A RESOLUTION ORDERING THE RAZING AND REMOVAL OF
DILAPIDATED AND UNSAFE STRUCTURES OWNED BY ALEX
AND LORI MAHLER LOCATED AT 1003, 1015, AND 1017 WEST
CATO SPRINGS ROAD IN THE CITY OF FAYETTEVILLE,
ARKANSAS.
WHEREAS, Alex and Lori Mahler are the record owners of the real property
situated at 1003, 1015, and 1017 West Cato Springs Road, City of Fayetteville,
Washington County, Arkansas, more particularly described as set forth in Exhibit "A"
attached hereto and made a part hereof; and,
WHEREAS, the City Council has determined that the structures located on
said property are dilapidated, unsightly, unsafe, and detrimental to the public welfare;
and,
WHEREAS, Alex and Lori Mahler, having been properly served with a
Violation Notice via Certified Mail, and given thirty (30) days to correct said violation,
have refused to repair, or raze and remove said dilapidated, unsightly, and unsafe
structures
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAYETTEVILLE, ARKANSAS:
Section 1. That, by the authority granted pursuant to A.C.A. §14-56-203, and in
accordance with the provisions of Ordinance No. 3948 of 1996, Alex and Lori Mahler are
hereby ordered to raze and remove forthwith, the dilapidated, unsightly, and unsafe
structures located on the aforementioned real property. The manner of removing said
structures shall be: dismantle by hand or bulldozer, and haul all debris to a landfill.
Section 2. That if Alex and Lori Mahler do not comply with this order, the
Mayor is hereby directed to cause the dilapidated, unsightly, and unsafe structures to be
razed and removed; and a lien against the real property shall be granted and given the
City, pursuant to A.C.A. §14-54-904, for the costs associated therewith.
PASSED and APPROVED this 15th day of July 2003.

Part of the Northwest quarter (NW 1/4) of the Northwest Quarter (NW 1/4) of
Section Twenty-eight (28) in Township Sixteen (16) North, Range Thirty (30)
West, being more particularly described as follows, to -wit: Beginning at a point
215 feet East of the Northwest corner of said forty acre tract and running thence
East 332 feet more or less to the centerline of branch, thence in a Southwest
direction along center of branch to a point due South of the beginning point,
thence North to the point of beginning, less and except that portion on the North
side embraced in Cato Springs Road, also less and except part of the Northwest
Quarter (NW 1/4) of Section Twenty-eight (28) in Township Sixteen (16) North,
Range Thirty (30) West, described as follows, to -wit: Beginning at a point 425
feet East of the Northwest corner of said forty acre tract, and running thence East
70 feet, more or less, thence South to the centerline of branch, thence in a
Southwest direction along the center of branch to a point due South of the
beginning point, thence North to the point of beginning.

Background
Service Request #5484, Case#1283: Code Compliance received a complaint about the unsafe,
unsightly, and dilapidated buildings on the property owned by Alex & Lori Mahler. The
properties are located at 1003, 1015, and 1017 W Cato Springs Road. Based on inspections
conducted by the Fire Marshall and Code Compliance the buildings are unsightly, unsafe, and
dilapidated. An Unsafe Buildings violation notice was sent to the owners on March 14, 2003.
Alex Mahler signed for the notice on March 18, 2003. By ordinance the owners were given until
April 17, 2003 to acquire a permit and make repairs or to demolish and remove the building.
Current Status
There is not a current building permit on this building. As shown in the pictures, some demolition
work has been done on the buildings. The buildings do not meet the City Ordinances. The owners
were notified by certified mail ofa public hearing on July 1st to consider the Raze and Removal of
the structure.
Recommendation
The staff recommends a resolution to order the Raze & Removal of the structures.

NOTICE TO PROPERTY OWNERS
FAYETTEVILLE
Pursuant to A.C.A. §14-56-203 at 173.08 of the Fayetteville Code, you are placed upon
Notice that the Fayetteville City Council will conduct a public hearing to determine if the
dwellings located at 1003, 1015, and 1017 W. Cato Springs Road, should be Razed and
Removed. You are free to appear at this hearing to present any evidence or statements. Please
call and inform me if you plan to appear at the public hearing. if you need additional
information concerning this process, please call or if you have information that we are not
aware of please call the Code Compliance Office (479) 444-3430.
The hearing will be part pf a regular City Council meeting — probably on July 1, 2003
beginning at 6:00 p.m. at the City Administration Building, 113 W. Mountain St, Fayetteville,
AR 72701. It is possible that this hearing may be conducted at 'a later meeting such as July 15,
2003 or thereafter. The City Council Meetings are advertised in local newspapers and will
contain an item concerning this hearing. You may also call the Fayetteville City Clerk's Office
(575-8323) for information confirming the date of the public hearing.

How This Violation Can Be Voluntarily Corrected:
Please obtain a building permit and make repairs as required or demolish the building and remove
all debris from the lot.
Potential Penalties if not corrected within thirty (30) days from the service of this Notice
include: Condemnation.
Appeal: If you disagree with our conclusion that your property contains a violation of the
ordinance listed above, you have a right to file an appeal with the City Council.
