A RESOLUTION TO APPROVE A CONTRACT WITH JOHN
BARRE LANDSCAPE CONSTRUCTION IN THE AMOUNT OF
$44,950.00 FOR THE PURCHASE AND INSTALLATION OF NEW
PLAYGROUND EQUIPMENT AT THE LAKE FAYETTEVILLE
SOFTBALL COMPLEX
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council approves a contract with John Barre
Landscape Construction in the amount of $41,950.00 for the purchase and
installation of new playground equipment at the Lake Fayetteville Softball
Complex and authorizes the Mayor to sign the contract for the City of
Fayetteville.

In regards to Resolution No. 79-01, there is no contract with John Barre Landscape Construction
in the amount of $44,950.00, for the purchase and installation of new playground equipment at
the Lake Fayetteville Softball Complex, per Eric Schuldt, Parks Development Coordinator, Parks
and Recreation Department, even though backup and resolution suggests a contract.
City Attorney, Kit Williams, refused to re -write the resolution excluding the contract He also
said there was no contract for this resolution.

Fayetteville, Purchasing Office, Room 306, 113 West Mountain Street, Fayetteville, Arkansas,
72701 in a sealed envelope marked "Lake Fayetteville Playground "RFP 01-03." Each bidder will
be required to meet or exceed the specifications attached. Any deviation must be noted with

Lake Fayetteville Playground
The Parks and Recreation Division and the Lake Fayetteville Playground Selection Committee
requests award of RPF #01-03 for the Lake Fayetteville Softball Complex playground equipment
to John Barre Landscape Construction in the amount of $44.950.
The project was awarded according to the request for proposal procedure in which playground
companies submit a design based upon specifications and a budget of 545.000. The proposal
includes all equipment, ground play surfacing and installation. Members serving on the
professional services committee included Lioneld Jordan - City Council, Jan O'Connell - Citizen.
Don Bunn - Engineering. Connie Edmonston - Park and Recreation. Nancy Smith - Accounting.
Eric Schuldt - Parks and Recreation and Mike Stephens - Citizen. A total of five designs were
submitted for the project and all were evaluated based on criteria including. aesthetics. durability.
and play value. A Miracle Recreation Equipment Company playground was chosen by the
committee.
We request approval of this playground equipment for the Lake Fayetteville Softball Complex.
This new playground will replace old equipment which no longer meets safety standards.
