BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council hereby Authorizes the City
Landscape Administrator to apply for an Urban and Community Forestry
Assistance Grant from the Arkansas Forestry Commission to fund two (2)
workshops on Tree Preservation During Construction.

Commission. This is a matching grant with a maximum award of $10,000.00. I have prepared the
grant to commission a professional that will assist me in the presentation of two "Tree Preservation
During Construction" workshops. One workshop would be targeted toward builders and
contractors and the other would be targeted toward engineers, architects, and developers. Both
workshops would be provided by urban forestry professionals experienced in tree preservation
techniques. These professionals will be asked to use local projects, utilize professionals in the
area, and take advantage of current situations to aid and enhance the educational process. These
two, four hour workshops will incur costs for professional fees, room rental, incidentals, and
employee time.
The scope of the project is described in the application which I urge you to review. If possible 1
would like to rush this through the process due to the fact that it is due in Little Rock

Dear Mr. Akin:
Thank you for this opportunity to apply for the Urban and Community Forestry Assistance Grant.
Since 1993, the City of Fayetteville has shown concern for the state of the existing urban forest
through the existence of the Tree Preservation and Protection Ordinance. This year a diverse
group of citizens are revising the Tree Preservation Ordinance to improve on it's clarity and
credibility.
Although the current and the revised versions of the ordinance require specific methods of
protection for trees during construction, implementation of tree protection is difficult among a vast
group of developers, designers and contractors. Specific knowledge of tree physiology is crucial
for both those designing and building infrastructure, buildings, and amenities on developments.
Innovative design and construction methods are often needed as developments are designed,
reviewed by the city, and built for occupancy. As the administrator and inspector of this ordinance,
I see the real need for continuing the education process in relation to preserving natural resources
while developing for commercial, industrial, and residential growth.
This grant is to request assistance to provide two workshops on preserving trees during
construction. One workshop would be targeted toward builders and contractors and the other would
be targeted toward engineers, architects, and developers. Both workshops would be provided by
urban forestry professionals experienced in tree preservation techniques. These professionals will
be asked to use local projects, utilize professionals in the area, and take advantage of current
'situations to aid and enhance the educational process. These two, four hour workshops will incur
costs for professional fees, room rental, incidentals, and employee time.

Scope of Project
The preservation of trees and other natural resources has become one of the hottest local
planning and environmental issues. Within our own state of Arkansas we are seeing more
communities incorporating tree preservation ordinances into the development process.
Whether tree preservation initiatives come from the government, the developer, or from the
community, the motivation for retaining trees is varied and encompasses economic,
environmental, and social considerations. By their very nature, trees provide benefits and
add value to developments. The ability of trees to improve and maintain the quality of
water, soil, and air, and to remove pollutants from the air is well known Trees also provide
shade and help lower temperatures during hot weather. Trees enrich people's lives and
beautify landscapes. Preserving trees has positive effects on the image and attractiveness
of the entire community.
Although the concept of tree preservation sounds simple, anyone involved in the process
knows that combining tree preservation with the installation of roads, utilities, and buildings
is complicated. Designing for tree preservation means that trees are considered an integral
feature of the project from the first stage of planning. The tree's physiology must be
understood, concessions must be made during site design, and innovative construction
techniques must be considered. From the beginning of the process to the end, tree
preservation must be taken seriously.
As the administrator and inspector for the city's tree preservation and protection ordinance,
I see first hand that organization, planning, and communication are key. Many different
designers and contractors are involved in the development of land and each must be
aware of the preservation goals of the project. Knowing which trees to preserve and
interpreting the construction plans and details for tree preservation is only a part of the
process. Each professional, laborer, and inspector should have knowledge of how
construction will effect a specific tree in order for preservation to be successful. As
problems arise and adjustments are made in the field the aspects of tree preservation
might be overlooked unless those involved in the decisions are aware of the construction
and environmental impact to the trees.
The City of Fayetteville has been on the forefront for developing and implementing tree
preservation ordinances within the state. With the diverse social makeup of the community,
preservation ofthe environment is always a concern. As the city encompasses revisions
to our Tree Protection and Preservation Ordinance, knowledge of the ordinances specific
requirements and general acceptance of tree preservation is the biggest hurdle in the
planning process. Once a development is reviewed and accepted by the city, knowledge
of how to protect trees dunng construction is the second hurdle. We lose as many or more
trees from poor construction practices as we do from poor planning and design. It is a
major goal of the city to educate the players of the development process how to be
successful preserving trees. Thus a tree preservation workshop presented by the city is
a major step in the right direction.

Our plan is to tailor the workshops to issues and construction constraints common to
Northwest Arkansas. By incorporating local projects, utilizing professionals in the area and
taking advantage of current situations, participants will be more likely to take stock in what
is presented. Two workshops would be provided; one workshop targeted towards the
planning and design process with engineers, architects, landscape architects, and
developers as the main participants, and one workshop targeted toward constructing
around trees with builders and contractors as the participants.
Although the primary focus of the workshops will be to inform local developers, design
professionals, builders, and site contractors on tree preservation, key staff within the city's
Public Works Division will be encouraged to attend Public Works crews will also have the
opportunity to view necessary portions of the workshop since the city will have the sessions
recorded on video tape. With the city's Community Access Channel opportunities, these
workshops will be suggested for general viewing on the Fayetteville government channel
providing a conduit for tree preservation information to reach the general public. And based
on space and cost limitations, city officials from other communities around Northwest
Arkansas would be invited to attend. The workshops would be free of charge to the
participants and would be scheduled in the winter months which will result in a better
attendance by the development community.
I believe the Arkansas Urban Forestry Council and the Arkansas Forestry Commission will
find this grant request meets many of the program objectives listed in the application.

As the duly authorized representative of the applicant I certify that
1. Has the legal authority to apply for Federal assistance,
and the institutional, managerial and financial capability
(including funds sufficient to pay the non -Federal share
of project costs) to ensure proper planning, management
and completion of the project described in this
application.
2. Will give the awarding agency, the Comptroller General
of the United States, and if appropriate, the State,
through any authorized representative, access to and the
right to examine all records, books, papers, or documents
related to the award; and will establish a proper
accounting system in accordance with generally accepted
accounting standards or agency directives.

the Civil Rights Act of 1968 (42 U.S.C. § 3601 et seq.),
as amended, relating to nondiscrimination in the sale,
rental or financing of housing; (I) any other
nondiscrimination provisions in the specific statute(s)
under which application for Federal assistance is being
made; and 0) the requirements of any other
nondiscrimination statute(s) which may apply to the
application. __
7. Will comply, or has already complied, with the
requirements of Titles II and III of the Uniform
Relocation Assistance and Real Property Acquisition
Policies Act of 1970 (P.L. 961-646) which provide for
fair and equitable treatment of persons displaced or
whose property is acquired as a result of Federal or
federally assisted programs. These requirements apply to
all interests in real property acquired for project purposes
regardless of Federal participation in purchases.
Will comply with the provisions of the Health Act (5
U.S.C. §§ 1501-1508 and 7324-7328) which limit the
political activities of employees whose principal
employment activities are funded in whole or in part with
Federal funds.
9. Will comply, as applicable, with the provisions of the
Davis -Bacon Act (40 U.S.C. §§ 276a to 276a-7), the
Copeland Act (40 U.S.C. § 276c and 18 U.S.C. §§ 874),
and the Contract Work Hours and Safety Standards Act
(40 U.S.C. §§ 327-333), regarding labor standards for
federally assisted construction subagreements.
