BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS Section 1. That the City Council hereby authorizes the Mayor and City Clerk to execute a cost share agreement with Lindsey -Green Commercial Properties in an amount not to exceed $23,452.50, for drainage improvements between Millsap and Highway 71. COMMERCIAL Awag PROPERTIES 113 West Mountain Street Fayetteville, AR 72701 Dear Mr. Venable, We recently discussed the possibility of a cost sharing arrangement between Millsap Center, LLC and the City of Fayetteville to fund improvements to the drainage ditch that runs between Millsap Road and the Highway 71 bypass along the west property line of the Millsap Center office project. Enclosed is a cost estimate and a cross section of the drainage channel repairs, both prepared by Crafton, Tull and Associates, Inc. The cost estimate is for paving the ditch with concrete between Millsap Road and the highway right-of-way. The area is flat and water stands in the ditch continually. During heavy rains, water backs up quickly from a highway culvert immediately to the north and ruts out the ditch. The ruts are deep and contribute to the water being trapped. There is also standing water immediately north of our north property line in the highway right-of-way. We have obtained permission from the AHTD to regrade this area, at our expense, to facilitate the movement of water from this area into the drainage ditch. We plan to complete that work shortly. The easement for the drainage ditch between Millsap Road and the highway right-of-way adjoins our property, but is not on our property. We have looked at the possibility of funding the improvements on our own, but the cost is high enough that it is not feasible for us to do so. If we can work out a satisfactory cost arrangement, we are willing to pay a portion of the cost of the improvements. You will note that the estimate includes the cost of improvements only to the south highway right-of-way line. It would probably be desirable to place riprap between the south highway right-of-way line and the existing culvert under the highway,.@lthat cost included xi the'nclosed estimate. This channel has presented maintenance problems in the past including excessive vegetation growth which reduces the carrying capacity. The channel is hard to maintain due to the soft bottom and limited access. The developer of an adjacent property has offered a cost share to concrete line the channel from Millsap to Highway 71 right-of-way. This will benefit the City with reduced maintenance costs and increased drainage capacity. The estimated total costs by the developer's engineer, Crafton-Tull and Associates, are $46,905.00 The requested cost -share is 50%, or $23,452.50.
