HomeMy WebLinkAbout54-03 RESOLUTION0 0 RESOLUTION NO. 51-03 4 A RESOLUTION ORDERING THE RAZING AND REMOVAL OF A DILAPIDATED AND UNSAFE STRUCTURE OWNED BY JAMES R. AND BECKIE E. TACKETT LOCATED AT 525 LYTTON AVENUE IN THE CITY OF FAYETTEVILLE, ARKANSAS. WHEREAS, James R. and Beckie E. Tackett are the record owners of the real property situated at 525 Lytton Avenue, City of Fayetteville, Washington County, Arkansas, more particularly described as: A part of Lot 16, Block 3, Fairland Addition to the City of Fayetteville, Arkansas; and, Lots numbered Fourteen (14) and Fifteen (15) in Block Numbered Three (3) in Fairland Addition to the City of Fayetteville, Arkansas, as per plat of said addition on file in the Office of the Circuit Clerk and Ex -Officio Register of Deeds of Washington County, Arkansas; and, WHEREAS, the City Council has determined that a structure located on said property is dilapidated, unsightly, unsafe, and detrimental to the public welfare; and, WHEREAS, James R. and Beckie E. Tackett, having been properly served with a Violation Notice via Certified Mail, and given thirty (30) days to correct said violation, have refused to repair, or raze and remove said dilapidated, unsightly, and unsafe structure. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That, by the authority granted pursuant to A.C.A. §14-56-203, and in accordance with the provisions of Ordinance No. 3948 of 1996, James R. and Beckie E. Tackett are hereby ordered to raze and remove forthwith, the dilapidated, unsightly, and unsafe structure located on the aforementioned real property. The manner of removing said structure shall be: dismantle by hand or bulldozer, and haul all debris to a landfill. Section 2. That if James R. and Beckie E. Tackett do not comply with this order, the Mayor is hereby directed to cause the dilapidated, unsightly, and unsafe structure to be razed and removed; and a lien against the real property shall be granted and given the City, pursuant to A.C.A. §14-54-904, for the costs associated therewith. Property is located off Huntsville Rd in Southeast Fayetteville. Current Status: On December 7, 2002, Judean Tackett signed for the violation notice which was sent via certified mail. A time period of thirty days was given to acquire a permit and make repairs or demolish the dwelling. An inspection was performed on January 16, 2002. There has not been any improvements or demolition work performed on this dwelling. As of February 27, 2003 there is not an active permit on this dwelling. There has not been any water service to this dwelling since 1987.
