HomeMy WebLinkAbout77-02 RESOLUTIONr In RESOLUTION NO. 77-02 • A RESOLUTION APPROVING CONTRACT AMENDMENT #2 IN THE AMOUNT OF TWO THOUSAND FIVE HUNDRED ELEVEN DOLLARS AND SIXTY ONE CENTS ($2,511.61) WITH McGOODWIN, WILLIAMS AND YATES, INC TO FUND AN EXPANDED CULTURAL RESOURCE SURVEY; APPROVING A PROJECT CONTINGENCY IN THE AMOUNT OF TWENTY-FIVE THOUSAND DOLLARS ($25,000.00); AND APPROVING A BUDGET ADJUSTMENT IN THE AMOUNT OF TWENTY-SEVEN THOUSAND FIVE HUNDRED ELEVEN DOLLARS AND SIXTY ONE CENTS ($27,511.61). BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the City Council hereby approves Contract Amendment #2 in the amount of Two Thousand Five Hundred Eleven Dollars and Sixty One Cents ($2,511.61) with McGoodwin, Williams and Yates, Inc. to fund an expanded Cultural Resource Survey. Section 2. That the City hereby approves a Project Contingency in the amount of Twenty -Five Thousand Dollars ($25,000.00). Section 3. That the City Council hereby approves a budget adjustment in the amount of Twenty -Seven Thousand Five Hundred Eleven Dollars and Sixty One Cents ($27,511.61). Section 4. That the City Council authorizes the Mayor to sign such an amendment to the contract with McGoodwin, Williams and Yates, Inc. (the Engineer) entered into an Agreement for Engineering Services in connection with the construction of the new Westside Wastewater Treatment Plant to serve the Illinois River Basin. The scope of these services included preliminary studies and preliminary design, resulting in a Preliminary Engineering Report setting forth the findings; and WHEREAS, the Engineer has completed those services required under the original scope including preparation and submittal of the Preliminary Design Report; and WHEREAS, The overall project (hereinafter referred to a "the Overall Project") being developed by the Owner includes an upgrade of the existing Paul Noland Wastewater Treatment Plant on the east side of the city and the sewer system collection and transmission facilities work for both the east and west sides. This work is being accomplished by three other engineering consultants; and WHEREAS, the Owner requested that the Engineer's and it subconsultants' original scope be expanded to include services relating to the Overall Project; and WHEREAS, the Engineer agrees to provide the requested services; NOW THEREFORE, in consideration of the mutual covenants and agreements herein contained, the Owner and the Engineer, the parties hereto, stipulate and agree that the Agreement for Engineering Services dated March 21, 2000, is hereby amended in the following particulars: Section IV. Services to be Furnished by the Engineer During Design Phase Additional Services. The Engineer shall conduct other studies and analyses as required to facilitate the production and approval of the Facility Plan, environmental permitting, and public involvement as required, said activities being amended to include: • Conduct a Cultural Resources Survey on the proposed alignment for Broyles Road, from Highway 62 (Farmington) to the proposed plant site. 3 • ess. 77- oz These services to be furnished by the Engineer shall be subject to the agreed cost ceiling set out in Section XII.5 as amended. Section X. Subcontracting Add the following paragraph: "The Engineer shall furnish copies of all sub - agreements if requested by the Owner." Section XII. Fees and Payments 1. Section A is amended as follows: The fixed set out in this section is increased to $130,624.60. 2. Attachment "A" to Contract Amendment Nol of February 5, 2002 is amended as follows: Sponsored Research Program - $47,392.01 3. Section D, second paragraph, first line, is amended to read as follows: "The estimated total compensation for the services set out under Section IV.A as amended is $1,538,109.61, including the fixed fee of $130.624.60 and reimbursable expenses." 4. After the last paragraph under Section D, add the following: "The Engineer shall furnish copies of invoices, billing information, and other materials as the Owner may request, to verify the accuracy of invoices and the nature of the work being performed." All other provisions of the original agreement with Amendments, remain in full force and effect. BACKGROUND The City of Fayetteville has an agreement with McGoodwin, Williams and Yates, Inc. regarding professional services for the West Side Wastewater Treatment Plant. Included under the scope of this agreement is the subcontracting of a cultural resource survey with the Arkansas Archaeological Survey Sponsored Research Program This activity was originally included in the agreement as a subcontract cost of $45,000.00 and is being performed at a cost of $44,993.38. The review of this scope of study found that the proposed alignment of the Broyles Road Extension (from Highway 62 in Farmington West to the West Side Treatment Plant Site) was not included under the list of cultural survey areas. The original scope of the Cultural Resource Survey was specified to include the 300 acre site, the interceptor sewer line routes, force main routes and pumping station sites. DISCUSSION On March 25, 2002 McGoodwin, Williams and Yates was requested to obtain a proposal from the Sponsored Research Program to include the new off-site alignment for Broyles Road. A copy of the April 3, 2002 response letter and the proposal from the Sponsored Research Program are attached. The increased cost for the added work is $2,511.61 c c • • Since the approval of Contract Amendment No 1 did not include any contingency funds, it is necessary for this matter to be brought before the City Council for approval. It is requested that the current approval include a contingency of $25,000.00 to allow any future minor authorizations to be handled administratively. RECOMMENDATION It is recommended that the Fayetteville City Council approve a budget adjustment m the amount of $27,511.61, and authorize the Mayor's execution of Contract Amendment No 2 for McGoodwin, Williams and Yates, Inc. for $2,511.61. 2 • • McCoodwin, Williams and Yates, Inc. If the City of Fayetteville chooses to authorize this work, our firm would require a contract amendment for this project, to add the cultural resource survey to our scope of work. As payment for this additional work, we would bill the City for the actual cost of the survey as outlined in the attached proposal, plus an engineering fee of five percent (5%).
