A RESOLUTION RECOGNIZING WASHINGTON COUNTY
CIRCUIT/CHANCERY COURT JURISDICTION OVER STAYS
REGARDING TREE REMOVAL OF LSD 00-5.00 AND
THEREBY DENYING ANY FURTHER REQUESTS FOR SUCH
STAYS FROM THE FAYETTEVILLE CITY COUNCIL
WHEREAS, in Serafini, et at vs. City of Fayetteville, et al., Washington County Case No.
2000-536, Plaintiffs have filed an appeal of the Planning Commission decision to grant large scale
development approval to the developers of the Steele Crossing Shopping Center; and
WHEREAS, in that appeal the Plaintiffs asked the Chancery Court in Case No. 2000-997,
to prelimHaiy enjoin the removal of trees on LSD 00-5.00 which is the Steele Crossing Shopping
Center; and
WHEREAS, an order was issued by the Chancery Court on May 31, 2000 enjoining Argus
Properties, L.L.C. and Fayetteville Exchange L.L.C. from removing any trees on the property known
as LSD 00-5.00 pending the appeal above and setting a bond of $310,000 to be paid on or before 12
p.m. (noon) on Friday, June 2, 2000 in order for the injunction to issue.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF FAYETTEVILLE, ARKANSAS:
Section 1. As a result of the appeal filed in this matter, the City Council hereby
recognizes Washington County Circuit/Chancery jurisdiction over stays regarding tree removal of
LSD 00-5.00 (Steele Crossing Shopping Center).
Section 2. As a result of such recognition, the City Council hereby denies any further
requests ibr such stays and directs those seeking such stays to make application in the Courts and
not to the City Council.
