HomeMy WebLinkAbout120-01 RESOLUTION• • RESOLUTION NO. 120-01 A RESOLUTION TO AUTHORIZE THE MAYOR TO SIGN A WARRANTY DEED TRANSFERRING OWNERSHIP OF LOTS 37 AND 38 IN BLOCK 2 OF GLENWOOD PARK ADDITION WHICH HAD BEEN OBTAINED THROUGH COMMUNITY BLOCK GRANT FUNDS TO THE SOUTH FAYETTEVILLE COMMUNITY DEVELOPMENT CORPORATION WHEREAS, the City of Fayetteville received from the United States Department of Housing and Urban Development a Community Block Grant to purchase run down or derelict housing and transfer it to a non-profit corporation for rehabilitation and improvement of blighted housing; and WHEREAS, the City of Fayetteville purchased such property and desires to transfer it to the South Fayetteville Community Development Corporation (a non-profit corporation) for repair, rehabilitation and construction of affordable housing. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS' Section 1. That the City Council of the City of Fayetteville, Arkansas hereby agrees to transfer by warranty deed lots numbered 37 and 38 in Block Number Two in Glenwood Park Addition of the City of Fayetteville to the South Fayetteville Community Development Corporation pursuant to its agreement to rehabilitate, repair and/ or construct affordable housing. Section 2. WHEREAS, the SFCDC is an Arkansas private non-profit corporation that develops and constructs housing that is affordable to lower income citizens of Fayetteville, and WHEREAS, the City encourages neighborhood revitalization through improvements to housing, infrastructure ans associated improvements for South Fayetteville citizens, and NOW, THEREFORE, in consideration of the benefits to be derived from programs and services described herein, the parties agree as follows; 1. The City through its Community Development Division, has obtained title to the real property generally located at 1035 S. Washington Avenue, Fayetteville, Arkansas 72701 more particularly described as; Lots Numbered Thirty -Seven and Thirty-eight (37-38) in Block Number Two (2) in Glenwood Park Addition to the City of Fayetteville, Arkansas, as the same are known and designated upon the recorded Plat of said Addition now of record in the office of the Recorder of Washington County, Arkansas (said Plat is recorded on page "91" in Plat Book and shows Addition is laid out in the Wets Half of the Northwest Quarter of the Northwest Quarter of Section Twenty -Two (22) in Township Sixteen (16) North, Range Thirty (30) West, and being situated in the County of Washington ands State of Arkansas. 2. The real property described above was acquired by the City of Fayetteville with Community Development Block Grant Funds awarded to the city by the U.S. Department of Housing & Urban Development. The purposes of the acquisition was to eliminate slums and blight on a spot basis. 3. The City will convey the real property described above to the SFCDC for the sum of One Dollar ($1.00) and other good and valuable consideration. 4. The City will furnish title insurance in the amount of $7,500.00. 5. In accordance with U.S. Department of Housing & Urban Development regulations governing the Community Development Block Grant Program, the SFCDC specifically agrees to construct housing on the conveyed property that is affordable to persons in the low to moderate income levels. The City of Fayetteville, Community Development Division has partnered with the SFCDC to acquire dilapidated property in South Fayetteville. The Bank of Fayetteville has partnered with the SFCDC to provide funding to construct the Housing. This is the second piece of property the city has purchased and donated to the SFCDC for affordable housing. Construction is ready to begin on the first piece of property. Current Status Attached is a Warranty Deed to a piece of property the City of Fayetteville, Community Development Division purchased. The property is being donated to the South Fayetteville Community Development Corporation (SFCDC). A new Warranty Deed is required from the City transferring the property to the SFCDC. The SFCDC will construct a new house on the property for a family with an income of 50% - 80% of the median, adjusted for family size. Recommendation The staff recommends approval of this resolution.
