RESOLUTION NO. 131-02
A RESOLUTION ADOPTING AN ACTION PLAN FOR THE
IMPLEMENTATION OF A CONSOLIDATED WASTE
MANAGEMENT PROGRAM; AND AUTHORIZING
COMPETITIVE BIDDING FOR HAULING SERVICES AND
CONTAINER RENTAL TO ACHIEVE SHORT-TERM
IMPLEMENTATION OF THE PLAN.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council of the City of Fayetteville, Arkansas,
hereby adopts an Action Plan for the implementation of a Consohdated Waste 1
Management Program, as set forth in Option 2 of Attachment 'A," attached
hereto and made a part hereof.
Section 2. That the City Council of the City of Fayetteville, Arkansas,
hereby authorizes competitive bidding for hauling services and container rental
to achieve short-term implementation of the plan.
PASSED and APPROVED this 20th day of August, 2002.

Subject: Commercial Solid Waste and Recycling Exclusive Municipal Franchise
Background
At the Council meeting of August 6, 2002 the City Council concurred with the
Administration recommendation to proceed with the development of a plan of action to
incorporate all municipal solid waste activities into a consolidated waste management
program This program would include the provision of all municipal solid waste and
recycling services by the City of Fayetteville.
The purpose of this consolidation is twofold: first to allow a full range of recycling
options to all businesses and residents in a coordinated effort to reduce landfill utilization
and second to assure the financial stability of the solid waste and recycling program of
activities and to maintain an affordable residential rate structure.
Discussion
The City Council is well aware that the City of Fayetteville is the exclusive provider of
municipal trash service to residents and small commercial container users. This change
will expand exclusivity to all municipal trash and recycling collection and hauling within
the City of Fayetteville.
In order to accomplish this transition there are two options. The first option is an
immediate transition in which all service will be provided by the City. This immediate
transition will require that the Solid Waste and Recycling Division contract for additional
equipment, vehicles, and manpower for 120 to 180 days as the Division ramps up to be
able to provide uninterrupted convenient and efficient service. A bid package soliciting
this service has been developed and will be ready for distribution August 21. The second
option is to provide a 12 month period in which the pnvate haulers can continue to
provide their services while the City acquires the necessary assets to implement service at
the end of the 12 month notice period.
