A RESOLUTION APPROVING A CONTRACT AMENDMENT
NOT TO EXCEED THE AMOUNT OF TWENTY-FOUR
THOUSAND NINE HUNDRED FORTY-SEVEN DOLLARS
($24,947.00) WITH GARVER ENGINEERS FOR ADDITIONAL
CONCEPTUAL DESIGNS AND COST ESTIMATES FOR
IMPROVEMENTS TO OLD MISSOURI ROAD FROM THE
INTERSECTION WITH ROLLING HILLS DRIVE, NORTH TO
THE MUD CREEK BRIDGE.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
Section 1. That the City Council hereby Approves a contract amendment
not to exceed the amount of Twenty -Four Thousand Nine Hundred Forty -Seven
Dollars ($24,947.00) with Garver Engineers for additional conceptual designs and
cost estimates for improvements to Old Missouri Road from the intersection with
Rolling Hills Drive, north to the Mud Creek Bridge.
Section 2. That the City Council authorizes the Mayor to sign such an
amendment to the contract with Garver Engineers.

Re: Old Missouri Road Improvements - Professional Engineering Services Contract Amendment No. 1
Dear Jim:
As requested, please consider this our proposed Amendment No. 1 to our original contract for Old
Missouri Road Improvements dated February 20, 2001.
After meeting on June 15 with Mayor Coody, Bob Davis, Greg Boettcher, and you, we understand that
the City wants us to develop, evaluate, and present additional conceptual alternatives for Old Missouri
Road from Rolling Hills to the Mud Creek Bridge and to participate in additional public meetings and
coordination. Based on your direction as a result of our meetings on June 15 and 26, we understand we
are to develop additional alternatives in accordance with the following guidelines.
✓ Reduce Construction Cost. Specific items discussed directly related to reducing construction cost
included not raising the street near the creek as high as originally planned, narrowing typical section
elements including street, sidewalk, and trail width at strategic locations, and using open ditches
instead of underground pipes for storm drainage. Garver will also investigate other ways to save
substantial construction cost on this project.
✓ Reduce Impact to Some Adjacent Properties. This primarily included discussion of revisions to the
horizontal alignment and narrowing typical section elements including street, sidewalk, and trail
width at strategic locations.
✓ Additional Options to Evaluate. Garver will make revisions in accordance with the direction from
the City as herein stated. We will also present the following alternatives (options) for consideration
by the City in accordance with the general guidelines in our original agreement for the Conceptual
Design Phase.
Option 4 — Option 3 (original report) with the following revisions:
1. Use 28 feet back to back street width from Farr to Stubblefield and from Elaine to Mud
Creek Bridge
2. Revise curve near creek to be less sharp
3. Reduce amount roadway will be raised near creek
4. Use open ditches instead of underground stormwater pipes and inlets where possible
5. Allow existing sidewalk to remain on west side and allow 2 -ft buffer
6. Narrow trail to six feet on east side, except for in front of school
7. Move trail to west side of street north of Elaine

Option 5 — Raise the road near the creek, from Stubblefield to Elaine, as needed to eliminate
flooding, and "straighten" the curve as much as possible without significant impacts to the
creek. This option would include cross drainage improvements and construction of a new
trail/sidewalk from Stubblefield to Elaine.
Option 6— Option 5 plus widen the roadway from Rolling Hills to Farr Lane to allow for a left -
turn lane for Butterfield Trail Elementary School. This option would including cross drainage
improvements and construction of a new trail/sidewalk from Rolling Hills to Farr Lane.
Option 7 — Option 6 plus add a sidewalk on the west side from Farr to Stubblefield.
Option 8 — Option 5 plus widen the roadway only from Eaton to Farr to allow for a left -turn
lane for Butterfield Trail Elementary School. This option would including cross drainage
improvements and construction of a new trail/sidewalk from Eaton to Farr and construction of a
new sidewalk on the west side from Farr to Stubblefield. No improvements would be made
south of Eaton or north of Elaine.
Since we have already completed the Conceptual Design Phase of our original agreement, and since the
City wants us to develop and evaluate several additional conceptual alternatives, we believe it is
appropriate to ask for this amendment to cover our additional costs. Approval of this amendment would
increase our "Not to Exceed" fee for Design Phase Services by $24,947, as shown on the attached
detailed spreadsheet.
