into the
required right-of-way. The proposal is not to dedicate right-of-way around the existing
building. Staff is in support of this request.
Parking requirements arc as noted in the findings, with a total of 6 spaces for 729 S.
School and a total of 28 spaces for 815 S. School. A shared access and parking easement
shall be indicated on the plat between the buildings to•accommodate parking stalls and
aisle.
3. Large Scale Development will be required for each tract at the time of expansion or
redevelopment. This is required in order to address utility easement and right of way
issues.
Standard Conditions of Approval:
4. Plat Review and Subdivision comments (to include written staff comments provided to
the applicant or his representative, and all comments from utility representatives - AR
Western Gas, SWBT, Ozarks, SWEPCO, Cox Communications)
5. Staff approval of final detailed plans, specifications and calculations (where applicable)
for grading, drainage, water, sewer, fire protection, streets (public and private), sidewalks,
parking lot(s) and tree preservation. The information submitted for the plat review
process was reviewed for general concept only. All public improvements are subject to
additional review and approval. All improvements shall comply with City's current
requirements.

Warrick. This request is to split the subject property into two tracts containing 0.45
acres and 0.75 acres. There are mixed commercial uses surrounding this
property with an industrial designation to the west, which is to the rear of
the property. The applicant is showing on their plan. A right of way
designation of 55' from centerline for S. School Avenue, which is the
required dedication for this principal arterial street. The applicant does
propose to dedicate the required right of way except where it encroaches
an existing structure, which is why the Planning Commission is asked to
hear this request. Typically, the Subdivision Committee has the authority
to approve a Lot Split. However, this is a lesser dedication of' right of
way. The applicant is showing on their plan a right of way dedication of
55' from centerline for S. School Avenue, which is the required dedication
for this principal arterial street. The applicant does propose to dedicate the
required right of way except where it encroaches an existing structure,
which is why the Planning Commission is asked to hear this request.
Typically the Subdivision Committee has the authority to approve a lot

Commission is asked to make a recommendation to the City Council
which is where this lesser dedication must ultimately be determined. Staff
is recommending in favor of the request.

Miller: Hello, my name is Scott Miller. This is pretty straight forward. 1t is a Lot
Split. We dust have two properties that are together and I am attempting to
purchase one of those buildings. We are just looking for a Lot Split.
I loover: At this time can I ask if there is any member of the audience that would
like to address LSP 03-37.00 at 729 and 815 S. School? Seeing no
member of the public I will bring it back to the Commission for
discussion.
