A RESOLUTION ADOPTING THE PLANNING AREA
BOUNDARY OF THE CITY OF FAYETTEVILLE, ARKANSAS
AS REQUESTED IN AD00-10.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1. That the City Council hereby adopts the Planning Area Boundary within the
territorial jurisdiction as set out under A.C.A. §14-56-413 and as designated by the Planning
Commission on May 8, 206 A copy of the Planning Area map and legal description is attached
hereto marked Exhibit "A" and made a part hereof.

SUBJECT: Update to the Planning Area Boundary Map
STAFF RECOMMENDATION:
Staff recommends adoption of the revised Planning Area Boundary.
BACKGROUND:
The Planning Division has updated the Planning Area Boundary to reflect revisions due to
changes in the City Limits for Fayetteville, Farmington, and Springdale. There is a total of six
revisions which are shown on the attached map. No additional area is being claimed as part of
this update.
The updated Planning Area described boundary is 57.86 miles long, contains 379 calls, and has
an area of 55,142 acres or 86.16 square miles (45.08 sq. miles inside Fayetteville City Limits,
41.08 sq. miles planning area outside City Limits). Overall, this update has resulted in a new
metes and bounds legal description that is tied to State Plane Coordinates and can be utilized as
part of the Fayetteville Geographic Information System
Regarding adoption of the Planning Area Boundary, Washington County Quorum Court recently
has been discussing how cities are adopting and enforcing regulations within the Planning Area
Boundaries.
I have checked with the City Clerk's office and have found ordinances which include legal
descriptions adopting Fayetteville's Planning Area Boundary which have been filed and recorded
at the County.
Furthermore, the Planning Division, in 1996, did file at Washington County the Fayetteville
General Plan 2020 Future Land Use Plan and the Master Street Plan that also identified the
Planning Area Boundary. A copy of both plans were hand delivered to the County Planner on the
same day they were filed.

§ 14-56-413. Territorial jurisdiction
(a)(1)(A) The territorial jurisdiction of the legislative body of the city having a planning commission, for
the purpose of this subchapter, shall be exclusive and shall include all land lying within five (5) miles of
the corporate limits.
(B) If the corporate limits of two (2) or more municipalities of the first or second class are less
than ten (10) miles apart, the limits of their respective territorial jurisdictions shall be a line
equidistant between them, or as agreed on by the respective municipalities.
(2)(A) Cities now having eight thousand (8,000) population or more and situated on navigable streams
shall have the authority to administer and enforce planning and zoning ordinances outside their
corporate limits as follows:
(i) For cities of eight thousand (8,000) to fifty thousand (50,000) population, the jurisdictional
area will be one (1) mile beyond the corporate limits;
(ii) For cities of fifty thousand (50,000) to one hundred fifty thousand (150,000) population,
the jurisdictional area will be two (2) miles beyond the corporate limits;
(iii)(a) For cities of one hundred fifty thousand (150,000) population and over, the
jurisdictional area will be three (3) miles beyond the corporate limits.
(b) Upon July 3, 1989, no city with a population in excess of one hundred fifty thousand
(150,000) persons and which is situated on a navigable stream shall exercise any zoning
authority outside the boundaries of the county wherein it is located without the approval of the
quorum court of the county wherein the city is not located and the approval of the governing
bodies of all other cities having zoning authority over the area.
(B) The city populations will be based on the latest available United States census data.
(C) The provisions of subdivision (a)(2) of this section shall not restrict the powers of any city
currently exercising the authority authorized under this subdivision.
(b)(1) The planning commission shall designate the area within the territorial jurisdiction for which it will
prepare plans, ordinances, and regulations.
(2) A description of the boundaries of the area shall be filed with the city clerk and with the county
recorder.

§ 14-56-414. Preparation of plans.
(a) Studies. The planning commission shall undertake suitable studies related to the plans to be prepared.
The studies shall be conducted after the completion of the planning area map and prior to the preparation
of the plans.
(b)(1) Land Use Plan. The commission may prepare and adopt a land use plan which may include, but
shall not be limited to:
(A) The reservation of open spaces;
(B) The preservation of natural and historical features, sites, and monuments;
(C) The existing uses to be retained without change;
(D) The existing uses proposed for change; and
(E) The areas proposed for new development.
(2) The plan may include areas proposed for redevelopment, rehabilitation, renewal, and similar
programs.
(c)(1) Community Facilities Plan. The commission may prepare and adopt a community facilities plan
indicating the general location and extent of the service areas of, and the future requirements of:
(A) Community facilities such as schools, playgrounds, recreational areas, hospitals, special
education facilities, and cultural facilities;
(B) Governmental buildings and areas;
(C) Public and private utility terminals and lines; and
(D) Transportation terminals and lines.
(2) The plan may indicate areas to be reserved for future public acquisition as provided in this
subchapter.
(d)(1) Master Street Plan. The commission may prepare and adopt a master street plan which shall
designate the general location, characteristics, and functions of streets and highways.
(2)(A) The plan shall include the general locations of streets and highways to be reserved for future
public acquisition.
(B) The plan may provide for the removal, relocation, widening, narrowing, vacating,
abandonment, and change of use or extension of any public ways.
(e) Other Plans. The commission may prepare and adopt such other plans as are significant to the health,
safety, and general welfare of the municipality and its environs.

AD 00-10.00: Administrative Item (City of Fayetteville)
Item submitted by the City Planning Division to discuss updating the planning area boundary.
Odom: The next item on tonight's agenda is AD 00-10 submitted by the City Planning
Division to discuss updating the planning area boundary. Not surprisingly Staff
recommends adoption of the revised planning area boundary. Staff, would you
like to tell us about this.
Conklin: This is basically a house cleaning item. We have been working on revising our
planning area boundary to make sure it does not encroach into other jurisdictions'
city limits. There are six revisions that have been made and I have included a
map on page 4.2 and a larger map that is before you this evening. The first
revision is where our planning area boundary encroaches into the city of
Springdale to the north and east of Hwy 265. The second change is to
accommodate a change in our city limits with the recent annexation just west of
Double Springs Road. The third is to remove our planning area boundary out of
the city of Farmington's city limits. That is shown on the map west of Double
Springs Road also. The fourth is to accommodate a change in the Fayetteville city
limits and that is a result of our annexation of the 300 acres for a sewage treatment
plant. The fifth and sixth changes, which are south of Hwy 62, are removing our
planning area boundary out of the Farmington city limits. We have not expanded
our planning area boundary. The area that we are showing is what has been
adopted since the early '70's. Basically it's to clean up our planning area
boundary where it does encroach into these other city limits. Staff is bringing
forward and working on updating our 2020 Plan with regard to our planning area
boundary. This is one of the first plans we will look at with regard to any changes
we will want to make to that and I'm looking at starting that in the next month.
So we will have changes that potentially could be made to that boundary,
however, this planning area boundary that's before you tonight, I really would like
to adopt is and get it filed over at the county. It is a brand new legal description in
the State Plane Coordinate system. It works with our geographic information
system and basically it will be a starting point for us to look at a legal description
that when we do make amendments we can actually amend this legal description
that we adopt. That's all I have. If you have any questions, I'll be happy to
answer them.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1. That the City Council hereby adopts the Planning Area Boundary within the
territorial jurisdiction as set out under A.C.A. §14-56-413 and as designated by the Planning
Commission on May 8, 200. A copy of the Planning Area map and legal description is attached
hereto marked Exhibit "A" and made a part hereof.
