A RESOLUTION TO APPROVE A CONTRACT WITH CROSSLAND
CONSTRUCTION, INC TO CONSTRUCT THE FIXED BASE
OPERATIONS HANGER IN THE AMOUNT OF $634,000.00 PLUS A
CONTINGENCY OF 63,400.00, THE ACCEPTANCE OF A STATE
DEPARTMENT OF AERONAUTICS GRANT IN THE AMOUNT OF
$200,000.00 AND APPROVAL OF A BUDGET ADJUSTMENT IN THE
AMOUNT OF $697,400.00
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas
hereby approves a construction contract with Crossland Construction, Inc. to
build the Fixed Base Operations Hangar in the amount of $634,000.00 plus a
contingency of $63,400.00.
Section 2. That the City Council of the City of Fayetteville, Arkansas
hereby accepts the State Department of Aeronautics grant in the amount of
$200,000.00 to assist in the construction of this FBO Hanger.
Section 3. That the City Council of the City of Fayetteville, Arkansas
hereby approves a budget adjustment in the amount of $697,400.00 for the
construction of the Fixed Base Operations Hanger.

2002, by and between Crossland Construction Co., Inc. and the City of Fayetteville, Arkansas:
WITNESSETH:
That Crossland Construction Co., Inc., for the consideration hereinafter fully set out, hereby agrees
with the City of Fayetteville as follows:
1. That Crossland Construction Co., Inc. shall furnish all the materials, and perform all of the work
in manner and form as provided by the following enumerated Drawings, Specifications, and
Documents, which are attached hereto and made a part hereof, as if fully contained herein and are
entitled FBO Hangar for Fayetteville Municipal Airport, dated August, 2002.

2. That the City of Fayetteville hereby agrees to pay to Crossland Construction Co., Inc. for the
faithful performance of this Agreement, subject to additions and deductions as provided in the
Specifications or Bid, in lawful money of the United States, the amount of: Six -hundred thirty-four
thousand Dollars ($634,000.00)
3. The Work will be substantially completed within 150 days after the date when the Contract Time
commences to run as provided in the Notice to Proceed.
4. Liquidated Damages: The City of Fayetteville and Crossland Construction Co., Inc. recognize that
time is of the essence of this Agreement and that the City of Fayetteville will suffer financial loss
if the Work is not completed within the time specified above, plus any extensions thereof allowed
in accordance with the General Conditions. They also recognize the delays, expense, and
difficulties involved in proving the actual loss suffered by the City of Fayetteville if the Work is
not completed on time. Accordingly, instead of requiring any such proof, the City of Fayetteville
and Crossland Construction Co., Inc. agree that as liquidated damages for delay (but not as a
penalty) Crossland Construction Co., Inc. shall pay the City of Fayetteville Five Hundred Dollars
(5500.00) for each day that expires after the time specified in Paragraph 3 for Substantial
Completion.
5. That within 30 days of receipt of an approved payment request, the City of Fayetteville shall
make partial payments to Crossland Construction Co., Inc. on the basis of a duly certified and
approved estimate of work performed during the preceding calendar month by Crossland
Construction Co., Inc., LESS the retainage provided in the General Conditions, which is to be
withheld by the City of Fayetteville until all work within a particular part has been performed
strictly in accordance with this Agreement and until such work has been accepted by the City of
Fayetteville.

That upon submission by C411,1and Construction Co., Inc. of evidentisfactory to the City of
Fayetteville that all payrolls, material bills, and other costs incurred by Crossland Construction
Co., Inc. in connection with the construction of the work have been paid in full, final payment on
account of this Agreement shall be made within 60 days after the completion by Crossland
Construction Co., Inc. of all work covered by this Agreement and the acceptance of such work
by the City of Fayetteville.
7. It is further mutually agreed between the parties hereto that if, at any time after the execution of
this Agreement and the Surety Bond hereto attached for its faithful performance and payment,
the City of Fayetteville shall deem the Surety or Sureties upon such bond to be unsatisfactory or
if, for any reason such bond ceases to be adequate to cover the performance of the work,
Crossland Construction Co., Inc. shall, at his expense, within 5 days after the receipt of notice
from the City of Fayetteville, furnish an additional bond or bonds in such form and amount and
with such Surety or Sureties as shall be satisfactory to the City of Fayetteville. In such event, no
further payment to Crossland Construction Co., Inc. shall be deemed to be due under this
Agreement until such new or additional security for the faithful performance of the work shall be
fumished in manner and form satisfactory to the City of Fayetteville.
8. No additional work or extras shall be done unless the same shall be duly authorized by
appropriate action by the City of Fayetteville in writing.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement on the day and date first
above written, in three (3) counterparts, each of which shall, without proof or accounting for the other
counterpart be deemed an original Contract.

FBO Hangar Construction Project

Background:
The Fayetteville Municipal Airport has no hangars to lease. Since March, we have been full.
The airport board at their June meeting approked the project to construct a newFBO Hangar.
We started engineering and design immediatelyand on September 26 opened bids for the
project. Seven bids were received. The engineer's estimate was $713,612.37. The lowest bid
was from Crossland Construction Co. for $634,000. The second lowest was for $636,000 from
Maranoni Construction.
To continue expansion we need space for new tenants to store their aircraft as well as for
overnight storage of transient aircraft. The new FBO hangar will allow a great degree of
flexibility. New tenants can be placed in the large hangar until a newT Hangar could be built.
The FBO hangar will hold up to 20 small aircraft. DHL has expressed interest in a heated
hangar for periods of severe weather. Many corporate pilots have expressed similar interest.
Our survey found 37 pilots, 20% of those responding were interested in a heated hangar
including several from Drake Field. Those would move to the heated, full service hangar
opening up some T Hangar units for new customers. This facility is the next step in the rebirth of
the Fayetteville Municipal Airport, Drake Field as the premiere general aviation airport in
Northwest Arkansas.
Purpose: Accept the lowest responsive bid and award contract for construction of the FBO
hangar to Crossland Construction Co.
Budget Considerations: The lowest responsive bid of 634,000 plus 10% contingency. Funds
are available. A State of Arkansas grant for $200,000 has been approved for this project. A
Budget Adjustment is attached.
Requested Action: Approve award of the contract for construction of the new FBO
Hangar plus a 10% contingency to Crossland Construction Company.

Dear Mr. Boudreaux:
The Arkansas Aeronautics Commission in their meeting of July 10, 2002 approved a State
Airport Aid Grant in the amount of $200,000.00 for construction of hangar to accommodate
FRO expansion at Fayetteville Municipal Airport. (50-50%)
Your grant has been assigned a number for identification purposes. Please use 1926-02 as
your grant number when corresponding with our office concerning your project. You should
advise the Director of this office if you find you will not be able to complete the project for
the amount approved. An amendment request for the project may then be acted on at the
next Commission meeting. The Commission will not be responsib;ie for any additional
project costs unless the sponsor has received notification in advance.
The Commission has asked that we call your attention to Page Three (3) of your applicatton
for State Airport Aid. You agreed, when the application was submitted to start the project
within three months after approval or the grant would be null and void. The next to the last
paragraph requires that the project be completed within one year unless it is partially funded
by the Federal Aviation Administration (FAA). Please advise if cin.umstances beyond your
control prevent the completion within the allotted time, otherwise, the grant may be
canceled.
Payment of this grant may be made on completion of the project. Please request payment of
this grant in writing and include your documentation for the project at that time.

The Sponsor agrees to furnish the Arkansas Department of Aeronautics a copy of
the legal instrument affecting use of the property for an airport. In
application for a new landing site or expansion of existing facility, the FAA
Form 7480.1, Notice of Landing Area Proposal, must be approved by FAA before
review for grant can be made by the state.
No land purchased with State Grant Funds may be sold or disposed of without
State Commission approval. All requests for sale or disposal of property will
be considered on an individual case basis.
No airport accepting State Grant funding may issue an Exclusive Rights Lease.
All applications for navigational aids (such as NDB or ILS) must have FAA site
approval before a state grant can be approved.
All Grant applications involving Federal Airport Improvement Program (AIP)
funding must be accompanied by the approved FAA application.
If this project is approved by the Arkansas Department of Aeronautics, and is
accepted by the sponsor,' it is agreed that all developments and construction
shall meet standard FAA construction practices as outlined in the
specifications of this agreement. Runways, Taxiways, Parking Ramps, etc.,
shall have a base and a thickness that will accommodate the weight of aircraft
expected to operate at this airport.
All grant applicants (City and/or County) are' totallyresponsible for
compliance with all Federal, Stater_ County and City Laws, Statutes,
Ordinances, Rules, Regulations, and Executive Orders concerning contracts and
purchases for which this grant is approved and issued. All grant applicants
must submit with their applications a completed Contract and Grant Disclosure
and Certification Form. (Form F -1 -Pages 162).
It is understood and agreed that should the sponsor fail to start this project
within three (3) months of the Arkansas Department of Aeronautics' date of
acceptance, that this grant is null and void.
It is also agreed that this project, except FAA funded projects, shall be
completed within one year from the date of acceptance of this grant by the
Arkansas Department of Aeronautics,Applications for extension will be
entertained if circumstances beyond the sponsor's control occur.
Funds will be disbursed according to Department procedures and final
inspection of completed project. (See Instruction Page).
IN WITNESS WHEREOF, the sponsor has caused this Application for State Airport
Aid to be duly executed in its name, this 25th day of June , 20 02 .

Dear Mr. Boudreaux:
As you are aware, bids were opened for the referenced project on September 26, 2002.
We were very pleased that seven bids were received, with the lowest bid coming from Crossland
Construction Co., Inc. in the amount of $634,000. This was substantially under the Engineer's
estimate of $713.612.37.
Of the seven bids received, five were below the Engineer's estimate. l attribute that to a
very competitive situation influenced somewhat by workload in Northwest Arkansas vs. number
of qualified Contractors.
Our company has worked successfully with Crossland Construction Co. before (on the
Science Engineering Building, UA Campus). They have an established office in Rogers, AR
(home office: Columbus, Kansas). They have an impressive list of completed projects — both
larger and smaller than the FBO Hangar.
They are licensed in the State of Arkansas to do "Municipal and Utility Construction"
and their "Bid Limit" is unlimited.
Without reservation, I recommend award of the Construction Contract for the FBO
Hangar to Crossland Construction Co., Inc. in the Total Lump Sum Base Bid amount of
$634,000.

The following changes are hereby made to the CONTRACT DOCUMENTS:
1. Perform additional work required to add manual wall switches to enhance the flexibility of controlling the hangar lighting.
2. Paint the overhead door and trim of the sliding door to match/blend with the metal building trim and the other walk-through doors
to improve the appearance of the hangar.
3. Install conduit across the site to provide telephone service to the hangar building.
4. Reconciliation of the Landscaping "allowance" set up in the Bid Form results in the confirmation that the entire allowance of
$5,000 was expended on landscaping for the project
5. Undercut/backfill with select material under the east -side column foundations (32 cubic yards).
Justification:
1. Added flexibility for lighting control was deemed necessary by the Owner in response to patron usage.
2. The overhead door was provided with a factory -applied paint system that was expected to reasonably complement the metal
building color scheme Once on-site, it was clear that the door color clashed with the other metal building component colors.
3. The conduit was installed in accordance with the requirements of the local telephone service provider.
4. Landscaping was always anticipated; extent was unknown initially.
5. Existing subgrade material under the eastern column foundations was wet, soft, and yielding.
