HomeMy WebLinkAbout107-03 RESOLUTIONRESOLUTION NO. 107-03 A RESOLUTION ORDERING THE RAZING AND REMOVAL OF DILAPIDATED AND UNSAFE STRUCTURES OWNED BY ALEX AND LORI MAHLER LOCATED AT 1003, 1015, AND 1017 WEST CATO SPRINGS ROAD IN THE CITY OF FAYETTEVILLE, ARKANSAS. WHEREAS, Alex and Lori Mahler are the record owners of the real property situated at 1003, 1015, and 1017 West Cato Springs Road, City of Fayetteville, Washington County, Arkansas, more particularly described as set forth in Exhibit "A" attached hereto and made a part hereof; and, WHEREAS, the City Council has determined that the structures located on said property are dilapidated, unsightly, unsafe, and detrimental to the public welfare; and, WHEREAS, Alex and Lori Mahler, having been properly served with a Violation Notice via Certified Mail, and given thirty (30) days to correct said violation, have refused to repair, or raze and remove said dilapidated, unsightly, and unsafe structures NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That, by the authority granted pursuant to A.C.A. §14-56-203, and in accordance with the provisions of Ordinance No. 3948 of 1996, Alex and Lori Mahler are hereby ordered to raze and remove forthwith, the dilapidated, unsightly, and unsafe structures located on the aforementioned real property. The manner of removing said structures shall be: dismantle by hand or bulldozer, and haul all debris to a landfill. Section 2. That if Alex and Lori Mahler do not comply with this order, the Mayor is hereby directed to cause the dilapidated, unsightly, and unsafe structures to be razed and removed; and a lien against the real property shall be granted and given the City, pursuant to A.C.A. §14-54-904, for the costs associated therewith. The properties are located at 1003, 1015, and 1017 W Cato Springs Road. Based on inspections conducted by the Fire Marshall and Code Compliance the buildings are unsightly, unsafe, and dilapidated. An Unsafe Buildings violation notice was sent to the owners on March 14, 2003. Alex Mahler signed for the notice on March 18, 2003. By ordinance the owners were given until April 17, 2003 to acquire a permit and make repairs or to demolish and remove the building. Current Status There is not a current building permit on this building. As shown in the pictures, some demolition work has been done on the buildings. The buildings do not meet the City Ordinances. The owners were notified by certified mail ofa public hearing on July 1st to consider the Raze and Removal of the structure.
