HomeMy WebLinkAbout169-02 RESOLUTION• 1 RESOLUTION NO. 169-02 A RESOLUTION ACCEPTING THE PARKS AND RECREATION ADVISORY BOARD'S RECOMMENDATION TO ACCEPT SIXTY- EIGHT THOUSAND ONE HUNDRED FIFTY DOLLARS ($68,150.00) CASH IN LIEU OF THE REQUIRED PARK LAND DEDICATION FOR PERSIMMON PLACE SUBDIVISION. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the City Council of the City of Fayetteville, Arkansas hereby accepts the Parks and Recreation Advisory Board's recommendation to accept Sixty -Eight Thousand One Hundred Fifty Dollars ($68,150.00) cash in lieu of the required Park Land Dedication for Persimmon Place Subdivision. Schuldt, Parks Development Coordinator DATE: October 9, 2002 SUBJECT: Persimmon Place Subdivision • Background Persimmon Place Subdivision is a proposed large scale development located south of Highway 16 and west of 46`h Ave. The owner is Larry Garroitt and the engineering firm is Jorgensen & Associates. The proposed plat includes 145 single family units on 59.6 acres. The requirement for parkland is 3.625 acres and the money -in -lieu is $68,150. The Park Land Dedication Ordinance states if a large scale development is over 40 acres or 100 units, the requirement is land. "...However, if the Parks and Recreation Advisory Board determines that a neighborhood park is not feasible or advisable, it may recommend to the City Council that a cash contribution pursuant to our ordinance be accepted in lieu of land dedication. The City Council will either accept the recommendation for a cash contribution or return the subdivision plat to the Parks Board with instructions or further study" (Unified Development Ordinance No. 166.03K ) Current Status Parks and Recreation staff has met with the engineenng firm to evaluate the site. The development was presented on location to the Parks and Recreation Advisory Board on October 7, 2002. See attached minutes. Recommendation The Parks and Recreation Advisory Board and Park staff recommend a money -in -lieu of land contribution for this development. The money -in -lieu contribution will be used for park improvements in the southwest park quadrant. As stated in the Parks and Recreation Advisory Board minutes, Park staff has visited with Mr. Boettcher, Public Works Director, over the possible utilization of city -owned land located near the development for use as a neighborhood park (see map). Mr. Boettcher and Park staff believe that the, yet to be developed, facility plan for the city -owned property will allow for creation of a new neighborhood park. In addition, the citizens of this development will benefit from their proximity to the Fayetteville Boys and Girls Club which will be located approximately V2 mile to the east. Additionally, the organization is actively searching for more board members. Mr. Hatfield announced the grand opening celebration of East Mud Creek Trail will be October 10 from 5:00 p.m. until 7:00 p.m. Several events will take place along with door prize awards. Parking is on Old Missouri Road behind Butterfield Trail Village. The Parks and Recreation Advisory Board conducted a site tour of the following proposed developments: 6. Development Name: Sequoyah Commons Engineer: EB LandWorks, Inc. Owner: Greg House Location: Olive Avenue, South of Spring Street on Mt. Sequoyah Park District: SE Units: 33 Multi Units Total Acres: 2 acres Land Dedication Requirement: 0.66 acres Money in Lieu Requirement: $12,375 Existing Parks and Acreage: Mt. Sequoyah Gardens (2.42 acres) Staff Recommendation: Money in Lieu of Land 1) The land dedication for park usage would be minimal. 2) The development is located across the street from Mt. Sequoyah Gardens Park. Mandy Bunch and Melissa Evans of EB LandWorks, Inc. met the Parks and Recreation Advisory Board on site. MOTION: Mr. Marley moved to accept money in lieu of a land dedication to satisfy the park land dedication requirement for the proposed Sequoyah Commons development. Mr. Hill seconded the motion. Upon roll call, the motion was approved unanimously 7-0-0. 7. Park staff has visited with Mr. Boettcher, Public Works Director, over the possible utilization of city -owned land located near the development for use as a neighborhood park. Mr. Boettcher and Park staff believe that the, yet to be developed, facility plan for the city -owned property will allow for creation of a new neighborhood park. In addition, the citizens of this development will benefit from their proximity to the Fayetteville Boys and Girls Club which will be located approximately 'A mile to the east. MOTION: Mr. Cook moved to accept money in lieu of a land dedication to satisfy the park land dedication requirement for the proposed Persimmon Place Subdivision and request a waiver of Ordinance No. 166.03K by City Council. Mr. Mauritson seconded the motion. Upon roll call, the motion was approved unanimously 6-0-0 with Pawlik-Holmes absent for the vote. 8.
