A RESOLUTION ACCEPTING THE PARKS AND RECREATION
ADVISORY BOARD'S RECOMMENDATION TO ACCEPT ONE
HUNDRED SEVENTEEN THOUSAND DOLLARS ($117,000.00)
CASH IN LIEU OF THE REQUIRED PARK LAND DEDICATION
FOR SOUTHERN VIEW APARTMENTS.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas
hereby accepts the Parks and Recreation Advisory Board's recommendation to
accept One Hundred Seventeen Thousand Dollars ($117,000.00) cash in lieu of
the required Park Land Dedication for Southern View Apartments.

SUBJECT: Southern View Apartments
Background
Southern View Apartments is a proposed large scale development located east of I-540 and west of
Ramay Junior High and West Fayetteville High School Campus. The owner is Lindsey and
Associates. The proposed plat includes 312 multi -family units on 19.39 acres. The requirement of
parkland is 6.24 acres and the money -in -lieu is $117,000. The Park Land Dedication Ordinance
states if a large scale development is over 40 acres or 100 units, the requirement is land.
"...However, if the Parks and Recreation Advisory Board determines that a neighborhood park is not feasible or
advisable, it may recommend to the City Council that a cash contribution pursuant to our ordinance be accepted in lieu
of land dedication. The City Council will either accept the recommendation for a cash contribution or return the
subdivision plat to the Parks Board with instructions or for further study."
Current Status
Parks and Recreation Staff has met with the engineering firm to evaluate the site. The development
was presented on location to the Parks and Recreation Advisory Board on November 4, 2002. See
attached minutes.
Recommendation
The Parks and Recreation Advisory Board and Park Staff recommend a money -in -lieu of land
contribution for this development. The money -in -lieu contribution will be used for park
improvements in the southwest park quadrant. Existing parks in close proximity to this
development include Hotz Park (1 acre) and Finger Park (19 acres). Southern View Apartments
will provide a small park area for the Southern View community which will include a playground
area, clubhouse, swimming pool, picnic tables and a lake. A concrete sidewalkhrail will be built
along Futrall Road. The developer also recommends a money -in -lieu of land requirement. See
attached letter. Future trail expansion along this corridor could utilize existing street right of way.

This development is over 100 units and would require a
waiver of the ordinance.
1) The development is providing adequate park services for its patrons including a swimming
pool, club house, lake, picnic tables, and a playground, concrete sidewalk/trail along Futrall.
Ms. Eads commented the developers appeared to be providing amenities equivalent to those the city
would provide for a park.
MOTION:
Mr. Hill moved to recommend to the City Council to accept money in lieu of a land
dedication to satisfy the park land dedication requirement for Southern View Apartments.
Mr. Colwell seconded the motion.
Upon roll call, the motion was approved 5-0-0 with Mauritson absent for the vote.

Dear Kim:
Please find attached 12 copies of plans for the above referenced project. The
north 19 acres of the property has been rezoned RMF -18 from C-2 commercial.
The remaining property on the south end is zoned commercial.
The project will contain 312 multi -family units. We will provide a small park area
for the Southern View community that will include a playground area as shown
on the drawing. (Attached is the equipment the developer will provide). The
additional amenities for this project will include a clubhouse, swimming pool,
picnic tables, and a lake. A concrete sidewalk/trail will be built along Futrell road.
The developer is requesting to donate money in lieu of land for this project, since
we will provide an abundant of amenities.
