A RESOLUTION APPROVING ENCROACHMENTS INTO THE
CITY'S RIGHT-OF-WAY FOR THE PURPOSE OF
CONSTRUCTING A BALCONY ON THE NORTH WAL OF 21
WEST MOUNTAIN STREET, AS REQUESTED BY EXECUTIVE
SQUARE, INC.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1. That the City Council hereby approves encroachments into the City's right-
of-way for the purpose of constructing a balcony on the north wall of 21 West Mountain Street, as
requested by Executive Square, Inc. Plans for the balcony are attached hereto marked Exhibit "A"
and made a part hereof.

SUBJECT: Balcony above Ozark Mountian Brew Pub
Last Friday staff met with the applicant on site to discuss several issues regarding the proposed
balcony above the Ozark Mountain Brew Pub. Staff is recommending that the location of the
three supporting balcony posts be moved 1 V2 feet further to the north to avoid obstructing
pedestrians using the side walk There are also two existing trees that will be impacted and will
likely result in their removal. Staff is recommending the applicant pay $350 per tree for the
replacement of two trees that will be installed at a later date by the City.
Attached are revised plans that show the location of the balcony, trees, sidewalks, and adjacent

Re: Balcony at the Southeast Corner of Block Street and Mountain Street above the Ozark
Mountain Brew Pub.
Dear Mr. Conklin;
Attached is the revised plan, per your suggestion, showing the balcony extending 7' - 6" off
the building in lieu of the original 6' - 0". Also, shown are the dimensions for existing trees,
light pole and planter in reference to the balcony columns. We have also included a drawing
of the column detail and column cap. This balcony will be for private use by Bradberry &
Associates and will not be used by the public from the Brew Pub.

Dear Heather;
We are requesting to be added to the agenda of the City Council Meeting on September 19, 2000.
We are proposing as per the drawings attached to construct a balcony on the front of #1 West
Mountain for Executive Square Inc., doing business as Bradberry & Associates. The North wall
of the above referenced building is sitting on the North property line according to the plans by
John E Mahaffey and Associates, Inc. Consulting Engineers dated June 1980 revised on July 11,
1980.
The following is the Legal Description of said property:
All Lots Numbered Two (2) through Seven (7) in Block Thirty (30) as designated on the
Original Plat of the Town of Fayetteville, being a part of the Northeast Quarter (NE1/4) of
the Southeast Quarter (SE1/4) of Section 16, Township 16 North, Range 30 West,
situated in Washington County, Arkansas, and being more particularly described as
beginning 30.00 feet West of the Northeast Corner of said Block; thence South 155.0
Feet; thence West 184.33 Feet; thence North 155.00 Feet; thence East 184.33 Feet to the
point of beginning; containing 0.656 Acres more or less.
Also Lot One (1) of Block Thirty (30) as designated on the Original Plat of the Town of
Fayetteville, being a part of the Northeast Quarter (NE1/4) of the Southeast Quarter
(SE1/4) of Section 16, Township 16 North, Range 30 West, situated in Washington
County, Arkansas, and being more particularly described as beginning at the Northeast
