A RESOLUTION GRANTING AN EASEMENT OVER 25 FEET
OF LAND NEAR RAZORBACK ROAD FOR THE PURPOSES OF
INGRESS AND EGRESS FOR A PARKING LOT AS
REQUESTED BY KENNETH MOURTON ON BEHALF OF THE
RAZORBACK FOUNDATION, INC.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1. That the City Council hereby grants an easement over 25 feet of land near
Razorback Road for the purposes of ingress and egress for a parking lot as requested by Kenneth
Mourton on behalf of the Razorback Foundation, Inc. A copy of the easement description is
attached hereto marked Exhibit "A" and made a part hereof.

RE: Land on Razorback Road
Dear Jerry:
Per our telephone conversations yesterday please find enclosed a survey, a title binder and a
rendition of the proposed entrance by McClelland Engineers.
As I discussed with you, the Razorback Foundation, Inc. is in the process of buying 9.7 acres on
Razorback Road and 35 acres on 15th Street from Vlassic Foods. It is the intention of the Razorback
Foundation to donate the land to the University of Arkansas and it is my understanding that the
University of Arkansas will build a parking lot on the 9.7 acres.
Once we reviewed the title binder it became obvious that the City owns 25 feet if land between the
9.7 acres and Razorback Road except for the last 136 feet before the intersection of Razorback Road
and 15th Street. The University could have the entrance in this section but we believe it would cause
massive traffic problems for the City and the Foundation had always planned for the entrance to be
further up Razorback Road as show in the McClelland rendition.
So as to avoid traffic problems for the City, the State Highway and the University of Arkansas, we
would request that the City grant an easement over the 25 feet for the purposes of ingress and egress
for the parking lot that will be constructed at that location.
