RESOLUTION NO. 3-02
A RESOLUTION AUTHORIZING THE ELIMINATION OF
PUBLIC PARKING ON THE SOUTH SIDE OF MOUNTAIN
STREET IN FRONT OF THE JOHN PAUL HAMMERSCHMIDT
FEDERAL BUILDING PURSUANT TO THE REQUEST OF THE
UNITED STATES MARSHALS SERVICE.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council hereby authorizes the elimination of
public parking on the south side of Mountain Street in front of the John Paul
Hammerschmidt Federal Building pursuant to the request of the United States
Marshals Service.

SUBJECT: Resolution Authorizing the Elimination of Public Parking Next to the
Federal Building
In light of the September 11 tragedy and the heightened security surrounding all federal facilities,
the U.S. Marshals Service has requested that we consider permanently closing all public parking
spaces on the north side of the Federal Building.
Nationwide, the U.S. Marshals Service has set a goal of establishing a 100 Il clearance of public
parking around all federal buildings. The federal government is redesigning all of their private
parking areas to ensure that public parking is farthest away from the building. The only other
public parking that is precariously close to the Fayetteville facility is the 20 spaces located on
both sides of Mountain Street directly in front of the building. After extensive consideration,
staff recommends changing the nine spaces closest to the building on the south side of the street
to be reused as follows: three spaces will be lengthened and changed into two handicapped
spaces for use by the public; the other six spaces will be changed to restricted parking for U.S.
officials only (off -premise officials that frequently visit the facility). The parking in these spaces
would be enforced by employees of the U.S. Marshals Service. We considered leaving these
spaces metered, but were afraid that this could be misleading to those looking for a parking
space. We also considered asking the federal government to reimburse the city an estimated
$2,000 in lost annual revenues, but decided not to recommend this because other cities, including
Fort Smith arc not charging for lost revenue. Therefore, we will merely attach signage to the
meter poles that states that the six spaces are for government officials only.
We recommend leaving the 11 parking meters on the north side of Mountain Street in place until
the renovation of the Mountain Inn parking garage begins. At that time, we could remove these
meters and encourage the owner to use this lane for entering and exiting the parking garage
(eliminating the current entrance on College that continues to be a traffic hazard).
As you may know, public parking on the south side has been blocked off since September 11.
Understandably, there have been no complaints, only positive feedback from the general public.
Staff recommends the approval of this resolution to support the efforts of our govemment in
accomplishing a safe environment for our federal employees.
