A RESOLUTION TO ACCEPT THE RECOMMENDATION
OF THE FAYETTEVILLE PARKS AND RECREATION
ADVISORY BOARD TO REQUIRE A CASH CONTRIBUTION
FOR THE PARK LAND DEDICATION REQUIREMENT FOR
SKYLAR PLACE ADDITION
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas
hereby accepts the recommendation of the Fayetteville Parks and Recreation
Advisory Board to require a cash contribution of $47,915 00 to satisfy the
required park land dedication for Skylar Place Addition pursuant to the Unified
Development Ordinance §166.03 K.

Background
Skylar Place Addition is a proposed large scale development located west of Sang Ave. and
South of Deane Street. The owners are Sam Mathias and Bleaux Barnes and the engineering firm
is Jorgensen & Associates. The development contains 119 multi -units and 7 single family units
on 21.03 acres The requirement for park land is 2.555 acres and money in lieu is $47,915. The
Park Land Dedication Ordinance states if a large scale development is over 40 acres or 100 units,
the requirement is land.
tHowever, if the Parks and Recreation Advisory Board determines that a neighborhood
park is not feasible or advisable, it may recommend to the City Council that a cash
contribution pursuant to our ordinance be accepted in lieu of land dedication. The City
Council will either accept the recommendation for a cash contribution or return the
subdivision plat to the Parks Board with instructions or further study." (Unified
Development Ordinance No. 166.03K)
Current Status
Parks and Recreation staff met with the engineering firm to evaluate the site. The development
was presented to the Parks and Recreation Advisory Board on September 9, 2002. See attached
minutes.
Recommendation
The Parks and Recreation staff and Parks and Recreation Advisory Board recommend a money in
lieu contribution for this development. The money in lieu contribution will be used for park
improvements in the northwest park quadrant.
The developers of Skylar Place Addition have proposed to provide 2.17 acres of land for a
neighborhood park. The majority of the proposed dedication is located in the 100 year flood
plain. The proposed dedication also includes over 0.55 acres of detention facilities. The
proposed park is divided into three partials, separated by two city streets. The conceptual loop
trail plan has four street intersections and is approximately 0.15 miles in length. The Parks and
Recreation Advisory Board and Park staff believe that the proposed land dedication will not meet
the desires of the neighborhood due to the limited size, configuration and relationship to the
detention ponds/flood plain. The Parks and Recreation Division is currently not accepting
detention facilities for parkland purposes due maintenance issues and because the developer is
responsible for drainage control. See attached plat.
From input at the public meeting, Park staff understands that the community is interested in
having a neighborhood park in this area of town. Asbell Park, which is located across the street
from the development, is used for many active sports and currently does not provide the
neighborhood park amenities desired by the community. Park staff believes that Asbell Park will
have opportunities in the future to provide a neighborhood park atmosphere. The Parks and
Recreation Advisory Board and Park staff recommends working with the Fayetteville School
System to add neighborhood park features to Asbell Park. After the public meeting, the
neighbors agreed to create a list of priority park amenities for the Park staff to incorporate into

The regular meeting of the Fayetteville Parks and Recreation Advisory Board was called to order
at 5:30 p.m. in front of Asbell Elementary School, 1500 N. Sang Avenue, Fayetteville, Arkansas
by Chairman Colwell.
PRESENT: Parks and Recreation Advisory Board members Mauritson, Eads, Colwell, Cook,
Hill, Marley, and Pawlik-Holmes; Ctty Staff Earnest, Edmonston, Gulley, Hatfield, Schuldt,
Nelson, Wright and Audience.

1) This development is in close proximity to Asbell, Lewis, and Friendship Parks.
2) Due to.drainage problems in this area, a park in this location is not advisable.
Neighborhood Association President, Richard Maynard, expressed a need for a recreational park in
the area and questioned the use of park fees which had been obtained from other developments in
the area Sarah Cox drives her children to Wilson, Gulley, or Davis Parks. Although she lives
within walking distance of Asbell Park, Ms. Cox said Asbell is not family -friendly and unattractive.
Barbara Fitzpatrick echoed that sentiment. She said there was no place within walking distance to

walk, to sit under trees, or to enjoy a picnic. Because of the soccer field, Ms. Fitzpatrick said she
must drive to another park across town. Linda Scarbrough labeled Asbell a sports facility and said it
is not a place for family recreation because of lack of parking and overcrowding. Ms. Scarbrough
felt the neighborhood should see benefits from developments in the area by having a park. Mr.
Maynard was surprised by resistance to the idea of having a park inside the proposed development.
He proposed the developers use the required park fees for development and lessen the maintenance
burden on the city by utilizing the comrnunity to help mow and maintain it. His idea is to take park
land fees to develop the green space, and it would be the city's to manage. If the city didn't want
the park, then it could be given to the POA. Mr. Gulley explained the Park Land Dedication
Ordinance. The city can not develop land it does not own or lease. Ms. Edmonston explained
criteria for accepting park land and the importance of following park master plan recommendations.
She cited Davis, Red Oak, Bundricic, and Lewis as parks benefiting from park fees.
Regardless of whether park land or money in lieu fees are taken, Bleaux Bames said the green
space will remain because the property is maximized with the number of units. He also stated the
pond would be removed
Urban Development Director; Hugh Eamest, felt the piece of ground in question did not meet the
legitimate needs of the area. The 1-1 1/2 acre parcel is too small. He suggested staff meet with the
Fayetteville School District to discuss a better use of the Asbell property. Neighbors were urged t�
create a wish list of park amenities.
MOTION:
Mr. Colwell moved to accept money in lieu of a land dedication to satisfy the park land
dedication requirement for the proposed Skylar Place Addition and requested the Paris and
Recreation Advisory Board focus on working with the neighborhood to deternine their needs
for Asbell Park.
Mr. Mauritson seconded the motion.
Upon roll call, the motion was approved unanimously 7-0-0.
The Parks and Recreation Advisory Board reconvened at 7:00 p.m. in Room 326 of the City Administration

Re: Skyler Place Subdivision
As you know, we have submitted Skyler Place for consideration by the Parks Staff for
parks dedication. The owner/devcloper v‘ill be dedicating 2.17 Acrcs of greenspace
which includes the detention pond area. The owner would like some of this to apply to
parks dedication if possible. The tout amount uf wii an dtis pmject is 126. At 01125
acres per unit the dedication requirement would be 3.15 acres.
If the Parks Board decided to accept money in leau of land the owner does not have a
problem with this.
The Abell Neignborhood Association has requested that some of this money be
dedicated to this grecnspace area if
Wo will attend the Parks meeting on Sept. 9 to work this out.
