A RESOLUTION AUTHORIZING THE FAYETTEVILLE PARKS
AND RECREATION DIVISION TO APPLY FOR AN ARKANSAS
PARKS AND TOURISM OUTDOOR RECREATION GRANT IN
AN AMOUNT UP TO TWO HUNDRED FIFTY THOUSAND
DOLLARS ($250,000.00) FOR THE LAKE FAYETTEVILLE
SPILLWAY BRIDGE PROJECT.
BE 1T RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas
hereby authorizes the Fayetteville Parks and Recreation Division to apply for an
Arkansas Parks and Tourism Outdoor Recreation Grant in an amount up to Two
Hundred Fifty Thousand Dollars ($250,000.00) for the Lake Fayetteville Spillway
Bridge Project.

Resolution to apply for Arkansas Outdoor Grant Program

Background
The Land and Water Conservation Fund (LWCF) is a federal program with funds derived from
the sale of federal surplus real property, federal motor boat fuel tax, and Outer Continental Shelf
mineral receipts. The Arkansas Natural and Cultural Resources Grant and Trust Fund
(NCRGTF) is a state program with funds collected from a tax on the transfer of certain real estate
in the State of Arkansas. LWCF and NCRGTF funds are included in the Department of Parks
and Tourism's Outdoor Recreation Grants Program for funding outdoor recreation facilities.
Only incorporated cities and counties may apply. This is a 50/50 reimbursable matching grant
with a $250,000 maximum request on matching funds. Last year, Arkansas Parks and Tourism
awarded our City with $100,000 for construction of the Walker Park Skate Park. Eastin
Outdoors, Inc. was contracted to write that grant, and once again, we have entered into a contract
with Eastin Outdoors for $6,000 to write the 2004 grant proposal. Grant deadline is August 29,
2003.
Current Status
Three public meetings were held on June 23, 27 and July 14, 2003 to gather input from the public
of their recreational desires and to prioritize an eligible grant project. An outreach to groups such
as ethnic minority populations, the elderly and persons with disabilities was attained through
group meetings, e-mails, and telephone conversations. It was determined after obtaining public
input that the Lake Fayetteville Spillway Bridge project should he submitted. This has been a
highly requested project for the past twenty years. 1 he bridge is estimated to have a 250 to 300
foot span. With the increasing popularity and usage of the 5-1/4 mile trail around the lake, the
bridge is needed to make it more accessible and safe for park patrons.
The grant application must include detailed budgets, plans, specifications and bid documents that
are ready for immediate bid and construction Facilities constructed with this grant must be
accessible to the handicapped. Fhe spillway bridge is a very viable project to pursue for this
grant. Carter Burgess design contract for the bridge was approved at the May 20, 2003 City
Council meeting at a cost of $42,536. Capital funds in the amount of $218,595 was funded for
this project, plus an additional $130,000 from the Northeast Park District's Park Land Dedication
Fund was authorized by the Parks and Recreation Advisory Board at the November 4, 2002 and
July 7, 2003 meetings. If this grant is received, funds remaining in our project budget will he for
improvements to the trails system.
Recommendation
Parks and Recreation requests City Council approval of a resolution to authorize the City to
apply for up to $250,000 from the Arkansas Parks and Tourism Outdoor Recreation Grant
Program for the Lake Fayetteville Spillway Bridge project.

I) The development is providing adequate park services for its patrons including a swimming
pool, club house, lake, picnic tables, and a playground, concrete sidewalk/trail along Futrall.
Ms. Eads commented the developers appeared to be providing amenities equivalent to those the
city would provide for a park.
MOTION:
Mr. Hill moved to recommend to the City Council to accept money in lieu of a land
dedication to satisfy the park land dedication requirement for Southern View Apartments.
Mr. Colwell seconded the motion.
Upon roll call, the motion was approved 5-0-0 with Mauritson absent for the vote.
3. Park Land Dedication Fund Requests
Park Staff recommends the following expenditures from the Park Land Dedication Fund:
Northeast Park District:
510,000 Picnic tables and grills for Lake Fayetteville Softball Complex
Picnic tables, grills and sign for Braden Park
Picnic tables and benches for East Mud Creek Trail
5100,000 Lake Fayetteville Spillway Bridge
Northwest Park District:
510,000 Gary Hampton Softball Complex Equipment Shed
MOTION:
Ms. Eads moved to appropriate Ten Thousand Dollars (510,000) from the Northeast Park
District for picnic tables and grills for Lake Fayetteville Softball Complex, for picnic tables,
grills, and sign for Braden Park, and for picnic tables and benches for East Mud Creek
Trail; One Hundred Thousand Dollars ($100,000) from the Northeast Park District for Lake
Fayetteville Spillway Bridge; and Ten Thousand Dollars ($10,000) from the Northwest Park
District for Gary Hampton Softball Complex Equipment Shed.
Mr. Shoulders seconded the motion.
Upon roll call, the motion was approved unanimously 6-0-0.

Meeting Minutes
July 7, 2003
Opening:
The regular meeting of the Parks and Recreation Advisory Board was called to
order at 5:30 p.m. on July 7, 2003 in Room 326 of the City Administration Building
located at 113 West Mountain Street, Fayetteville, Arkansas by Chairperson
Colwell.
Present:
Parks and Recreation Advisory Board members Bailey, Hill, Shoulders, Marley,
Colwell, and Mauritson; City staff Edmonston, Coles, Hatfield, Hesse, Nelson,
Ohman, Wright; and Audience.
7. Park Land Dedication Funding Requests: Steve Hatfield
Parks and Recreation Staff requested the following projects for funding
from the Park Land Dedication Fund:
Northeast Park District: S30,000 for Lake Fayetteville Spillway Bridge
Project
Northwest Park District: S200,000 for West Mud Creek Trail Project
Mr. Hatfield updated the status of the design and construction documents
for the Lake Fayetteville spillway bridge. The location selected will simplify
the bridge construction but will require a longer bridge.
Scott Mashburn questioned ADA accessibility and Mr. Marley requested
leaving the current route around the spillway as an alternative for
bicyclists.
West Mud Creek Trail was redesigned in-house and is now being reviewed
by the State. The one -mile section will extend from Front Street along West
Mud Creek to Steele Boulevard. Eventually the trail will tie into Gregg
street.
MOTION:
Mr. Mauritson moved to appropriate Thirty Thousand Dollars
($30,000) from the Northeast Park Land Dedication Fund for the Lake
Fayetteville Spillway Bridge Project and Two Hundred Thousand
Dollars ($200,000) from the Northwest Park Land Dedication Fund for
the West Mud Creek Trail Project.
Mr. Shoulders seconded the motion.

2004 APPUCAnON GUIDE
RESOLUTION NO.
WHEREAS Arkansas seeks to improve the recreation facilities and
wishes to seek grant funding assistance; and
WHEREAS, in order to obtain the funds necessary to develop and/or improve the site for such a
recreation arca it is necessary to obtain a 50/50 Matching Grant from the Arkansas Department of Parks
and Tourism's Outdoor Recreation Grant Program; and
WHEREAS, the plans for such recreation areas have been prepared and the price therefore has been
established; and
WHEREAS, this governing body understands the grantee and grantor will enter into a binding
agreement which obligates both parties to policies and procedures contained in the Land and Water
Conservation Fund Grana AManua/including, but not limited to the following; the park area defined by the
project boundary map, submitted in the application, must remain in outdoor recreation use in perpetuity,
regardless if the property is bought or developed with matching grant funds and; all present and future
overhead utility lines within the project boundary must be routed away or placed underground and; the
project area must remain open and available for use by the public at all rcsonable times of the day and year;
facilities can be reserved for special events, league play, etc. but cannot be reserved, leased or assigned for
exclusive use, and; the project area must be kept clean, maintained, and operated in a safe and healthful
manner.
City Council/Quorum Court is well aware and apprised of the above-mentioned project, and will
provide the local portion of the development cost of the entire project:.
NOW, THEREFORE, BE IT RESOLVED by the City Council/Quorum Court of
Arkansas that the Mayor/County judge is hereby authorized to make
application to the Arkansas Department of Parks and Tourism for assistance to develop recreational
facilities for the Ciry/County; therefore such application shall be submitted as expediently as possible.
