Subject: Senior Citizen Center Background The council is certainly aware that after several years of effort, a contract for construction of a Senior citizen Center was authorized by Resolution # 4-01 in January of this year. The contract was awarded to Harrison Davis Construction Company in the amount of $1,982,600 with no contingency built into the contract. It was understood by representatives from the Council on Aging that all change orders for work and material left out of the base contract would be their responsibility. It should also be noted that the financing for this project has drawn money from a temporary property tax millage that was collected for a year. In addition, the Community Development Department and the Parks Development fund have also contributed significant amounts toward this effort. Current Situation Over the past several weeks, there has been a great deal of concern over the pace of the construction since the issuance of the notice to proceed in February. Last Wednesday, representatives from all parties met at city hall for the specific purpose of clarifying roles and responsibilities among the parties. The meeting was very successful in achieving that objective. As was noted in the memo that the council received, there are more than a few issues, which remain to be resolved. However, assurances were received that the contract will be completed within the original budget and that the contractor of record wants to fulfill his obligation. The particular issue before the council at this time is a resolution to approve a change order in the amount of $100,192 for the installation of kitchen equipment that was not included in the base contract. Our position on this expenditure was clear. The Council understands this position and has agreed in writing to pay for this equipment. Recommendation The Council on Aging has approved the kitchen equipment purchase on the recommendation of their architect and has committed in writing to pay for said equipment. From the city perspective, we will be closely monitoring this project and will be working with all parties over the next several weeks to develop a process to handle what all parties acknowledge will be inevitable. That inevitability is a number of change orders to this project during construction. We recommend that this change order be approved. All comments on this project from City staff will be his responsibility. • The Council on Aging will be responsible for designating a spokesperson • Harrsion Davis Construction Company committed to completion of the project. • The City commitment to this project is capped at $1,982,600. That amount is the contract between the City and Davis Construction. City and Council representatives will determine the issue of what constitutes an acceptable commitment by December 14th, 2001. • There will be at a minimum bi-weekly meeting between the parties to ensure that acceptable progress is being made. • The architect agreed to fax meeting dates and an agenda to all parties as part of the preparation for the bi-weekly meetings. • Harrison Davis Construction will provide, at a minimum, a monthly progress report that summarizes their progress against the project time line. • The City will not process any change order that has not been approved by the representative from the Council on Aging. • The issue of additional days and the imposition of liquidated damages were not discussed.
