AND CHRISTINE KLINGER LOCATED AT 226 N. SCHOOL AVENUE IN THE CITY OF FAYETTEVILLE, ARKANSAS. WHEREAS, Timothy C. and Christine Klinger are the record owners of the real property situated at 226 N. School Avenue, City of Fayetteville, Washington County, Arkansas, more particularly described as set forth in Exhibit "A" attached hereto and made a part hereof; and, WHEREAS, the City Council has determined that the structure located on said property is dilapidated, unsightly, unsafe, and detrimental to the public welfare; and, WHEREAS, Timothy C. and Christine Klinger, having been properly served with a Violation Notice via Certified Mail, and given thirty (30) days to correct said- .... violation, have refused to repair, or raze and remove said dilapidated, unsightly, and unsafe structure. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That, by the authority granted pursuant to A.C.A. § 14-56-203, and in accordance with the provisions of Ordinance No. 3948 of 1996, Timothy C. and Christine Klinger are hereby ordered to raze and remove forthwith, the dilapidated, unsightly, and unsafe structure located on the aforementioned real property. The manner of removing said structure shall be: dismantle by hand or bulldozer, and haul all debris to a landfill. Section 2. That if Timothy C. and Christine Klinger do not comply with this order, the Mayor is hereby directed to cause the dilapidated, unsightly, and unsafe structure to be razed and removed; and a lien against the real property shall be granted and given the City, pursuant to A.C.A. §I4-54-904, for the costs associated therewith. -'PASSED and APPROVED this 2nd day of December, 2003. ARKANSAS • /Z.45 / Z /L/o3 /C5 40 E /carfoVL/ .z z- 44 gate/ Date: July 23, 2003 To: The Mayor and Council From: Hugh Earnest CAO Subject: Raze and Removal Resolution Background Our Community Resources and Code Compliance Division has been active in moving against structures that no longer comply with minimum codes relating to the basic structure and integrity of the structure. As part of that process, an Unsafe Buildings Violation notice was sent the owners of a building at 226 N. School in February of 2003. The owners had until April 1 to acquire a permit and make repairs or demolish the building. This particular location has a long history with respect to its condition and compliance with our ordinances. I have attached a 1998 memo from Charles Venable that summarized the several commitments made regarding this structure. Current Situation We have had several conversations with Mr. Tom Klinger, who along with his wife is the owner of the building. Mr. Klinger has expressed a continued interest in working to improve the site and had apparently employed or authorized an individual to begin work on the grounds by removing a concrete pad adjacent to the building in question. However, no building permit was requested for work on the site. Mr. Klinger understands that we will carry this issue to the council meeting of August 5, 2003. Recommendation It is our opinion that the city has given every opportunity for this property to be re- developed and returned to profitable use. That willingness to cooperate is certainly evidenced in the 1998 memo from Mr. Venable and most recently by the slowness shown by the staff in moving this to the council agenda. ARKANSAS • Memo To: Mayor Hanna and City Council From: Charles E Venable Date: July 27, 1998 Subject: Property Located at 226 North School (Timothy Klinger Summary of Events • City purchased a parcel of land totaling 19,530 square feet with a building totaling 4,284 square feet in April 1990 for 583,500. • A portion of the land, 12,897 square feet, was converted into a parking lot for use by the Walton Arts Center, et al, following the purchase. • On March 25, 1993, a public auction was held to dispose of the remaining parcel, 6,633 square feet, and the 4,284 square foot building. Five bids were received with the high bid in the amount of $21,100. This bid. from Timothy Klinger, was approved by the City Council on June 15, 1993. • In February 1995, problems with the building were noted by the Inspections Division and Mr. Klinger was notified of a potential hazard. • March 10, 1995, it was noted that Mr. Klinger had made a good faith effort but more corrections were needed. • November 1995, Mr. Klinger was notified the back wall of the building was unsafe. This wall was removed in early December. • December 2, 1996, a letter from Kevin Crosson was sent to Timothy Klinger requesting schedule and plans for the property since no work had been done on the site and the building was continuing to deteriorate. :. es =p7( 501-575-8257 • \layor Hanna and City Council Page '- • April 14, 1997, a follow up letter was sent to Mr. Klinger since no reply had been received from the December 2. 1996. letter. • May 22. 1997, notification from Inspections Division that the building had become dilapidated. unsafe. and detrimental to the public welfare was forwarded to Mr. Klinger requesting the owner to obtain a building permit and either repair or demolish the structure. • June 23, 1997, a building permit was requested from the Inspections Division for the stabilization of the structure and the removal of debris. secure from vandalism. and to reroof a portion of the structure. • June 24, 1997, letter from Inspections Division notifying Mr. Klinger that on July 1, 1997, the City Council would consider a resolution to determine if the structure should be razed and removed • June 25, 1997, letter from Timothy Klinger to Jerry Rose regarding his concern on the proposed council action. • June 26, 1997, Inspections Division met with Mr. Klinger. • June 30, 1998, letter from Timothy Klinger to the Inspections Division stating that an architect, Cal Canfield, had been retained and that the following schedule was developed: 1. preparation of preliminary design - two to three months 2. preparation of construction documents - three to four months 3. Total design effort completed within seven months 4. Construction to begin in the spring 1998 • June 30, 1997, memo from the Inspection Division to the City Council giving the status of the property and recommending that Mr. Klinger be given the time to accomplish the objectives outlined in his June 30 letter. • July 1, 1997, the raze and removal resolution was introduced to the City Council. After discussion with Mr. Klinger, the City Council voted to table the resolution until such time as there is no progress shown on the time line or to completion of promise made by Mr. Klinger. • July 3, 1997, letter from Mr. Klinger to the Inspections Division setting out the method of alleviating the problems at the site. Mr. Klinger agreed to: 1. Cover all openings with either plywood or fencing viewingof the 2. Seal the front of the structure with fencing to allow easy interior 3. Remove all loose blocks and bricks from the tops of all walls • July 21, 1997, memo to Public Works and Inspections that the work was under way. • August 12, 1997, letter to Mr. Klinger from Inspections notifying him that a portion of the north wall was unsafe. • April 6, 1998, letter to Mr. Klinger from Inspections requesting status of proposed improvements. • April 17, 1998, letter Mr. Klinger to Inspections stating that the architect. Cal Canfield, had been terminated and that discussions with Richard Alderman were ongoing. He also stated that a commitment for construction financing had been secured. • July 23, 1998, memo from Inspections updating status of property stating that the building is secure although new graffiti has appeared on the inside of the north wall within with past six weeks. Also stated that no further communication had been received from Mr. Klinger since the April 17 letter.
