HomeMy WebLinkAbout158-01 RESOLUTIONRESOLUTION NO. 158-01 r A RESOLUTION AWARDING A CONTRACT TO RICHARD UTLEY IN THE AMOUNT OF TWENTY-THREE THOUSAND SEVEN HUNDRED DOLLARS ($23,700.00) TO OPERATE THE LAKE SEQUOYAH BOAT DOCK FOR CALENDAR YEAR 2002. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the City Council hereby awards a contract to Richard Utley in the amount of Twenty -Three Thousand Seven Hundred Dollars ($23,700.00) to operate the Lake Sequoyah boat dock for calendar year 2002. A copy of the contract is attached hereto marked Exhibit "A" and made a part hereof. Section 2. That the City Council hereby authorizes the Mayor to sign such a contract with Richard Utley. ISE -ti tea sc CITY OF FAYETTEVILLE Lake Sequoyah Boat Dock Operator Contract OPERATING CONTRACT FOR LAKE SEOUOYAH BOAT DOCK For the total amount of $1,975.00 to be paid in monthly installments, Richard Utley (the "Contractor") agrees to provide the list of services and requirements to the City of Fayetteville beginning January 1, 2002 and ending on December 31, 2002. The term of this agreement is for a twelve month period. Either party may cancel this contract by giving the other party thirty days written notice of cancellation. Richard Utley (the "Contractor") further certifies possession of the initial capital monies to commence boat dock operations. The City agrees to pay the Contractor in current funds for the performance of the listed services and requirements by making payments to the contractor no later than the 15' of each month. CONTRACTED SERVICES AND REQUIREMENTS 1. Contractor shall operate and manage the Lake Sequoyah Boat Dock. Shall be an independent contractor, not an employee of the City. Opens and closes the lake gates seven days a week at sunrise and sunset. The Lake Sequoyah Boat Dock is closed each year form December 24 through January 14. The operator is responsible for supervising the boat dock during this time. 2. Collect boat stall rentals, storage rentals, fishing permits, and boating permits. These fees are submitted to the Parks and Recreation Office on a weekly basis. 3. Prepare reports and keep records as required by the Parks and Recreation Superintendent. 4. Enforce lake rules and regulations as adopted by the Fayetteville Code of Ordinances Chapter 97, Section 97.070 and 97.999. 5. Purchase and provide proof of liability insurance with a minimum coverage of: $300,000.00 for one person involved in death or injury. $500,000.00 for two or more persons involved in death or injury. 6. Receive prior approval from the Parks and Recreation Superintendent, for any special event conducted at Lake Sequoyah. 7. Mow the yard surrounding the boat dock office and dock area to maintain a manicured appearance. 8. Pick up trash and clean the office and bathroom on a daily basis. Contractor is to supply cleaning and bathroom supplies. 9. Conduct the following at the Lake Sequoyah Boat Dock: a. Sell concessions in compliance with all applicable State & Federal Laws, • Res. iS2-01 Municipal Ordinances, Health Department Regulations and the rules and regulations of all authorities having jurisdiction over the performance of this project. b. Sell fish bait. c. Provide other services which the Parks and Recreation Superintendent determines will enhance the operation of Lake Sequoyah. 10. On call to the boat dock operations 24 hours a day. 11. Upon budget approval by the City Council, the term of the Contract shall be for one (1) year. However, said Contract may automatically renew for four (4) consecutive one (1) year terms, with compensation being adjusted each renewal period by the Consumer Price Index for the prior year. Such automatic renewal shall be subject to budget approval by the City Council. 12. Either party may terminate this contract at any time by giving the other party thirty (30) days written notice of termination. The term of the contract is one year. The contract may be automatically renewed for five consecutive one year terms, with a compensation adjusted each renewal period by three percent of the contracted amount for the prior year. Frank Thorpe operated the boatdock for the past six and a half years until his death on May 1, 2001. Mrs. Thorpe and Richard Utley have operated the lake until the end of the year as approved by City Council in May. Current Status Two bids for the Lake Sequoyah Boatdock Operator RFP were received. On October 29, 2001, the Professional Selection Committee interviewed the two applicants. Recommendation The Professional Selection Committee and Park Staff recommend Richard Utley be awarded the Lake Sequoyah Boatdock Operator's Contract in the amount of $23,700. Mr. Utley worked full- time for Frank Thorpe for the past three years in the operations of Lake Sequoyah The City has been very pleased with Mr. Utley's performance. Attached is a copy of his resume. Operations Of Lake Sequoyah have been conducted in a Business -like way during this time treating the Wants and needs of the customers we serve with Utmost importance. Prior to operating Lake Sequoyah, I have been a Building contractor and have been retired from this Profession. Part of this was covered in qualifications. I initially Purchased needed equipment such as cash register, Refrigerator and aerators necessary for the Operation from Frank Thorpe and presently I do Own the entire inventory of the shop. No further Equipment is necessary at this time to continue the Operation. I have been an avid outdoorsman all my life and Am very knowledgeable about fishing and the rules And regulations of the lake. In my work as a Building contractor I gained vast experience in Dealing with different types of people and the Aspect of retail operations. PROPOSED WORK METHOD: My plan is to continue to serve the needs of the People who utilize Lake Sequoyah's resources in PAGE 2 OF LAKE SEQUOYAH BOAT DOCK OPERATORS CONTRACT PROPOSED WORK METHOD CONTINUED: PAST PERFORMANCE: Any possible way that is reasonable. I will continue to sell crappie and bass minnows, Goldfish in season, liver, worms etc., along with Hooks, sinkers and other terminal tackle. My aim Is to also keep the public informed about Fishing conditions and the types of fish that are Biting and to promote the lake using newspapers And the Arkansas Game and Fish Commission. Three local news papers as well as the AGFC call Each week for a fishing report which goes both Locally and statewide. Various other publications Call from time to time. The Lake Sequoyah Office is also a source of information for area Outdoorsmen and we keep current state fishing Regulations on hand free of charge. Insurance Coverage will be continued with Shelter Insurance. A copy of this insurance is on file with the City of Fayetteville. Operations will be done as instructed. I think most of this has been covered.
