• A RESOLUTION AUTHORIZING McCLELLAND CONSULTING
ENGINEERS,INC. TO PROCEED UNDER THE CONTRACT FOR
ENGINEERING SERVICES RELATED TO THE DEVELOPMENT
OF THE. ARKANSAS BUSINESS TECHNOLOGY PARK, AS
APPROVED BY RESOLUTION #20-02
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council hereby authorizes McClelland Consulting
Engineers, Inc. to proceed under the contract for engineering services related to
the development of the Arkansas Business Technology Park as approved by
Resolution #20-02.

Subject: Approve Resolution Authorizing McClelland Engineering to Proceed With Their
Contract for 1-540 Business/Technology Park
Background
Four weeks ago the Council authorized two contracts which allowed work to begin on the
1-540 Business/Technology Park. This authorization was limited to work which would
define the parameters of the area of mitigation, review the potential scope of the
mitigation, and define how the actual development of the land to eventually be•
subdivided would proceed. The Council also requested that public input on the project be
sought and that monthly reports be made to the Council on activities and status of the
work and project.
Discussion
On February 28 from 5:30 p.m. to 8:00 p.m. a public meeting was held in the Town
Center to provide an historicaLas well as future perspective of the of the project.
Following this approximate 30 -minute introduction, the meeting participants were broken
into small groups and asked to discuss in a roundtable format the various issues from
their point of view. Comments could either be provided in writing or recorded by a
Project Team member who was assisting each table. Most comments were received in
writing, with 32 comment sheets returned from the 48 participants who signed in. These
comment sheets and sign in sheets are attached for your review.
The comments can be grouped generally into three main areas, those who feel that the
project is not addressing the environmental issues, those who favor the project but want
assurance that certain analysis is conducted and responded to appropriately, and those
who favor the project objectives and direction as presented.

The meeting attendees included a sizable number of residents who were at the meeting to
express a particular interest in soccer activities for the area north of Clabber Creek. What
was interesting about this group was the fact that they generally felt that the ecological
sensitivity that was expressed in the design considerations discussed in the presentation
were appropriate for the site and that they appreciated the sensitivity that was proposed to
be shown to the fragile environment of the Wilson Spring Area.
Some of the design considerations, which will be discussed with the Council during the
presentation on March 19, included limited use of curb and gutter, permeable pavement
in parking lots, walkways, etc. where appropriate, grass and landscaped drainage swales,
bio -filters and rain gardens, as a part of the storm water management system, and
maintenance of the current site hydrology though individual lot storm water management
and retention to the maximum extent possible.
Discussion in the presentation also included possible mitigation activities within the
approximatc 100 -acre conservation/preservation area. The staff will also be presenting
these options to the Council during the presentation on March 19. These were all
presented as possible activities, which will require scientific analysis and concurrence by
the regulatory agencies, U. S. Corps of Engineers and U. S. Fish and Wildlife before any
activity is undertaken.
At the conclusion of the meeting following the worktable reports, representatives of the
U. S. Corps of Engineers and U. S. Fish and Wildlife made some briefcomments. In
summary, those comments indicated a very favorable appreciation for the efforts that the
City of Fayetteville was putting forward to address the ecological issues that have
surrounded this 289 acres for the last 12 years. Perhaps the most telling were the
comments from the Corps, which indicated that there would probably not need to be
other regulatory required public meetings, if the City followed through with the design
parameters as had been discussed and the comment from Fish and Wildlife that if the
City continued with the design parameters for the conservation and development areas as
discussed, that the Arkansas Darter may not need to be listed as endangered.
As this project proceeds there will be additional public information meetings, in addition
to the public hearings required of any development being considered within the City
The Staff will bring the approximate 30 -minute presentation to the Council meeting of
March 19 so that the Council and the viewing public can see the considerations that will
be given to the development of this site.
Recommendation
Approve resolution allowing McClelland Engineering to proceed with development of all
work authorized in their contact as approved February 5, 2002.
