A RESOLUTION ACCEPTING THE PARKS AND RECREATION
ADVISORY BOARD'S RECOMMENDATION TO ACCEPT FIFTY-
EIGI IT THOUSAND EIGHT HUNDRED THIRTY DOLLARS
($58,830.00) CASH IN LIEU OF THE REQUIRED PARK LAND
DEDICATION FOR CROSS KEYS SUBDIVISION.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas
hereby accepts the Parks and Recreation Advisory Board's recommendation to
accept Fifty -Eight Thousand Eight Hundred Thirty Dollars ($58,830.00) cash in
lieu of the required Park Land Dedication for Cross Keys Subdivision.
PASSED and APPROVED this 2nd day of December, 2003.

Subject: Resolution to accept the recommendation of the Fayetteville Parks and
Recreation Advisory Board to accept money in lieu of land for the Park Land Dedication
Requirement of Cross Keys Subdivision.
RECOMMENDATION
Fayetteville Parks and Recreation Advisory Board (PRAB) and Parks and Recreation
Staff recommend money in lieu of land as the Park Land Dedication requirement for
Cross Keys Subdivision.
BACKGROUND
Cross Keys Subdivision is located at the intersection of N 46th Street and Persimmon
Street. The owner is Sloan Properties, Inc and the engineering firm is Jorgensen &
Associates. The development contains 106 single family units on 38.48 acres. The
requirement for park land is 2 54 acres and money in lieu is $58,830. The Park Land
Dedication Ordinance states if a major development is over 40 acres or 100 units, the
requirement is land.
'..11owever, if the Parks and Recreation Advisory Board determines that a neighborhood park is not feasible
or advisable. it may recommend to the City Council that a cash contribution pursuant to our ordinance be
accepted in lieu of land dedication. The City Council will either accept the recommendation for a cash
contribution or return the subdivision plat to the Parks Board with instructions or further study' (Unified
Development Ordinance No. 166.03K)
Parks and Recreation Staff met with Jorgensen & Associates and the owner, Charlie
Sloan to evaluate the site. The Boys and Girls Club is located within a half -mile of this
development.

The development was presented to the Parks and Recreation Advisory Board on
November 3, 2003.
DISCUSSION
The Parks and Recreation Staff and PRAB recommend money -in -lieu of land in the
amount of $58,830 for the Park Land Dedication requirement. This decision is based
upon the developer's plan to provide park land and a trail corridor along Owl Creek in
future developments adjacent to this subdivision. This proposed trail corridor is included
in the Alternative Transportation and Trails Master Plan and will provide off-street
connections to the Boys and Girls Club for this and surrounding developments. The
money -in -lieu contribution will be used for park improvements in the southwest park

Meeting Minutes
November 3, 2003
Opening:
The regular meeting of the Parks and Recreation Advisory Board was called to order at 5:30 p.m.
on November 3, 2003 in Room 326 of the City Administration Building located at 113 West
Mountain Street, Fayetteville, Arkansas by Chairman Colwell.
Present:
Parks and Recreation Advisory Board members Colwell, Bailey, Eads, Marley, Shoulders, Pawlik-
Holmes, Mauritson; City Staff Coles, Ohman, Wright, Edmonston; and Audience.
1. Park Land Dedication
Development Name: Cross Keys Subdivision
Engineer: Jorgensen and Associates, Chris Brackett
Owner: Sloan Properties, Inc
Location: Intersection of Persimmon Street and 46th Street
Park District: SW
Units: 106 Single Family Units
• Total Acres: 38.48 acres
Land Dedication Requirement: 2.54 acres
Money in Lieu Requirement: $58,830
Existing Parks: Boys and Girls Club
Staff Recommendation: Money in lieu of land and Park Land Dedication
Ordinance Waiver
Developer Request: Money in lieu of land
Justification: Boys and Girls Club is located within a half -mile of
this development. In addition, the Applicant has
indicated that additional phases of the development
will occur along Owl Creek. These developments will
provide several opportunities to acquire sufficient
park land for the entire development.
A waiver from City Council will be required as this
development proposes over a 100 units.
Colwell asked the Applicant if the future development would have enough land to provide
park land for the parks and recreation needs of the entire development.
Sloan replied the property provided ample land for the development of park lands. In
addition, the property runs along Owl Creek and Sloan stated that a trail would be
constructed along the Creek as part of the development
Ohman reminded the Board this recommendation will have to be approved by City
Council as an amendment to the Park Land Dedication Ordinance 166.03 K.
MOTION:
Marley moved to accept money in lieu of land for the proposed Cross Keys
Subdivision.
Mauritson seconded the motion.
Upon roll call, the motion was approved 7-0-0 with Colwell, Bailey, Eads, Marley,
Shoulders, Mauritson and Pawlik-Holmes voting 'yes'.
