A RESOLUTION GRANTING A TEMPORARY REVOCABLE
LICENSE FOR THE PLACEMENT OF BURIED FIBER OPTIC
COMMUNICATION CABLE 114 THE STREET AND ALLEY
RIGHTS-OF-WAY.
BE 1T RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS•
Section 1. A temporary revocable license is hereby granted to Alltel Communications
for the placement and maintenance of buried fiber optic communication cable in the street and alley
rights-of-way at the following locations:
The location of the facility would begin at Futrall Drive and Wedington Drive,
Wedington to Lonnie Drive, Lonnie to Ora Drive, Ora to Sang Avenue, Sang to
Halsell Road, Halsell to Cross Avenue, Cross to Markham, Markham to Sang, Sang
to ALLTEL Cell Site Leaving the cellular site bury north on Hotz Drive to Harman
Avenue, south along Hartman to Center Street and Center to Razorback Avenue, at
Razorback and Meadow to Southwestern Bell manhole.
The portion from Futrall Drive and Wedington to Sang Avenue, will be in
Southwestern Bell duct and beginning again with Southwestern Bell duct at
Razorback and Meadow, Meadow to Center Street, east to Block Street, north on
Block to Spring, Spring to the Southwestern Bell office and out of the Southwestern
Bell office north on East Avenue, to Dickson, Dickson to Highland, Highland to
Maple, Maple to College, College to Milsap. This will all be Southwestem Bell duct.
The portion from College Ave. on Milsap to Futrall Dr., to U.S. 71 will be
constructed by Alltel
A map depicting the route described above, is attached hereto as Exhibit "A" and
made a part hereof.
Section 2. The City shall have no responsibility for the maintenance of said buried fiber
• optic communication cable. If the fiber optic communication cable is damaged in any manner, same
shall be removed by the licensee at the licensee's sole cost and expense in a manner meeting the
approval of the Mayor. Upon thirty (30) days notice from the Mayor, the licensee shall remove the
fiber optic communication cable from the City right-of-way at the licensee's sole cost and expense
and in a manner meeting the approval of the Mayor. The licensee shall hold the City harmless from
and indemnify the City from all expenses, losses, costs, causes of action and Judgments, including
legal expenses arising from the placement and maintenance of said improvements. Alltel shall
contact the Arkansas One Call system for field locations of utilities prior to placement of the fiber
optic cable. Alltel shall provide advance notice to all franchise utility companies within the City and
will reimburse said companies for any relocation costs necessitated by the cable installation. Prior

to the installation of the cable, at a time determined by the Public Works Director, Alltel shall place
a $500,000 performance bond with the City to cover the cost of repairs or other incidental costs to
the City associated with service interruption resulting from the installation of the fiber optic
communication cable. Alltel shall bore streets whenever possible. Where street cuts are
unavoidable, as determined by the Public Works Director, they shall be approved by the Public
Works Department and performed in accordance with all street cut ordinances, policies and
procedures. The City reserves the right to impose reasonable fees for the location of the permitted
or other facilities in the public rights-of-way and the City is currently developing a franchise
agreement which, when prepared, shall be substituted for this temporary revocable license. The
terms of this temporary revocable license are deemed accepted by the licensee by the licensee's
initial or continued placement or maintenance of the fiber optic communication cable at said
location Any marking posts installed by the licensee shall be no higher than 24" in residential areas.

ALLTEL Communications Inc , is requesting that the City Counsel consider approval
of our application for a temporary revocable license to place a buried fiber optic communication
cable within a Public Right -Of -Way. The location of the facility would begin at the northwest corner
of Futrall Dr. and 6th Street to Old Farmington Rd. then north to Sang Av., Snag to Eastern Ave.
Eastern to Nettleship St.,Nettleship to Hartman Av. ,Hartman north to Center St. at Center and
Hartman we will go aerial to Sang Ave., then back to buried to Hotz Dr., Hotz to the ALLTEL cell
site. Leaving the cellular site bury north on Hotz Dr. to Hartman Ave. south along Hartman to Center
St and Center to Razorback Ave., at Razorback and Meadow to a Southwestern Bell manhole All of
the above will be constructed by ALLTEL.
The portion beginning with the manhole on Razorback we will use Southwestern Bell
underground duct from that point back to Center St., east to Block St., north on Block to
Spring, Spring to the Southwestern Bell office and out of the Southwestern Bell office north on
East Ave., to Dickson, Dickson to Highland, Highland to Maple, Maple to College, College to
Milsap. We will end the Southwestern Bell duct at Milsap Rd.
The portion from College Ave on Milsap to Futrall Dr., to US 71 will be constructed by ALLTEL.
