RESOLUTION NO.97-02
A RESOLUTION TO AFFIRM THE PLANNING
COMMISSION'S DENIAL OF THE LARGE SCALE
DEVELOPMENT 02-7.00 SUBMITTED BY ROBERT
SCHMITT AND BRIAN DANDY FOR PROPERTY
LOCATED AT THE CORNER OF FLETCHER AVENUE
AND RODGERS DRIVE
WHEREAS, the City Council of the City of Fayetteville determines that the
Planning Commission was correct in refusing to approve Large Scale development 02-
7.00 submitted by Robert Schmitt and Bfrian Dandy for various reasons including:
(a) The proposed development could create or compound a dangerous
traffic condition at and near the intersection of Rodgers Drive, Fletcher Avenue,
Oklahoma Way and Lighton Trail;
(b) The risk of accidents at this unusual and difficult intersection with
changing topography, narrow roadways and non-aligned streets would be significant
especially because of the proximity of the proposed driveway from the development to
this intersection, the limitation of sight distance from the driveway, -and the large number
of vehicles (over thirty parking spaces) which would have to use the access driveway;
(c) The density of this development not only increases traffic danger,
strains the existing limited infrastructure of this area, but also is incompatible with the
long established, existing residential neighborhood.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas hereby
affirms the decision of the Fayetteville Planning Commission to refuse to approve Large
Scale Development 02-7.00 as submitted by Robert Schmitt and Brian Dandy for the
reasons stated above and all those presented during the hearings before the Planning
Commission and City Council on this issue.
PASSED and APPROVED this the 18`h day of June, 2002.
