HomeMy WebLinkAbout37-01 RESOLUTION• • RESOLUTION NO. 37-01 A RESOLUTION APPROVING AMENDMENT #1 FOR CONSTRUCTION MANAGEMENT OF MOVING THE CITY WATER MAIN FROM THE TWO EXISTING BRIDGES ON HIGHWAY 45 OVER THE WHITE RIVER TO THE TWO NEW BRIDGES OVER THE WHITE RIVER BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the City Council hereby approves Amendment #1 to an engineering contract with McClelland Consulting Engineers, Inc. in the amount of $29,920.00 plus a 15% contingency of $4,488.00 for construction management of the moving of the City's water main from the old bridges to the new bridges over the White River on Highway 45. A copy of the amendment is attached hereto and made a part hereof, Exhibit "A". t It rp4SSED AND APPROVED this F.C-Pday of March, 2001. .;• 1 +` 1 .+ ++ ATTEST By: 4 eather Woodruff, City Clerk APPROVED: By: DAN COODY, Mayo 1 • • • EXHIBIT A Ai sst AMENDMENT NO. 1 TO AGREEMENT FOR ENGINEERING SERVICES CITY OF FAYETTEVILLE CONSTRUCTION PHASE SERVICES FOR HIGHWAY 45 EAST WATER MAIN RELOCATION The Agreement listed above and dated May 2, 2000 did not include Construction Phase services for the water main project. This Amendment to the Agreement is hereby made for that purpose. ARTICLE 1, SCOPE REVISIONS The Scope of Work is amended to include; construction observation services for a full time resident observer to be on site while pipe is being installed, contract administration services to include routine progress pay estimates, change orders, preconstruction conference and progress conference participation, and contract close out services, including record documents. Specific services shall include the following: 1) Coordinate and conduct a preconstruction conference. 2) Provide a resident construction observer, whose duties and responsibilities shall be as follows: a) Provide full-time, resident inspection of the construction to observe the progress and quality of the work executed by the contractor to determine if such work is in accordance with the contract documents. b) Endeavor to guard the OWNER against defects and deficiencies in such work. c) Maintain a daily diary which shall be open for inspection by the OWNER in which the following shall be recorded in indelible ink: (1) Work performed. (2) Number of men and equipment with detailed description of equipment used in such work. (3) Defects and deficiencies in such work, if not corrected by the contractor. (4) Weather conditions. d) Submit a copy of the daily logs for each week to the OWNER no later than Monday of the following week. e) Verify that the contractor is: (1) Using construction methods and materials in accordance with the specifications. (2) Constructing water lines within the easements provided. (3) Constructing water mains in compliance with specifications (especially depth of cover and acceptable bedding and backfill materials) before initial backfilling is performed. FY002255/Amendment I.doc rn X -1 D • • 0 Advise the contractor when the work performed is not meeting the conditions set forth in subsection (e) above. The contractor shall be instructed to correct any observed deficiencies and/or instructed to stop work, as appropriate. Records will be made of the observation, the discussion, and the actions taken. If the contractor continues without satisfactory corrective action, the OWNER will be notified immediately, so that appropriate action under the OWNER's contract with the contractor can be taken. 3) The Engineer and resident construction observer will endeavor to protect the OWNER against defects and deficiencies in the work of the Contractor. However, the Engineer and Construction Observer cannot guarantee the performance of the Contractor, nor be responsible for the actual supervision of construction operations of for the safety measures that the Contractor takes or should take. 4) Provide plan interpretation, review material submittals, and provide general contract administration. 5) Review the contractor's monthly pay request and provide a recommendation on it the OWNER. 6) Prepare contract change orders if needed. 7) Conduct three (3) status and progress meetings with contractor durmg course of the construction period. 8) Conduct final inspection and make recommendations to OWNER regarding approval of work. 9) Prepare post construction documents and provide to OWNER including summary of quality control tests, bacteriological test reports and record drawings as provided by contractor. ARTICLE 2, FEE REVISIONS The Fees and Payments established in the Agreement are amended to include compensation for Construction Phase services as listed in Appendix "C" and as follows: 1) "Construction" phase services not to exceed: $26,450.00 2) Fixed fee for "Construction" services: $3,470.00 3) "ENGINEERING" contract amendment amount for "Construction" phase services not to exceed: $29,920.00 ARTICLE 3, TIME OF PERFORMANCE The construction documents provide for a two phase construction project, as follows: 1) Phase 1, water main outside the Highway Right of Way, to be completed while the bridge is being constructed. A 75 calendar day period is allowed for this phase. 2) Phase 2, water main inside the Highway Right of Way and attached to the bridge, to be completed immediately after the bridge construction is complete. A 30 calendar day period is allowed for this phase. 2 • • • Time of performance is therefore dependent upon the completion of the bridge construction by the Highway Department's contractor. The ENGINEER shall perform his services as necessary to comply with these constraints and to minimize overall project delays The ENGINEER shall provide Record Drawings within 60 days of construction completion. Water Main Relocation Amendment #1 to the Engineering Contract The above referenced project is a Highway Department Project under construction. City of Fayetteville has a water main that is attached to the two bridges at the present time. Since there will be two new bridges constructed and the old bridges to be taken down, the water main has to be relocated to the new bridges. McClelland Consulting Engineers, Inc. Was selected to perform the design and bidding phase of this project, as the first phase of their contract. Attached please find the Amendment #1 to the existing engineering contract with McClelland Consulting Engineers, to provide the construction management for this project, as the second phase of their contract. The cost of this agreement to the City will be $29,920.00. The Staff is requesting the Council approve the following: (1) Approval of the Amendment #1, for a not to exceed amount of $29,920. (2) Approval of $4,488 (15%)Project Contingency to cover unexpected expenses subject to the approval of the Mayor.
