A RESOLUTION AUTHORIZING THE PARKS & RECREATION
DEPARTMENT TO ACCEPT A TONY HAWK FOUNDATION
GRANT IN THE AMOUNT OF FIVE THOUSAND DOLLARS
($5,000.00) FOR THE FAYETTEVILLE SKATEPARK PROJECT.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS•
Section 1. That the City Council of the City of Fayetteville, Arkansas
hereby authorizes the Parks & Recreation Department to accept a Tony Hawk
Foundation Grant in the amount of Five Thousand Dollars ($5,000:00) for the
Fayetteville Skatepark project.
PASSED and APPROVED this 3rd day of September, 2002.

Dear Eric,
We are pleased to inform you that the Tony Hawk Foundation has decided to grant your
organization $5,000 to assist in the construction of a public, non-profit skatepark in Fayetteville.
The Foundation will pay one installment of $5,000, which will be sent after we've received the
signed grant agreement outlined below.
The grant is made subject to the following conditions:
1. You agree to assume any and all liability for:
a. The construction and operation of the skateboard park, and
b. The implementation of any information or advice given to you by the
Foundation.
2. The Foundation has the right to terminate the grant, to modify or withhold any payment
otherwise due under the grant, or to require repayment of any expended or unexpended
grant funds if, in the Foundation's sole judgment:
a. Grant funds or income arising from the grant have been used for purposes other
than those described above; or
b. Your organization has failed to comply with any of the terms of the grant.
3. You agree to provide a written progress report (not to exceed two pages) on or before six
months from the date of this agreement, and a final report twelve months from such date,
detailing the manner in which the Grant money has been spent and the progress you've
made in accomplishing the purpose of the Grant.
4. You qualify as a public charity as described in Section 50I (c)(3) and under IRC sec.
I70(b)(1)(a), or you are a state or local agency, including public school systems or public
projects. You agree to inform the Foundation immediately of any alterations in your
organization's structure or activities which may adversely affect its status under this Code
provision.
5. You agree NOT to expend Tony Hawk Foundation grant funds:
a. To carry on propaganda or otherwise to attempt to influence legislation within
the meaning of the Internal Revenue Code 4945(d)(1), or
b. To influence the outcome of any specific public election or to carry on, directly
or indirectly, any voter registration drive within the meaning of Internal Revenue
Code Section 4945(d)(2). (The term "legislation" in this case does not include
actions by executive, judicial or administrative bodies, such as school boards,

Foundation in your organization's publications, including print and electronic media,

Background
The Fayetteville Skatepark, which was designed in a series of public meetings with Fayetteville
skaters, will be an 18,870 sq. ft. concrete facility. The skatepark will have beginner and
advanced sections to accommodate all skill levels. Many of the elements within the skatepark
will duplicate what the skaters use on our city streets.
Current Status
The construction cost estimate provided by our skatepark consultants Purkiss-Rose, RSI is
$384,855. Parks and Recreation has been working more than two years to obtain funding for the
project We have received two grants, a $100,000 outdoor matching grant from Arkansas Parks
and Tourism and a $5,000 pending grant from the Tony Hawk Foundation. Fayetteville Skaters
have also taken an active role in the fund-raising process accumulating over $5,000 by working
on vanous fund-raising activities, including a can -drive, letter writing campaign, and donations
from birthday parties. Approximately 25 percent of the project cost will be paid for by grants
and skater fund-raising. The remaining funds were allocated from the Park Land Ordinance and
the Parks and Recreation Capital Improvement Program. Parks and Recreation staff's goal is to
bring a successful bid and contract to the City Council in the next couple of months, in order to
begin construction this fall.
Recommendation
The Parks and Recreation Division seeks approval to allow the City to enter into an agreement
with the Tony Hawk Foundation. The Tony Hawk Foundation will provide a $5,000 grant to the
Fayetteville Skatepark upon receiving signed agreement. If you have any questions or need

STATEMENT OF AGREEMENT No. 2

The State of Arkansas, represented by the Executive Director, Arkansas Department of Parks and Tourism and the Applicant
named above (hereinafter referred to as the Applicant) mutually agree to perform this agreement in accordance with the Land
and Water Conservatiori Fund Act of 1965, 78 Stat. 897 (1964), and with the terms, promises, conditions, plans, specifications,
estimates, procedures, project proposals, maps, and assurances attached hereto and hereby made a part hereof.
The State of Arkansas hereby promises, in consideration of the promises by the Applicant herein, to obligate to the Applicant
the amount of money referred to above, and to tender to the Applicant that portion of the obligation which is required to pay
the State of Arkansas share of the costs of the above project stage. based upon the above percentage of assistance. and also
based upon receipt of those funds from Act 729 of 1987. The Applicant hereby promises, in consideration of the promises made
by the State of Arkansas herein, to execute the project or project stage described above in accordance with the terms of this
agreement.
The participant may not deviate from the scope of the project without the concurrence of the Arkansas Department of Parks and
Tourism Executive Director. When one of the conditions in the agreement changes, such as change in the project scope, a
revised estimate of costs, a deletion or additions of items, or a need to extend the project period, the participant will submit
In writing a formal request to the Executive Director for its approval.

The Applicant agrees to comply with Abe requirements of the Arkansas Department of Parks and Tourism regulations by
Immediately erecting a project sign and by burying or relocating underground overhead lines at all development and acquisition

The applicant agrees to be responsible for operation and maintenance of said park in perpetuity.
The undersigned Applicant of the State of Arkansas does hereby agree and accept the same responsibility and obligations as
set out in the herein described project and to the same extent and in the same manner, including all requirements. as does
the State of Arkansas. The undersigned Applicant of the State of Arkansas further understands, agrees, and accepts that this
project is not effective until this project agreement has been duly executed by the State of Arkansas and the said Applicant Is
notified accordingly: and no work shall be initiated and/or undertaken by said Applicant on the herein described project until
it has received said notification by the State.

OUTDOOR RECREATION GRANTS PROGRAM
STATEMENT OF AGREEMENT No. 2

The State of Arkansas, represented by the Executive Director, Arkansas Department of Parks and Tourism and the Applicant
named above (hereinafter referred to as the Applicant) mutually agree to perform this agreement in accordance with the Land
and Water Conservation Fund Act of 1965, 78 Stat. 897 (1964), and with the terms, promises, conditions, plans, specifications,
estimates, procedures. project proposals, maps, and assurances attached hereto and hereby made a part hereof.
The State of Arkansas hereby promises, in consideration of the promises by the Applicant herein, to obligate to the Applicant
the amount of money referred to above, and to tender to the Applicant that portion of the obligation which is required to pay
the State of Arkansas share of the costs of the above project stage, based upon the above percentage of assistance, and also
based upon receipt of those funds from Act 729 of 1987. The Applicant hereby promises, in consideration of the promises made
by the State of Arkansas herein, to execute the project or project stage described above in accordance with the terms of this
agreement
The participant may not deviate from the scope of the project without the concurrence of the Arkansas Department of Parks and
Tourism Executive Director. When one of the conditions in the agreement changes, such as change in the project scope, a
revised estimate of costs, a deletion or additions of items, or a need to extend the project period, the participant will submit
in writing a formal request to the Executive Director for its approval.
The following special project terms and conditions were added to this agreement before it was signed by the parties hereto:
(1) Historic Properties Preservation Act of 1966 (80 Stat. 915 16 U.S.C. 470), Executive Order 11593 (Protection and
Enhancement of the Cultural Environment); (2) Undorm Relocation Assistance and Real ereoertas auisitien Policies (41 CFR
114-50) P. L 91-646; (3) National Environmental Pohcv Act of i9e (Public Law 91-190); (4) OMB Circular A-45;
(5) Architectural Barriers Act of 1968 (P. L. 90-480); (6) Eiteeutrve Order 12088 (Pollution Control), (7) Fxecutive Order 1198
es amended (Floodplain Management); (8) OMB Circular A-102 (9) Executive Order 11940 as amended (Equal Employment
Opportunity) 41 CFR Part 60; (10) Copeland 'Anti -Kickback' Act (18 U S C 874) DOL (29 CFR, Part 3); (11) Clean Air Act of
SSZQ (Construction Contract Amounts in Excess of $100.000.00; (12) Nondiscrimination on the Basis of Handicap Section
504 Rehabilitation Act o1 1973. DOI (43 CFR Part 17).
The Applicant agrees to comply with the requirements of the Arkansas Department of Parks and Tourism regulations by
Immediatelyerecting a project sign and by burying or relocating underground overhead lines at all development and acquisition
project sites.
The applicant agrees to be responsible for operation and maintenance of said park in perpetuity.
The undersigned Applicant of the State of Arkansas does hereby agree and accept the same responsibility and obligations as
set out in the herein described project and to the same extent and in the same manner, including all requirements, as does
the State of Arkansas. The undersigned Applicant of the State of Arkansas further understands. agrees, and accepts that this
project is not effective until this project agreement has been duly executed by the State of Arkansas and the said Applicam is
notified accordingly: and no work shall be initiated and/or undertaken by said Applicant on the herein described project until
it has received said notification by the State.
